September 21, 2021 The Regular meeting of Mayor and Council of Blue Springs, Nebraska was held the 21st day of September, 2021, at 7PM. at the Blue Springs City Hall. PRESENT: Council members Neumann, Reedy, Sedlacek, Seeman ABSENT; Mayor Meyer OTHERS PRESENT: Employee Mike Pike, Attorney Andy Carothers, Connie Mewes Notice of the meeting/hearing was also given in advance by posting in at least three public places as shown by the certificate of posting placed on file. Council President Reedy called the meeting to order at 7:00 PM. COMMUNITY REDEVELOPMENT/TAX INCREMENT FINANCING/ BLIGHT STUDY REVIEW/ORDINANCE# 466 ( as applies), ANY NEW INFORMATION: Attorney Carothers provided information, per: “Community Redevelopment/TIF/Annexation - waiting for survey/legal description from Land Survey Tech. Close to moving forward.” DEMOLITION PROJECT: Black Hills Energy will address demolition sites in the next two weeks (has requested a list verifying locations). Carothers provided all members with a copy of the proposed equipment lease (1999 John Deere 200 LC w/ thumb track machine - Brent Schlake - machine available between Oct 1 and Nov. 10th) and no reservations as to the terms were stated and all members were in agreement that a copy be provided to Brent Schlake for his review and approval. A copy of the proposed lease is attached to the office copy of the minutes. CLEAN-UP: Carothers provided to all members copies of two complaints with Court date of October 26, 2021. Copies of the complaints are also attached to the office copy of the minutes. Ordinance Enforcement Officer Hanson will have a new list (5 locations -- at next Regular meeting) for clean up infractions. Hanson will be asked (Carothers) to submit a to-date invoice of charges for his service by the next Regular meeting. PLANNING AND ZONING: No new applications. GRAVE DIGGING RATES: Review continues for determination of increased charges for grave openings.Study into other community charges has thus far identified costs from $400 to $1,000. CHICKENS WITHIN CITY LIMITS: ORDINANCE # 468: Carothers provided all members with a copy of proposed Ordinance # 468, and he asked that everyone review it. Carothers indicated that it “will need public hearings before the Planning Commission and City Council”. A copy of the proposed ordinance is attached to the office copy of the minutes. CAMPING REGULATIONS: SIGNAGE/DROP BOX: Members discussed changes to Ordinance # 463 (Camping Regulations in Municipal Parks), to describe allowable camping as tents or campers, and clarifying (along with other prohibitive factors) that the park will not be available to those pulling into the park and desiring to sleep in their cars. A charge of $10.00 a night was also suggested for qualifying electrical hookup. It is in the current plan to have a sign made/and a drop box placed. A draft of Ordinance # 469 will be provided for consideration at the next Regular meeting. September 7, 2021 The 2021-2022 Budget Hearing of Mayor and Council of Blue Springs, Nebraska was held the 7th day of September, 2021, at 7PM. at the Blue Springs City Hall. Motion (Neumann), Second (Sedlacek), vote (Neumann - Aye, Reedy - Aye, Sedlacek - Aye). Three copies of the proposed budget statement were available to the public. Jennifer Busboom (Blobaum/Busboom) made a presentation outlining the key provision of the proposed budget statement as directed in the prepared budget notes, including, but limited to, a comparison with the prior year’s budget, per: 2021-2022 Budget Notes: The City appears to be continuing to produce revenues in excess of regular operating expenditures. The General All-Purpose Fund is producing roughly $36,000 per year (nearly the same as the last year), and the Keno Fund is not currently producing funds due to the keno lounge being closed. It is estimated that as of October 1, 2021, you will have cash reserves of about $340,000 General and $75,000 Keno. This compares to the prior year amounts of $289,000 General and $92,000 Keno.… For the year 2021-2022, proposed budget property tax has been left at the levy limit of 45 cents, which increases the tax request from $31,409 to $32,716. This increase (of approx. 4.16%) is due to higher total assessed valuation for the City from $6,979,871 to $7,270,316 All of the increased valuation of $290,445 is attributable to new growth… Other operating revenues have been estimated conservatively at $120,000 based on the prior year amounts for the general funds. $275,,000 has been included in other operating revenues based upon prior years’ estimated Keno game gross proceeds... $398,000 has been budgeted as potential capital outlay in the General All-Purpose Fund and no capital outlay has been budgeted in the Keno Fund beyond your normal operating expenditures. However, $124,000 has been budgeted to be transferred from the Keno Fund to the General All-Purpose Fund to assist in financing potential capital outlay projects. Normal operating expenditures have been budgeted liberally at $360,000 for the General All-Purpose Fund and $226,000 (includes game winner payoffs) for the Keno Fund at 85% payout... The budget process and document perform two legal functions: 1. Sets the property tax request-budgeted at $32,716. 2. Establishes an overall expenditure limit-budgeted at $1,108,000.... The budget must be adopted by September 20. The property tax requested in the budget will be final; however, the expenditure limit may be amended, if needed, throughout the year...The expenditure limit included in the proposed budget allows for expenditure of nearly all cash reserves which are expected to be available. Since some cash reserves will be necessary, we don’t expect, nor do we recommend, that the full amount budgeted of $1,108,000 be spent. GENERAL BUDGETING NOTES: The lid law is assigned to limit the growth of non-utility government revenues to inflationary increases. Exceptions are allowed for revenues required to pay off bonded debt, real estate improvement capital outlays, and interlocal agreements... Due to the Lid Law restrictions, it continues to be advantageous to pay real estate capital outlays, pay off of bonded debt, and participate in interlocal agreements from funds where property tax, sales tax, and state pass-through revenues are deposited (i.e. General and Street). This will help keep this law from limiting your non-utility source revenues...The lid law has become a significant factor for future budgets. Although you have adequate unused budget authority at this time, this is a factor that should be monitored. The floor was then opened for public comment on the proposed budget statement. Public comment ensued. All members of the public wishing to address the governing body were provided a reasonable amount of time to do so. Budget Approval A motion was made by Reedy and seconded by Neumann to approve the 2021-2022 Budget as proposed (Ayes: Neumann, Reedy, Sedlacek ; Nays: None ) Motion passed. Resolution Setting the Property Tax Request Resolution 2021-3 setting the property tax request was read (Busboom), per: (WHEREAS, Nebraska Revised Statute 77-1601.02 provides that the Governing Body of the City of Blue Springs, passes by a majority vote a resolution or ordinance setting the tax request, and WHEREAS, a special public hearing was held as required by law to hear and consider comments concerning the property tax request; NOW, THEREFORE, the Governing Body of the City of Blue Springs resolves that: 1. The 2021-2022 property tax request be set at General Fund: $32,716.00. 2. The total assessed value of property differs from last year’s total assessed value by 4.16%. 3. The tax rate which would levy the same amount of property taxes as last year, when multiplied by the new total assessed value of property, would be 0.432017 per $100 of assessed value. 4. The City of Blue Springs proposes to adopt a property tax request that will cause its tax rate to be 0.449994 per $100 of assessed value. 5. Based on the proposed property tax request and changes in other revenue, the total operating budget of City of Blue Springs will increase or decrease last year’s budget by 1.56 percent. 6. A copy of this resolution to be certified and forward to the County Clerk on or before October 13, 2021. DEMOLITION PROJECT: Attorney Carothers listed properties (with members and Adams, where applicable, providing additional information. Properties/stages of development were discussed within the current demolition planRelated factors: Continuing contact(Carothers) as necessary, with Black Hills Energy for abandonment of lines at involved locations. Understanding: Employee Pike will run the evac machine (to be arranged with B. Schlake, in correlation with Wymore demolitions. Understanding: demolition roll-offs/disposal fees will be billed to the City with One Property at a Time in agreement for reimbursement of some charges to be discussed as applies in the timeline of demolition. Understanding: Sedlacek will contact Jason/Shelby for comparative analysis of roll off fees/land fill charges. CLEAN-UP: Carothers updated information, per: One property owner will be sent a second notice and situation filed again. Another property owner criminal complaint/the District Court to get court order - Round 2) Reedy inquired as to if Tim Hanson had come up with the list of 5 new properties, as per request. It was reported as uncertain, as Hanson has related news of a very tight schedule, which resulted in Sedlacek inquiring as to if Hanson should be asked if he wishes to continue in the position. Contact will be made, and, as necessary, a replacement Ordinance Enforcement Officer pursued (not restricted to a police officer, but a police officer has the advantage/benefit to the City of being able to run license plates.) PLANNING AND ZONING: No new applications. EQUIPMENT(BACKHOES/GRAVE DIGGING RATES): City charge of $65 per grave opening continues under review, based on expenses: two employee’s wages, equipment repair costs and use- backhoe, dump truck and comparative grave opening costs of other communities, as -- $340 - Blue Springs; $1,300 - Beatrice; Hanover/Herkimer? $475; by Carmichael $500.. Reedy suggested broadening the information base to arrive at a resulting assessment that would be cost friendly to both the City and to the cemetery. CHICKENS WITHIN CITY LIMITS: SARAH CHADD: Chadd (realtor) requested consideration of allowing chickens within city limits (has buyer with relevant issue/interest), and members discussed the situation and decided to have Carothers draft an ordinance (comparable to that in Wymore) for review at the next meeting. That Ordinance # will be 468.
