Notice of the meeting/hearing was given in advance by posting in at least three public places as shown by the certificate of posting placed on file. Notice of the hearing/meeting was simultaneously given to the Mayor and all members of the City Council and a copy of their acknowledgment of receipt and agenda are placed on file. Availability of the agenda was communicated in the advance notice and in the advance notice to the Mayor and City Council of the hearing/meeting. Proceedings hereafter shown were taken while the convened hearing/meeting was open to public attendance.
At 7:30 PM, Mayor Meyer called the Regular meeting to order and roll call was taken. A motion was made by Council member Wolf, seconded by Reedy, and followed by a 4-0 affirmative vote to approve as sent the March 19, 2013 Regular meeting minutes. After review of claims, a motion was made by Council member Mewes, seconded by Neumann, and followed by a 4-0 affirmative vote to approve claims as follows: Bank-Direct Payment - Internal Revenue Service (941) - $1,509.86; Salaries - $2,559.05; Black Hills Energy - $49.71; Constellation Energy - $111.49; HJP Pest - $1,267.20; Eldon Izer (Tel. Comp.) - $5.00; Liberty Repair - $718.69; NE Dept. of Rev.(941N) - $186.58; Michael Todd & Co. - $154.96; Norris Public Power - $1,318.57; Milton Pike (Health Ins. Comp.) - $426.38; Milton Pike (Tel. Comp.) - $25.00; Postmaster - $112.00; Dean Scheideler (Ref. O/P) - $15.83; Security First Bank (Pike IRA) - $55.00; Shell - $303.31; Willet & Carothers - $290.00; Wymore Arbor State - $121.50; Wymore, City of (Tower/Individual) - $5,005.97; Wymore Lumber - $100.61; Wymore Oil Company - $227.50; TOTAL CLAIMS: $14,564.21.
PUBLIC HEARING FOR COMMENTS/CONCERNS: ZITO MEDIA FRANCHISE RENEWAL Following the opening of the Public Hearing at 7:32 PM (Motion by Council member Wolf, Second by Mewes, and 4-0 affirmative vote), Mayor and Council, City Attorney Carothers, Employee Pike and Delbert Bartels, Evelyn Michaelis, Janet Roberts and Roberta Hopkins entered into discussion following a brief overview by Carothers. (Zito Media Franchise expires in three years. Formal and informal renewal process required by Federal Cable Act. Purpose of public hearing for subscribers to express concerns.) Shared concerns included: Incidents of poor reception - “squiggles on a daily basis,”, incidents of “picture without sound, sound without picture”, “channels lost but price increased”, “incidents of automatic bank payment wherein increased pricing came into effect without notification to customer”, “service calls answered but without improvement”, “long wait and continued unavailability of acceptable reception boxes (HD)”, “can’t get Major League Baseball.” Alternate option service provider was discussed, but it was noted that larger companies cannot be attracted to the community. Satisfaction was expressed in regard to Zito internet service. The Public Hearing closed at 7:55 PM ( Motion by Council member Wolf, Second by Neumann - 4-0 affirmative vote). Franchise renewal study will continue.
KENO OPERATOR CONTRACT RENEWAL: Attorney Carothers provided drafts of the new (annual renewal 5/1/13 - 5/1/14) Operator’s Agreement. No changes had been requested by the Operator. The Operator will be advised of the availability of the agreement at the City Office. Signature by all parties will be followed by distribution of copies.
ANNUAL INSURANCE PACKAGE (DAVIDSON INSURANCE CO.) : Compilation of data continues by Davidson Insurance. Topic will be forwarded to next agenda.
CONTINUED PLANNING (AS NECESSARY) FOR ANNUAL CAR/TRACTOR SHOW: Council member Reedy provided information for the following inclusions for the annual celebration: Mud Volleyball (Independent of City - Brent Maxson (own insurance); Horseshoe Pitch - East of Fire hall, Bounce House (from Beatrice this year). Council member Neumann noted that the Elevator will again sponsor plaques for the Tractor Show.
STATE FIRE CONFERENCE AD (Continued review): Council member Reedy circulated a copy of the proposed ad. Following discussion, Mayor Meyer advised against placing an ad in the State Fire Conference booklet, due to limited advertising impact of the ad. Neumann opt for placement of the ad in local media as: Arbor State, Daily Sun, Lincoln Journal. Wolf noted the ad was intended not only to advertise the local event, but also to support the Fire Department (Conference). Neumann said he would rather it had been an opportunity to support the Blue Springs Fire Department. Council member Mewes made a motion, followed by a second by Neumann, and a passing vote of (Reedy - Yes, Wolf- No (by reason that the motion was not necessary since local advertising of the event had already been decided), Neumann - Yes, Mewes - Yes).
PLANNING & ZONING: Determination was made on a question posed by a local farmer (Gale Hardin), who had inquired about a building permit at the County Office, and was told that his location falls under the jurisdiction of the City. Reference materials were reviewed, and confirmation reached. A building permit application will be mailed to Hardin for his completion and return.
INCOME SURVEY (Ongoing Concerns): No new information.
