The Regular Meeting of Mayor and Council was held on August 19, 2014, in the Blue Springs City Hall, Blue Springs, NE.

Notice of the meeting/hearing was given in advance by posting in at least three public places as shown by the certificate of posting placed on file. Notice of the hearing/meeting was simultaneously given to the Mayor and all members of the City Council and a copy of their acknowledgment of receipt and agenda are placed on file. Availability of the agenda was communicated in the advance notice and in the advance notice to the Mayor and City Council of the hearing/meeting. Proceedings hereafter shown were taken while the convened hearing/meeting was open to public attendance.
At 7:30 PM, Mayor Meyer called the Regular meeting to order and roll call was taken. A motion was made by Council member Wolf, seconded by Mewes, and followed by a 4-0 affirmative vote to approve as sent the August 5, 2014 Regular meeting minutes. CITY CELEBRATION: FINAL REVIEW, AS NEEDED: Public attendance alone qualified the event as a success. Only positive comments were made to Mayor Meyer, and Council members Mewes, Neumann, Reedy and Wolf. Connie Mewes did suggest need for caution to protect children in the area when several of the car show participants were leaving (speed above limit). Neumann stated that a minor incident occurred - health issue of Tractor show participant), but all ended well. Council member Mewes reported noticing a steady flow of visitors to the cabin (Count per Jan Morris - 100+ - “a record.”) Morris commented about the buffalo hide and fur trader trademark, and also was grateful for the recent electrical work done at the cabin. Reedy reported Car/Motorcycle participation -66; Neumann indicated there were 4 or 5 new Tractor participants, with count down 2-3 from last year. All things considered, (as same-day competitive events in surrounding area, for one of which inflated participation information was initially received), the result of promotion and a fine day of weather was an impressive turnout. Gratitude of Mayor and Council was expressed to: Tim Brown for volunteer mowing (providing his own equipment and fuel), cleaning the park shelter, fixing the table (providing materials), pursuit of door prizes, and other aspects. Connie Mewes was thanked for providing the Tractor Show pens at her own expense. The City crew was thanked for extra clean up efforts which made the City look good. Council member Wolf apologized for not (due to medical issues) taking an active role in this year’s preparations. In closing, Mayor Meyer thanked all facilitators and volunteers.
CHAMBERLIN MEMORIAL: FINAL REVIEW, AS NEEDED: Jan Morris indicated that the dedication went well, which included impressive public attendance, a high level of reception and public availability of the speakers and their faction, a pictorial by the Arbor State; and a video record (online). Council member Wolf noted that he saw “a very nice article and (Arbor State) pictures” on the Husker site. Success was in no small part attributable to Jan Morris herself who put forward a supreme and greatly appreciated effort, giving generously of her own time and personal assets. (Chamberlin donations prior to meeting: $3,060.00. Added at meeting: $210, with $10.00 of it previously logged, resulted in a current amount of $3,260 with at least one more donation anticipated in route by mail.)
PLANNING & ZONING, REQUEST TO RECLASSIFY RESIDENTIAL PROPERTY TO AGRICULTURAL (T. CARY): Gladys Cary was advised to provide all needed information for review of the situation to the Planning and Zoning Commission. Positive reception to the request would result in a Public Hearing of the Planning and Zoning Commission and Public Hearing of the City Council (with Ordinance prepared). It was noted that, within the process, specifics must be posted - Legal description of property for which request is made, and descriptions of surrounding properties. Attorney Carothers noted that “spot zoning is frequently struck down” (Supreme Court).
WAIVE RENTAL FEE FOR HALL USE -- WOLF: Council member Wolf requested consideration for waiving rental fee for Thursday night (8/21) for use of City Hall for cookie bake (use of oven) for upcoming Cystic Fibrosis Stride Walk. No objections were made. Wolf will provide access to building.
CLEAN UP: Attorney Carothers reported on progress at one property - : Trailer is gone and property owner has reported he is in the process of following up on DHHS advisement to contact the landfill for handling specifics (asbestos concerns - fire damaged house). Carothers will call property owner again on Friday, and if timely follow-up is not maintained, he will go ahead with the legal filing. Council member Reedy reported on contact with another property owner. Reedy reported that the property owner is receptive to removal of the sub-standard trailer from the property, and would like to know the cost of a roll off. Employee Pike will provide Reedy with that information so he can report back to the property owner. An interested party was determined to be available for the scrapping process. Progress continues on one property on the list, with review to follow. Current information (Neumann/Carothers) supports possibility of a sale pending of one property with mowing considerations. A request will be made with Buss Realty (Carothers) for mowing the property. Two properties were added to the current list by Council member Neumann (for mowing), with courtesy letters (with 9/2 deadlines) to be sent.

AUGUST 16TH CITY CELEBRATION: FINAL PLANS, CONCERNS, EXPENSES: Council member Reedy reported that “everything is on track,” but additional Bounce House manpower “may be needed.” He asked that “streets be swept (Friday),” and “flags be put up (Saturday morning).” Reedy will contact a property owner about cleaning up his front yard prior to activities. Discussion of other main route properties resulted in determinations for City (and/or) volunteer mowing/trimming, and that a courtesy letter be sent to one property owner for mowing. Electrical upgrade at the park shelter was discussed, resulting in a motion by Council member Mewes, second by Neumann, and a 4-0 affirmative vote to approve/accept the Diller Electric estimate (provided by Reedy) for $1,575.96 - (New Panel and Rewire Lights and Outlets in Park Picnic Area). Connie Mewes suggested “painting fire hydrants.” Bob Widick suggested that the picnic tables in the park be fixed and painted (perhaps by volunteer force- youth group), and the cooker fixed. Tim Brown suggested weed eating/mowing “where cars line up” for the car show, and he volunteered his service, (as did Reedy), with Brown adding that employee “Pike can’t do it all.” He further noted that he was helping Reedy in the capacity (request for door prizes, etc.) of a previous volunteer (Fred Colgrove) who has medical issues this year. Jan Morris indicated that “suggested clean up activities were good, but it was late now” to expect all might be accomplished.
CHAMBERLIN MEMORIAL: DONATION STATUS, FINAL PLANS, CONCERNS: Jan Morris summarized-- which included the following aspects: -- Advertising - Arbor State, Beatrice Daily Sun. -- Her willingness to complete a grant application to the Thomas Foundation for funding not covered by donations (which was determined unnecessary, since the City previously agreed to match/donate (Neumann) funds to the project.) --The monument will be installed 8/6. It will then be the property of the School and their responsibility for maintenance (mowing around, etc.) and liability issues. Council member Reedy told of a discussion with school official (Jeff Murphy) within which maintenance and liability by School was acknowledged. -- Morris provided a letter, mailing list, and addressed envelopes for a VIP invitation mailing (County Commissioner, Economic Development, Historic Restoration). -- She also talked about the press release at the dedication, about Carolyn VanBoening being on hand for instruction on loading the app (links to the website) on smart phones, and Guest Speakers Randy York (senior writer for Huskers.com and Director of Creative Services) and Terry Novak (Son of Legendary Husker Tom “Train wreck” Novak), and how combined aspects should generate not only attendance, but media coverage. -- Jan Morris noted that three yard signs were ordered for the event, and suggested that those for the tractor show might be followed-up on (Neumann) to assure timely completion for the event.

CARY) and FOREMAN SUB-DIVISION: Attorney Carothers presented Ordinance # 453 - (An ordinance to approve the subdivision of land within the City of Blue Springs’ extra territorial zoning jurisdiction, as certified by the surveyor of said subdivision, and approved by the Planning and Zoning Commission of the City of Blue Springs, Nebraska -- (7:PM - 8/5/14). A motion was made by Council member Wolf, seconded by Neumann, and received a 4-0 affirmative vote to Suspend the Rule of Three Readings for Ordinance # 453. Carothers read Ordinance # 453. A motion was made by Council member Wolf, seconded by Reedy and received a 4-0 affirmative vote to approve Ordinance # 453.
CLEAN UP: Kay and Rod Bohlmeyer addressed Mayor and Council regarding a property (fire-damaged house). They expressed concern and cooperation. A letter from Interior Solutions was circulated, which noted that a pre-demolition asbestos inspection had been performed, that samples (6) were taken, with the following findings: Yellow sheet vinyl, approximately 225 sq ft. located in the middle room of the house under the carpet. 25% Chrysotile, non-friable. Attorney Carothers advised the Bohlmeyers to follow-up (w/ Eldon Hutchinson - Fairbury) regarding asbestos removal procedure/fees, landfill requirements (also w/ Beatrice Landfill), and re-inspection provisions. In regard to another property, Carothers advised members of a potential candidate for building inspection. He also spoke about a property which quite possibly would fail sub-standard structure definition within legal address. Carothers was asked to write a clean-up (mowing) letter to one property owner, since it was determined that a letter from an attorney would have greater impact in this specific situation. On-going progress was noted on one property, and review will continue.

Car Show Registration beginning at 9AM, Show running till 4:30PM; BBQ - Noon - 5 PM; Beer Garden (& Horseshoes) - Noon to 5:00 (or later, depending on crowd - per Robinson). Council member Neumann indicated that the Tractor Show will run until 3:00 PM, with the Tractor Drive at 2:00 PM.

PLANNING & ZONING: Larry Foreman addressed members. Concern: He is selling farm and splitting 6.2 acres (Homestead) from the property. Review by Planning and Zoning Commission, with recommendation to Mayor and Council for approval will be pursued when the survey (County Surveyor) is given to Nebraska Title and to City Attorney Carothers (contact: Diane Zimmerman). Carothers will then follow through with sub-division requirements. It was suggested that the Planning and Zoning Commission (which has a scheduled meeting for July 21 - should that date work out for review) could have a meeting at 7:00 PM on August 5, preceding the Regular Meeting of Mayor and Council at 7:30PM - this to expedite review and potential approval of property concerns for out-of-State seller. In another matter, Connie Mewes questioned agricultural use of residential property. Council member Reedy identified it as a “grandfathered” property-use situation. Clarification of “grandfather” aspect followed by Carothers, but no further comments from members.
CABIN, MISC. CONCERNS: Jan Morris has arranged for Jan Roberts to be at the Cabin from 10AM - 2 PM on August 16th, to enable Morris to attend and supervise dedication of the Chamberlin monument.
POST OFFICE - HOURS, INFORMATION (Wolf): Wolf provided handouts from the meeting he attended regarding Post Office changes. Potential Retail Operating Hours (4) - initial suggestion 8AM - Noon - M-F, and 9:15 AM - 11 AM Sat. Alternate options under consideration, as: (due to time of mail delivery to Blue Springs) - 10 AM - 2 PM M-F. Post Office boxes might be available 24-hours. Considerations remain under review.
CLEAN UP: Two properties were removed from the list due to resolution of issues. Continuing progress was noted on one property. No response yet to correspondence (by Carothers) to one property owner with sub-standard trailer issues, Legal action to be initiated for two concerns. Attorney Carothers will research ownership of one property (with tall weeds) and email information to the City Office.
Other:
Diller Electric will be contacted for estimate to update electrical to Park Shelter (prior to August 16th celebration events, and required electrical hookup). Members agreed to discuss (at a future date) upgrade and replacement of electrical at the tennis court.
Attorney Carothers asked if Mayor and Council had any objection to his providing Ashley Calkin with copies of dog incident reports (Gage County Sheriff), since the incidents had direct involvement or bearing (her
past experience, and on-going circumstances). No objections were raised.

The Regular Meeting of Mayor and Council was held on July 15, 2014, in the Blue Springs City Hall, Blue Springs, NE.

Notice of the meeting/hearing was given in advance by posting in at least three public places as shown by the certificate of posting placed on file. Notice of the hearing/meeting was simultaneously given to the Mayor and all members of the City Council and a copy of their acknowledgment of receipt and agenda are placed on file. Availability of the agenda was communicated in the advance notice and in the advance notice to the Mayor and City Council of the hearing/meeting. Proceedings hereafter shown were taken while the convened hearing/meeting was open to public attendance.
At 7:30 PM, Mayor Meyer called the Regular meeting to order and roll call was taken. A motion was made by Council member Wolf, seconded by Reedy, and followed by a 4-0 affirmative vote to approve as sent the July 1, 2014 Regular meeting minutes. AUGUST 16TH CITY CELEBRATION: FURTHER PLANS, CONCERNS, EXPENSES: Per Council member Reedy, flyers are pending, and a mailing planned. Reedy asked Robinson to confirm reservation of the Memorial Hall for August 16th. Event particulars as stated by Reedy: Road closed by 9AM. Car Show Registration beginning at 9AM, Show running till 4:30PM; BBQ - Noon - 5 PM; Beer Garden (& Horseshoes) - Noon to 5:00 (or later, depending on crowd - per Robinson). Council member Neumann indicated that the Tractor Show will run until 3:00 PM, with the Tractor Drive at 2:00 PM.
CHAMBERLIN MEMORIAL: DONATION STATUS, FURTHER PLANS, CONCERNS:
Current total of donations - $1,785.00. Schedule: Chamberlin dedication August 16 - (School) - 11:30AM - (Far east Bus lane). School board approved placement site at July 14th meeting. Supplementary plans are in the capable hands of Jan Morris.
