The Regular Meeting of Mayor and Council was held on November 19, 2019, in the Blue Springs City Hall, Blue Springs, NE.
PRESENT: Mayor Meyer, Council members Carmichael, Mewes, Neumann, Reedy (Arrived 7:10 PM)
ABSENT:
OTHER ATTENDEES: Employee Mike Pike, Connie Mewes, Carol Hughes, Fred Laber

Notice of the meeting/hearing was given in advance by posting in at least three public places as shown by the certificate of posting placed on file. Notice of the hearing/meeting was simultaneously given to the Mayor and all members of the City Council and a copy of their acknowledgment of receipt and agenda are placed on file. Availability of the agenda was communicated in the advance notice and in the advance notice to the Mayor and City Council of the hearing/meeting. Proceedings hereafter shown were taken while the convened hearing/meeting was open to public attendance.

At 7:00 PM, Mayor Meyer called the Regular meeting to order and roll call was taken.

Motion, second and vote (Mewes, Carmichael , 3-0 affirmative) to approve as sent minutes for the November 5, 2019 Regular meeting.

After review -- motion (Neumann), second (Mewes), and vote ( 3-0 affirmative) to approve claims as follow: Bank Direct - NE Dept. of Revenue (10) - $342.72; Payroll - $2,030.14; Black Hills Energy - $32.31; DHHS - Licensure Unit (Water Operator Renewal) - $115.00; First State Insurance - $115.00; Linda Hohensee (Reimb.) - $5.49; Municipal Supply - $286.69; Office Depot - $557.05; Milton Pike (Postage Reimb. - Water Sample) - $25.60; Postmaster - $180.00; Security First Bank (Pike - IRA) - $55.00; Roehr’s Machinery - $283.42; Tractor Supply - $154.92; Ullman Auto Sales/Repair - $1,969.04; Windstream - $102.58; Wymore Arbor State - $244.78; TOTAL CLAIMS: $6,499.74.

ONE PROPERTY AT A TIME PURCHASE/CITY OF BLUE SPRINGS DEMOLITION COST? (FORNEY PROPERTY): Mayor Meyer asked attending One Property at a Time Member Hughes for a progress report.
Hughes said “one dumpster is filled, another ordered. Progress is better than expected.” Mayor Meyer reported that “the wires are down.”

PLANNING & ZONING: No new applications.

CABIN PRESERVATION ISSUES: Council member Reedy reported that 888-Log Guys will be on site Wednesday afternoon, and that the logs are cut and will be evaluated for compliance with specifications.

CLEAN-UP/BUILDING INSPECTOR AGREEMENT: Mayor Meyer asked that an inquiry be made of Attorney Carothers to ascertain, if possible at this time, the date the two Blue Springs structures under current review will be inspected, and also, if any discounted price will be available if both towns (Blue Springs/Wymore) want inspections on the same day-choice schedule. In another matter, a complaint was filed for December 3, 2019 court date for a matter of “residing in a residential dwelling that is not being served with water, electric, and natural gas utility services…” Documentation is attached to the office copy of the minutes.

PLAYGROUND RUBBER MULCH INFORMATION /GRANT OPPORTUNITIES: Understanding is that Dean Cole will not be pursuing grants in this regard due to heavy demands on his present schedule. Employee Pike will check with the Wymore Park Board to determine Wymore Park needs, this aimed at determining if prices might be discounted through a two-community purchase option.

OTHER: Mayor Meyer inquired about equipment, and Pike responded that both backhoes are working, but that units are crowded together and infringing on the shop work area. Suggestions were made about alternate storage, as the possibility of removing the dump truck, perhaps to the Cemetery building, and putting other equipment in its place. Height restriction of the storage area makes this an unworkable solution. It was also discussed that the old backhoe could be moved to the Cemetery storage building and put out for bids in the Spring (Reedy), thus potentially garnering a better price. Employee Pike will make inquiries to determine feasibility of this alternate storage for the old backhoe.

ONE PROPERTY AT A TIME PURCHASE/CITY OF BLUE SPRINGS DEMOLITION COST? (FORNEY PROPERTY): Carol Hughes gave information on behalf of One Property At a Time, as ---Forney property has been acquired, and they would like the City to participate in the clean-up project (“demolition cost”). Attorney Carothers suggested that OPAT contact demolition operators (Fossler/Lottman) to get a bid for demolition cost and share that information with the City to support their decision on the matter. It was also suggested (Pike) that there may be interest in removing the trailer to another location, which would reduce removal cost of the structure.

PLANNING & ZONING: No new applications.

CABIN PRESERVATION ISSUES: Council member Reedy identified individuals (James Ullman, Oren Bednar) who will be participating in log (oak) acquisition and cutting. Williams Midwest House Movers is expected to have a representative on site on November 18 for determination or actual start date, depending on their schedule. 888-Log-Guys Log Home Restoration proposal specifications and conditions were discussed (copy of proposal attached to office copy of minutes and available for public review,), and a motion was made by Mewes to accept the proposal, which was then seconded by Reedy, and approved in a vote of Carmichael - No, Mewes - Yes, Neumann - Yes, and Reedy - Yes. (Office Record: Copies of signed Proposal sent to 888-Log Guys, Jan Morris, Gene Reedy)

PAVING/TRANSFER OF FUNDS: Not necessary at this time. Removed until later date.

BACKHOE/TRANSFER OF FUNDS : Within a motion by Carmichael, second by Mewes, and a 4-0 affirmative vote, an excess of $12,500 was declared in the Water Fund and an excess of $12,500 was declared in the Sewer Fund, $12,500 alike was transferred from Water and Sewer funds to the General Fund, and the combined total of $25,000 was then transferred from the General Fund to the Street Fund to cover the Backhoe purchase of $25,000 - (1999 New Holland 655E STK 60359 from Martin Equipment - Goodfield, Il) It was noted that the new backhoe is working out well and has been described as a good machine by a local service provider (Jerry’s Diesel). The old backhoe, however, though up and running briefly, is again in need of repair, perhaps (Pike) - “needing to have injectors replaced.”

CLEAN-UP: Upon advisement of Attorney Carothers, a motion was made by Reedy, seconded by Mewes, and received a 4-0 affirmative vote to appoint Milton Pike as Temporary Ordinance Enforcement Officer for the purpose of serving notice (with 5 day response deadline) to an individual in violation of Ordinance # 460. In another matter, Attorney Carothers stated he would have an agreement for members to consider/approve at the next Regular meeting regarding the inspection of two Blue Springs structures (Office Record: Lance/Stipe) , hopefully which can be addressed within the same timeline as Wymore inspections, and which may result in reduced price per unit (possibly from $125 to $100).

PLAYGROUND RUBBER MULCH INFORMATION /GRANT OPPORTUNITIES: Members discussed the sales proposal of Sterling West - for Nuplay rubber mulch coated earthtone - delivered price at $4,250.00 for (10 bags). Mayor Meyer indicated that it is his understanding that Dean Cole is still researching grant opportunities, and he suggested delaying any decision on the purchase pending outcome of that endeavor. No objection was raised. As per Mayor Meyer’s request, the Sterling West information will be kept on file.

POTENTIALLY DANGEROUS “DOG” SITUATION AT PRESCHOOL (Patty Novotny): Patty Novotny questioned if breed-specific ban might be considered by the City, and in support of that inquiry, stated strong concern for the safety of children at the preschool during outside activity in which they are in close proximity with neighborhood dogs (2 pit bulls, one Rotweiler) and she presented a timeline of events and documentation of several individuals describing experiences which had the potential to escalate into dangerous situations for adults and children. A copy of this information is attached to the office copy of the minutes and available for public review. Dog owners (Millers) described the dogs as gentle and friendly, and noted that the Investigator at the scene told that the dogs did not present with hostility. City Attorney stressed the importance of keeping the safety of the children the primary concern, and asked for the cooperation of the owners in keeping in compliance with the leash law, and out of concern and cooperation-- to place them on their property as far away from the children as possible, and with due concern about keeping them inside during the outside activity of children. Though the Millers repeated that the dogs are not dangerous (even taken to Nursing Home to visit clients), they agreed to comply with City leash law, and cooperate. In an unrelated incident, Adam Vater shared information about another pit bull (owner not determined) who posed threateningly when they were having a family event at City Hall. Other responders told of other incidents of dogs-at-large.
