March 21, 2023 The Regular meeting of Mayor and Council of Blue Springs, Nebraska, was held 7:00 PM, March 21, 2023, at the Blue Springs City Hall. Mayor Meyer called the meeting to order, and roll call was taken. PRESENT: Mayor Meyer, Council members Neumann, Reedy, Sedlacek ABSENT: Council member Riensche OTHERS PRESENT: Attorney Andy Carothers, Employee Milton Pike, Rex Adams, Curt Hagerman. Gene Reedy, Dean Cole Notice of the Regular meeting was given in advance by posting in at least three public places as shown by the certificate of posting placed on file. Notice of the hearing/meeting was simultaneously given to the Mayor and all members of the City Council and a copy of their acknowledgment of receipt and agenda are placed on file. Availability of the agenda was communicated in the advance notice and in the advance notice to the Mayor and City Council of the hearing/meeting. Motion (Neumann), second (Reedy), 3-0 affirmative vote to approve as sent minutes for the March 7, 2023 Regular meeting of Mayor and Council. Motion (Neumann), second (Sedlacek), 3-0 affirmative vote to approve claims as follow: Bank Direct - NE Dept. of Revenue (10) - $78.48; Payroll - $2,646.25; Black Hills Energy - $33.91; George Bohlmeyer -(Meter Deposit Refund) - $100.00; Fairbury Journal News - $57.97; NE Dept. of Revenue - Charitable Gaming (Late Charges) - $69.48; NE Public Health Environmental Labs - $15.00: Norris Public Power - $1,097.49; Security First Bank - (IRA/Pike) - $55.00; Visa - $663.26; Windstream - $90.00; TOTAL CLAIMS $ $4,906.84, AND FROM Keno Proceeds Account - Papa B’s Keno Lounge - $500.78 and $1,784.96. WATER PROJECT/ALTERNATE FUNDING: No new information. Will be addressed further when options are identified. PLANNING & ZONING - APPLICATION FOR BUILDING PERMITS (as submitted): No new applications. DEMOLITION PROJECT: Pending actions/concerns: Two houses pending scheduling for inspection (asbestos). (South of Blue River Pallets). House on West I Street needs consent for asbestos testing and schedule for removal of personal goods. One structure purchased by OPAT. One property may be purchased after guardianship procedures completed/Court approval. Carothers focused on having as many properties as possible within the demolition project in position for asbestos testing on same timeline. Mayor Meyer asked Pike for an update on one property, and Pike reported that the materials, including foundation have been removed and it is ready for “dirt fill”, and Adams indicated that OPAT should be forwarded the bill for the dirt needed at that location. CLEAN-UP: Pending concerns/actions: Letter sent regarding household waste, landfill-like situation, and 30 days were given for resolution, or the matter would be addressed in District Court. Carothers drafted a letter to be sent giving 30 days for removal of household waste and identification/removal of inoperable/unlicensed vehicle(s), and if not resolved the matter would be addressed in District Court. Two properties were discussed in regard to legal actions underway. Hagerman indicated that the nuisance situation that exists and continues growing at one property could be building into a safety issue (near school) where children are often seen walking/riding bikes on the grass) and he suggested “sidewalks.” ZITO MIDWEST CONTRACT/ORDINANCE #473: No input yet from Zito. BLUE SPRINGS CITY PARK PROJECT 2023, INCLUDING PLANS, MATCH-FUND POSSIBILITIES/IN-KIND DETERMINATIONS, TIMELINES, ETC.: Cole reminded members that time is running out for the identification of needs determined for the City Park and Feit Park, and he asked for plans to be identified by members in order for him to orchestrate grant applications to incorporate in-kind funds/match funds ($2,000) inclusion outside of direct City responsibility. Discussion resulted in the identification of focus: mulch for the City Park, trash receptacles/ possibly benches for the City Park, benches/safety rail for Feit Park. Although a toilet for Feit Park was discussed, determination was made, following suggestion by Cole that it be moved ahead to a future grant application. Reedy asked that particulars from Ordinance #469 be added to the information about parks on the website, as length of stay, charges, and Jan Morris will be asked to add that information on a “noticeable” place on the website. Cole reported that April-May has been identified to be the timeline for the tree survey previously discussed. Sedlacek asked that contact be made with the City insurance carrier to determine the coverage/potential assessment/compensation for hail damages to the “barrel of fun” house at the City Park . BRIDGE/NORTH SIDE APPROACH (BY CITY PARK): No information yet regarding meeting attendance/or information from Don Schuller. Speed bumps were briefly discussed which would call for drafting an Ordinance. WYMORE-BLUE SPRINGS SHARED BURN SITE: Sedlacek reported that the fence is up, the road halfway built, a sign is to be made, and by the end of the week the site should be useable, but no definite information was released about when the public would be released to use the site. CABIN EAVES (Gene Reedy): Reedy provided an overview of cabin history, and addressed the matter of “removal of eaves” since relocation has removed their practicality, and it is historically in error to have eaves on an 1857 cabin. No objections were raised to prevent removal of the eaves. 51C DELINQUENT FEES - 2 QUARTERS: Since documentation sufficient for the City to submit timely 51C reports to Charitable gaming was not provided by the Lounge, the delinquent fees are to be billed to the Keno Lounge. Carothers is to enter into conversation with Borgman about this, and related Keno concerns, and further discussion will be an agenda topic at the next Regular meeting. Hagerman thanked members for “updating” his Building Permit and indicated he has plans to begin construction in April. Hagerman also made available to Attorney Carothers his TIF tax application, and Carothers will forward it for review in the approval process. DEMOLITION PROJECT: Carothers indicated that all is “lined up” for the project (Included: The time is about up for a couple of properties, and Chet will be contacted to come down. Letters have been sent by Carothers. CLEAN-UP: Nuisance letter (with 30-day deadline) to be provided by Carothers to City Clerk for one property owner prior to making any arrangements for District Court, one property owner has District Court date, one property owner is rotating vehicles and has trailers full of household trash/scrap iron, one property owner is pending establishment of appointment of guardian (possibly a 30-day process, followed by another 30 days until project resolution), during which a possible sales agreement might be drawn. ZITO MIDWEST CONTRACT/ORDINANCE: No response yet from Zito regarding changes requested. BLUE SPRINGS CITY PARK PROJECT 2023, INCLUDING PLANS, MATCH-FUND POSSIBILITIES/IN-KIND DETERMINATIONS, TIMELINES, ETC. No new information, but McKinney reminded members of the need for a “handicap accessible” swing. BRIDGE/NORTH SIDE APPROACH (BY CITY PARK): Manner of correction was discussed, which included “milling” the problem area at the County bridge, digging up a sunken area to determine cause, and building up the approach. Don Schuller is expected to provide input at the next Regular meeting. (FOR INFORMATION ONLY) Pavement Dressing Conditioner (Armor coating alternate option) Mike Pike: Materials were provided to initially evaluate product potential, and more information to further clarification and determine cost will be pursued. JOINT BURN PILE WITH CITY OF WYMORE (SEDLACEK): Present location for Blue Springs and latest location for Wymore were discussed, and Sedlacek suggested that the two towns share a spot (Wymore owned) where Blue Springs previous had its burn site (near the pallet company). Modifications and conditions (fence, lock, cameras, maintenance, overseeing) would come into play, with the communities sharing time obligations, manpower, and cost. Motion (Riensche), second (Neumann), and a 3-0 affirmative vote approved initiation procedures by Sedlacek for the State approved burn location to be shared by Wymore and Blue Springs.
