The PUBLIC HEARING - STREET PLAN/MUNICIPAL ANNUAL CERTIFICATION OF NE. BOARD OF PUBLIC ROADS CLASSIFICATIONS AND STANDARDS - RESOLUTION #2019-4 and Regular Meeting of Mayor and Council were held on September 17, 2019, in the Blue Springs City Hall, Blue Springs, NE.
PRESENT: Mayor Meyer, Council members, Mewes, Neumann, Reedy
ABSENT: Council member Carmichael

Notice of the meeting/hearing was given in advance by posting in at least three public places as shown by the certificate of posting placed on file. Notice of the hearing/meeting was simultaneously given to the Mayor and all members of the City Council and a copy of their acknowledgment of receipt and agenda are placed on file. Availability of the agenda was communicated in the advance notice and in the advance notice to the Mayor and City Council of the hearing/meeting. Proceedings hereafter shown were taken while the convened hearing/meeting was open to public attendance.
At 7:00 PM, Mayor Meyer called the Regular meeting to order and roll call was taken.
Motion, second and vote (Mewes, Neumann , 3-0 affirmative) to approve as sent minutes for the Sept 3, 2019, 2019-2020 Budget Hearing and Regular meeting.

Motion (Reedy ), second (Mewes), vote (3-0 affirmative) to open the PUBLIC HEARING - STREET PLAN/MUNICIPAL ANNUAL CERTIFICATION OF NE. BOARD OF PUBLIC ROADS CLASSIFICATIONS AND STANDARDS - RESOLUTION #2019-4.
Call for Comments: (None). Motion (Mewes), second (Neumann), vote 3-0 affirmative to close the Public Hearing.
RESOLUTION #2019-4: : Motion (Neumann) , second (Mewes) to adopt/approve Resolution #2019-4 - Signing of the Municipal Annual Certification of Program Compliance Form 2019 - ( which was read- Carothers) --- “Whereas: State of Nebraska Statutes, Sections 3l9-2115, 39-2119, 39-2120, 39-2121, and 39-2520(2), requires an annual certification of program compliance to the Nebraska Board of Public Roads Classifications and Standards, and Whereas: State of Nebraska Statute, section 39-2120 also requires that the annual certification of program compliance by each municipality shall be signed by the Mayor or Village Board Chairperson and shall include a copy of a resolution of the governing body of the municipality authorizing the signing of the certification form. Be it resolved that the Mayor of Blue Springs, Nebraska 68318 is hereby authorized to sign the attached Municipal Annual Certification of Program Compliance form. Adopted this 17th day of September at Blue Springs, Nebraska. The vote followed the reading, and was Carmichael - (absent); Mewes -Yes, Neumann - Yes, and Reedy - Yes, to approve Resolution #2019-4, which (along with a signed copy of the certificate) is attached to the office copy of the minutes and available for public review upon request. BUILDING INSPECTOR - CONDEMNED BUILDINGS: Attorney Carothers notified members that the Beatrice Building Inspectors (Rob Mierau /Chet McCrury) expressed interest in providing service to the Municipality at the rate of $125 per hr., with 4-hr minimum - under Unsafe Building Code. Clarification (request by Reedy) was needed as to whether the rate would apply to one structure only, or if savings would be realized if two locations were included at one time. Carothers will discuss this with Mierau and McCrury. Connie Mewes inquired if asbestos testing would be included, and the response was “No.” Carothers also indicated that Mierau and McCrury were contemplating LLC classification in the future (Building Code/Residential code/ Property Maintenance code) and plan to determine interest in contractual/established rate participation of various municipalities. In regard to the two structures presently under review for demolition, Carothers will discuss representation aspects/requirements with the Beatrice building inspectors and will prepare for review/acceptance a contract for members at the next Regular meeting. Mierau and McCrury will be invited to attend the next Regular meeting (by Carothers) to present information regarding other potential services.
GILMORE REVIEW/SURVEY OF TWO MUNICIPAL STREETS: As reported by Employee Pike, Gilmore representative (Clyde) indicated that it is generally the responsibility of property owners to contact/pay for surveyors to determine property lines. Pike also stated that he planned to address one situation (Dale Crumb/Dick Sutton)which was described as discord between neighbors, by widening the road and applying gravel. A property owner (Carol Klee) stressed that she was not requesting property lines clarification at her location (the second site under review), but rather wanted to know right where the road lay. She was also concerned with the placement of fencing, and expressed interest in the road being paved; but unfortunately, paving at that location is not in the current road plan and will likely need to wait until the next grant application process.
PLANNING & ZONING: No new applications.
CABIN PRESERVATION ISSUES: Ongoing preservation concerns. Attached to the office copy of the minutes is the latest Jan Morris update, and interested parties may review it upon request.
PAVING: High demand for paving work continues to cause delay and speculation in regard to exact scheduling of Blue Springs work (Walnut Street).
CLEAN-UP: Tomorrow Attorney Carothers will speak with Tony Shepardson (OEO for Blue Springs) , and request his attendance at the next Regular meeting - to provide members with name/location/problem clarification of situations he is addressing. Discussion also included the sites of recent demolition, and observation (Meyer) that results were “comparable”, and it is hoped that appreciation is felt for the work done by the Municipality/ One-Property-at-a-Time, and funded in considerable part by grants from the Thomas Foundation, and that property owners will willingly address what small issues might remain to be resolved.
OTHER:
Carol Hughes inquired as to if the requested painting (to remove graffiti) had been completed at the City Park, to which Employee Pike responded that the activity is anticipated to be completed next week.
Dean Cole addressed members. He stressed the importance of elevating the activities of the present Park Committee to an active Park Board. He identified focal issues: The tennis court - “upgrade/or take down” - , City Park (draw - “possibly plant wild flowers and native grasses,” (SECC plan) - Feit Memorial Park - “further enhance for canoe/etc. activities.” He asked if the members were receptive to his planned participation in community enhancement/”green spaces.” He noted that, through Nebraska State Forestry (at no cost) - ten - 3/yr participation slots are available for free software which would determine Municipal inventory of trees, conditions, and record by GPS. George Pinkerton, Certified Arborist, and Dean Cole would plot the area. Members were in agreement for Cole to proceed.
