The Regular Meeting of Mayor and Council was held on January 3, 2017, in the Blue Springs City Hall, Blue Springs, NE.


PRESENT: Mayor Meyer, Council members Carmichael, Mewes, Neumann, Reedy


ABSENT;


OTHER ATTENDEES: City Employee Milton Pike, City Attorney Andy Carothers, Gilmore Representative John Berry, Connie Mewes


Notice of the meeting/hearing was given in advance by posting in at least three public places as shown by the certificate of posting placed on file. Notice of the hearing/meeting was simultaneously given to the Mayor and all members of the City Council and a copy of their acknowledgment of receipt and agenda are placed on file. Availability of the agenda was communicated in the advance notice and in the advance notice to the Mayor and City Council of the hearing/meeting. Proceedings hereafter shown were taken while the convened hearing/meeting was open to public attendance.


At 7:30 PM, Mayor Meyer called the Regular meeting to order and roll call was taken.


Motion, second and vote (Carmichael, Mewes, 4-0 affirmative) to approve as sent the December 20, 2016 Regular meeting minutes.


After review -- motion, second, and vote (Neumann, Carmichael, 4-0 affirmative) to approve claims as follows: Bank Direct -Internal Revenue (941) - $2,412.07; Salaries $2,920.94; Beatrice Sand & Gravel - $271.80; Constellation Energy - $40.63; Gilmore & Associates - $216.00; NE Dept. of Rev (941N) - $263.99; Milton Pike (Tel. Comp.) - $25.00; Norris Public Power - $1,338.74; Security First Bank (IRA/Pike) - $55.00; Shell - $252.55; Spilker Electric - $149.88; Milford Woutzke (Tel. Comp.) - $5.00; Wymore Oil Company - $76.50; TOTAL CLAIMS $8,028.10.


CDBG PROJECT # 15 PW-015: ANY PERTINENT INFORMATION: No activity.


PLANNING AND ZONING: Advisement by Attorney Carothers: Nuisance violation (clean-up) not an acceptable stipulation for disapproval of an application for a building permit, except in such case as directly linked to workmanship or materials of the building project itself. Connie Mewes (P&Z member) expressed concern regarding various non-compliance situations. Advisement of Attorney: Since no official Building Code is in place, restrictions (aside from set-back, and measures of “cease and desist” of construction prior to application approval) though advisable, are not fully enforceable. Primary corollary of Municipal building permits - to get property improvements on County tax records.

DANGEROUS DOGS (FOLLOW-UP AS NECESSARY): City Attorney to share latest dog incident report (upon receipt from Gus) with Mayor and Council.


EQUIPMENT (AS NECESSARY): No relevant issues.


CLEAN-UP: Attorney Carothers to check on property transfer for the only issue on the clean-up list.
