The Regular Meeting of Mayor and Council was held on August 16, 2016, in the Blue Springs City Hall, Blue Springs, NE.

Notice of the meeting/hearing was given in advance by posting in at least three public places as shown by the certificate of posting placed on file. Notice of the hearing/meeting was simultaneously given to the Mayor and all members of the City Council and a copy of their acknowledgment of receipt and agenda are placed on file. Availability of the agenda was communicated in the advance notice and in the advance notice to the Mayor and City Council of the hearing/meeting. Proceedings hereafter shown were taken while the convened hearing/meeting was open to public attendance.


At 7:30 PM, Mayor Meyer called the Regular meeting to order and roll call was taken.


Motion, second and vote to approve as sent the August 2, 2016, Regular meeting minutes: , Mewes, Carmichael, 4-0 affirmative.

Acknowledgment of preconstruction conference held on August 9th, whereat it was advised: Due to 5-day timeline considerations for payment, recommended that the City pay all bills submitted from local funds (as is possible.) transfer the total funds ($358, 825.22 - with applicable interest and penalty for early withdrawal) from the Keno Fund into the General fund, then through motion (Reedy), second (Neumann), and 4-0 affirmative vote transfer the same from General Fund into Street Fund to facilitate prompt payment of contractor/
engineer/facilitator billing, and which will call for the City to handle State payments (as made into the Street Project checking account) as reimbursements.


CITY CELEBRATION, MISC. ASPECTS AS NECESSARY: Council member Reedy indicated that good weather (77 degrees) is anticipated, and everything is “shaping up well,” which includes vendors, bounce house, pre-registration, pie/ice cream (church), chicken (11:30 a.m. - with arrangements for carry-out), and he will be on KWBE Friday 19th (morning) to announce and detail the event. Council member Neumann stated that “all is well for the tractor show.”


PLANNING AND ZONING: Motion, second, vote (Mewes, Neumann, 4-0 affirmative to approve Building Permit Application for Art Linsenmeyer (pole building) - and which was previously approved by the Planning and Zoning Commission. Applicant will be notified of approval and fee.


DEFICIT FUND TRANSFER- AS NECESSARY( PRIOR TO FISCAL END): (July 31st - Street Fund Deficit - $3,978.08) Not necessary at this time.


HAZARD MITIGATION AGREEMENT/RESOLUTION 2016-7 (JEFF HENSON (corrected to Tim Stutzman) : Tim Stutzman gave the presentation, focusing on Blue Springs needs. Information included: Procedure is done every 6 years to allow City to request grant funding for applicable issues (NEMA - disaster declarations: storms, lightning, wind, hail, drought, winter storm, hazardous spills, with considerations also based on age-related risks of general population. Critical structures were identified - city hall, fire department, lift station. A copy of the complete Hazard Mitigation manual is available at the City office for public review. After discussion, a motion was made by Council member Reedy, followed by a second by Neumann to approve/accept Resolution 2016-7, and the resolution was read, per: (A RESOLUTION OF THE CITY OF BLUE SPRINGS ADOPTING THE Little Blue and Lower Big Blue Natural Resources Districts Multi-jurisdictional Hazard Mitigation Plan - WHERAS, the governing body of the City of Blue Springs recognizes the threat that natural hazards pose to people and property within the City of Blue Springs; and WHEREAS the Little Blue and Lower Big Blue Natural Resources Districts have prepared a multi-hazard, multi-jurisdictional hazard mitigation plan, hereby known as the 2016 Little Blue and Lower Big Blue Natural Resources Districts Multi-Jurisdictional Hazard Mitigation Plan in accordance with the Disaster Mitigation Act of 2000, and WHEREAS the little Blue and Lower Big Blue Natural Resources Districts Multi-Jurisdictional Hazard Mitigation Plan identifies mitigation goals and actions to reduce or eliminate long-term risk to people and property in the City of Blue Springs from the impacts of future hazards and disasters; and WHEREAS adoption by the governing body of the City of Blue Springs demonstrates their commitment to the mitigation of hazards and achieving the goals outlined in the 2016 Little Blue and Lower Big Blue Natural Resources Districts Multi-jurisdictional Hazard Mitigation Plan. NOW, THEREFORE, the governing body of the City of Blue Springs does herewith adopt the 2016 Little Blue and Lower Big Blue Natural Resources Districts Multi-jurisdiction Hazard Mitigation Plan Update in its entirety;) then approved/passed by a 4-0 affirmative vote.


INTENDED RELOCATION OF DANGEROUS DOG TO BLUE SPRINGS: Acknowledgment of receipt of information packet from Attorney Carothers and distribution of same information to members. Discussion, followed by motion, second, vote (Mewes, Neumann, 4-0 affirmative) to DISALLOW relocation. of the previously established DANGEROUS DOG into the City of Blue Springs., which as Mewes stated, “is only a couple blocks from the school). It was noted by members that relocation has transpired without benefit of jurisdictional consent. Carothers will address the issue in accordance with acceptable procedure to have the animal removed from the Municipality.


CAT 416 F BACKHOW LOADER SPECS: Receipt of specs was acknowledged, and the materials will be kept with other bids for future review (most likely at the completion of the paving project).


CLEAN-UP: Council member Reedy will continue to work with one property owner to achieve desired results. One property was removed due to resolution of issue. Review of general clean-up issues continue on another property. Two properties were acknowledged as “works in progress.” Council member Reedy will cut tall weeds on another property “described as hillside,” and as circumstances permit, try to generate removal of a junked/inoperable/unlicensed vehicle from in front of the property on Broad Street. That same property is currently under arrangements of sheriff’s sale (Collection Associates), and it will be kept under review. Court date has been determined as October 18th for another pending legal issue.

CDBG PROJECT # 15 PW-015: ANY PERTINENT INFORMATION: Acknowledgement of Mayoral signature on Certification of Continued Environmental Compliance, which includes the statement: “I certify that the above statements accurately reflect the revisions to the project scope of work and that such revisions do not alter the basis under which the project received its original environmental status determination.” Also, acknowledgment of Mayoral signature on Amendment # 1 - To Professional Service/Consultant Agreement - Street Improvements 2016, (3 copies), and Change Order # 1 (4 copies).


CITY CELEBRATION, MISC. ASPECTS AS NECESSARY: Council member Reedy reported arrangements: Bounce House/Obstacle Course ($825 - includes delivery, on-site maintenance, return - “a better deal than picking it up ourselves.”) The Wymore/Blue Springs Group would like to help with bounce house, and maybe judging. Reedy will call Lori Miller about Church services. Van’s chicken is arranged. Trophy cost is up $600, but greater participation is expected. Council member Neumann said “everything is falling into place for the Tractor Show.”


PLANNING AND ZONING: No new applications.


ANNUAL KENO OPERATOR AGREEMENT (FOR SIGNATURES ONLY): Acknowledgement of Mayoral signature on three copies of the new annual agreement and arrangements made for signature of Keno Operator.


DEFICIT FUND TRANSFER- AS NECESSARY( PRIOR TO BUDGET HEARING): Current deficit minimal. No action taken at this time.


CLEAN-UP: One property owner was removed from the list due to resolution of issue. No action will be taken regarding another property until after August 24th Sheriff’s sale. One property owner who received a courtesy clean-up letter will be contacted by Council member Reedy (Mayor Meyer indicated he should do so on own behalf) about property clean-up. The brother of one property owner who received a courtesy clean-up notice that he will help clean-up the property this week. No action was designated for another property owner. A certified letter was designated for weeds. Review continues for a property making clean-up progress.
