    The Regular Meeting of Mayor and Council was held on May 4, 2021, in the Blue Springs City Hall, Blue Springs, NE.

    Motion (Neumann), second (Sedlacek) and vote (4-0 affirmative) to approve as sent minutes for the April 20, 2021 Regular meeting.

TODD BOHLMEYER/EMC LIABILITY/AUTO LIABILITY INCREASED COVERAGE OPTIONS: No new information.  Tabled until next Regular meeting (5/18).

COMMUNITY REDEVELOPMENT/BLIGHT STUDY REVIEW/ TAX INCREMENT FINANCING/ ANNEXATION, ORDINANCE# 466, ANY NEW INFORMATION: Carothers called for questions/concerns, but indicated that the survey (for annexation) has not yet been completed.  Discussion included:  pros and cons regarding the possibility and location of additional annexed areas, with no final decisions made. Further analysis required.

DEMOLITION PROJECT: Attorney Carothers provided a memorandum that identified properties and gave progress status for each. (Attached to the office copy of the minutes). Asbestos inspection of two properties (Lance/Stipe) is anticipated to be completed by the May 18th Regular Meeting. The City backhoe is expected to be used to gain entry to one (Lance).   Discussion included demolition options (Lottman/Fossler [possibly 4T-5T cost each]/use of independently owned equipment [1 T ? ea. Per Adams info.] by qualified operator. Removal of a vehicle on one of the properties (Lance) will be addressed by notice to owner.

CLEAN-UP: Information about Complaints (filed or drafted) and letters were included in the above noted memorandum - under the title “Nuisance Properties.

PLANNING AND ZONING: No formal recommendation yet (George Bohlmeyer building permit application) from P & Z.  Determination was made for request for a drawing/on site staking to identify exact location. Will be further addressed at 5/18 meeting.

COMMUNITY REDEVELOPMENT/TAX INCREMENT FINANCING; BLIGHT AND SUBSTANDARD STUDY/ORDINANCE# 466( as applies), DESCRIPTIONS, ANY NEW INFORMATION: Attorney Carothers passed out copies of the Blue Springs, Nebraska Redevelopment Area Blight & Substandard Determination Study and General Redevelopment Plan completed by Hanna:Keelan Associates, PC. (Community Planning & Research).  Carothers asked that members study the documentation and pose questions/concerns at the next Regular Meeting (May 4th).  He noted that the area to be annexed is included, but that his attention continues to determine the status of the survey study needed for the annexation process.

DEMOLITION PROJECT: Carothers has spoken to one property owner who expressed wishes to convert the house that burned--  into a garage, with Carothers indicating he felt “the City Council may not embrace” that option. The property owner gave permission for inspection (Rob/Chet) of two properties.  It is anticipated that next week inspection warrants could be issued by one of the judges.   Tim Sedlacek will be inspecting two properties for asbestos (at a rate of $150 each location, as well as conferring with Bockman in the event of needed remediation, and getting the City started on the credit app for the cost of  samples.  Baring unforeseen circumstances, the plan is to have the inspection process completed by the second meeting in May - (18th). 

CLEAN-UP:  Ordinance Enforcement Officer Hanson has provided Attorney Carothers with pictures of several properties, with complaints to be filed on all but one of them.

PLANNING AND ZONING:  Motion (Neumann), second (Seeman), Reedy (abstained), vote 3-0, to approve the building permit application for Radar & Becky Reedy’s storage building.  Valerie Hazen asked for “rock base” on Cherry by their property, and Pike indicated he would “put down more gravel.” Hazen also advised members of intent to put a roof over porches (colored metal), and was told to contact Gage County Highway Department for a building permit application (since in County jurisdiction), but there might be a chance they would defer the request to the City, at which time they could complete an application here.

FULL-TIME EMPLOYEE BENEFITS:  REVIEW/APPROVAL OF CHANGES TO  THE EMPLOYEE BENEFITS PACKAGE (SICK TIME/ EARNINGS/ CEILING/ ETC.:   Since one member (Sedlacek) did not have access to the handbook draft, (and will be provided one by Carothers), Comp time/ overtime will be discussed further (and possibly sick time, earnings/ceiling)  at the next Regular meeting. 

ORDINANCE ENFORCEMENT ISSUES:  SENDD:   Have been notified by SENDD that they are currently “bogged” down with grant work, and “have put their Ordinance Enforcement program on hold until further notice.”

CITY PARKS: ANY NEW INFORMATION: Portable toilet is now in place, and University organized canoeing has begun.  The American flag (per Pike) “is again flying.”

HALL RENTAL (RE-OPEN?): No objection was raised by members to prohibit returning to standard (pre-Covid) rental of City Hall by individuals.

TREES (DOREEN WILLIAMS): Ms. Williams did not attend, but it was believed she wished to request trimming of trees at her location.   Carothers stated that property owners, (and (per Meyer) Norris Public Power whereat they determine trees infringe on the electric lines) are responsible for the trimming of trees.

TODD BOHLMEYER/EMC INSURANCE REVIEW: Bohlmeyer reported on his on-site review of City coverage, specifically business property in shop, and made suggestions to increase Liability/Auto Liability from $1,000,000 to meet current standard… to an Umbrella Coverage of at least $2,000,000.  He will be emailing several coverage/premium options for members to consider at the next regular meeting.  Bohlmeyer also presented the City with a $2,636.65 dividend check.

COMMUNITY REDEVELOPMENT/TAX INCREMENT FINANCING; BLIGHT AND SUBSTANDARD STUDY/ORDINANCE# 466( as applies), DESCRIPTIONS, ANY NEW INFORMATION: Study is expected to be complete and provided to Mayor and Council within the next two weeks (Carothers handout). Survey for property to be annexed has not yet been received from Land Survey Tech.  Chris Witulski was contacted  (Carothers handout) to check on completion date, but he was not available for comment at that time, so a message was left.  Hanna-Keelan is in the process of finishing the study (Carothers handout), and it should be received within the next two weeks.

DEMOLITION PROJECT: Waiting for asbestos inspection on two properties.  Inspection warrants have been prepared for several properties with warrants to be issued depending on availability of a judge and time available on court’s docket.  Tim Sedlacek indicated his willingness to conduct asbestos inspections in “individual capacity” and will conduct a study to determine costs (as samples), to enable him to propose cost to City… to members at the next Regular meeting.  Another property ( proposed for demolition has met with reluctance from the owner who wishes to convert the structure into a garage, and it was suggested (Carothers handout) that it be recommended for inspection under the unsafe buildings ordinances  so a Notice and Order can be issued for tear-down.  A second property on the list of proposed demolition sites has owner consent for inspection. For further reference, a copy of the Carothers handout is attached to the office copy of the minutes.

CLEAN-UP: Complaint has been filed and awaiting arraignment date on April 20th .  Determination was made for the mailing of various  “status” courtesy letters to several property owners. and Carothers will be requested to review a situation regarding a semi from one part of property owned by them to another part with a different legal description, specifically if the “grandfathered” condition still remains after the move.

PLANNING AND ZONING:  No new applications.

FULL-TIME EMPLOYEE BENEFITS:  REVIEW/APPROVAL OF CHANGES TO  THE EMPLOYEE BENEFITS PACKAGE: It was noted (Neumann) that the sick leave (other than Covid leave) was not clarified in the material provided to members for their input, and it was suggested (as before) that one day be earned per month by full time employees (suggested by Sedlacek), but that a ceiling and timeline for use needs to be implemented. The League of Municipalities will be contacted (clerk) to ascertain particulars, as comparisons, standard, allowances. 

ORDINANCE ENFORCEMENT ISSUES:  HANSON/SENDD/OTHER OPTIONS:  Members discussed options.  It is believed that Tim Hanson wishes to continue as the City Ordinance Enforcement Officer, and his time may now be freed up to support the plan, with members allowing 90 days (till July 6) for him to come forward with results.  Members also, by a motion by Reedy, second by Seeman, and a vote of Neumann - yes; Reedy - yes; Seeman - yes, and Sedlacek - no; approved inviting SENDD (Reedy will affirm with SENDD) to the next Regular meeting on April 20th to provide the range, scope, cost, duration of an Ordinance Enforcement program available through the SENDD organization.

CITY PARKS (DEAN COLE)  Reedy thanked Pike for the “great work” he did at the bridge.  Reedy also presented a $6,000 check from the Gage County Foundation Grant (application by Gene Reedy Sr.) for the Cabin… Reedy went through the list of action needs provided to him by Dean Cole, which included, but was not all inclusive of specifics, but with details provided by attachment to the office copy of the minutes -- information from Cole). 1.  Placement of portable toilet at Feit Park (for camping season - until October 1). 2.  Prep and paint blue picnic table at Feit Park and power wash concrete foundation of shelter. 3.  Dirt work and preparation and seeding. 4.  Remove large stump (grind) in horseshoe area, and other stumps, and prep area for seeding.  5. Instructional signage (collection box) for camping regulations (Feit Park). 6. Discussion about permanent toilet at Feit Park. Cole could write grant. 7. Remove three small poles once used as barriers - Feit Park; 8.  Metal trash container donated by Wymore/Blue Springs Area Fund needs to be placed in park (and according to Sedlacek evaluated for improvement to prevent rain water collection) (will need concrete foundation).   9.  Better sign at Feit Park.  10.  Cole will be using city water April, May, June.  11. Provisions to be made to repair/replace materials (as necessary) to enable the flying of the American and Nebraska flags at the entrance of Blue Springs and the American flag at City Hall.  (before Memorial Day). 12.  Motion (Neumann), second (Seeman) and 4-0 affirmative vote for Dean Cole to draft a letter to Mainstreet Beatrice in support of “corridor” - (river -- Feit Park)…. Pike discussed the current cost of mulch for the City Park, and the possibility of applying for a grant after initial purchase for possible reimbursement of approximately a third of the approximately $10,000 cost.   A motion was made by Reedy to transfer $15,000 from the Keno Proceeds Account to General fund in General checking (will be transacted by check from one account the other), and then to transfer the same amount from the General Fund in General checking to the Park Fund in General checking to finance decisions/approval of park expenses.  Neumann seconded the motion, and a 4-0 affirmative vote followed for approval.

Motion by Council member Verona Neumann; second by Gene (Radar) Reedy, and a 3-0 affirmative vote to approve Non-Binding Recommendation to Nebraska Liquor control Commission for Approval of Steve M. Borgman (Trade Name - Papa B’s) application for Class C License (Beer, Wine, Distilled Spirits, On and Off Sale), and Class K Catering license.  June 1 is the hopeful opening date.

ANNUAL INSURANCE PACKAGE:  EMC Rep. Todd Bohlmeyer provided particulars and rationale for standard cost increases, and requested on-site review of properties and equipment/vehicles, and made arrangements with Milton Pike. (Policy Particulars:  Total Premium $15,265.00   (Last year - $14,343.00)  Breakdown: Commercial Property - $3,226; Commercial Inland Marine - $1,114; General Liability $837; Business Auto; $3.044; Workers Compensation $4,997; Linebacker - $2,047 --- Difference: (property) - “adding a separate $2,500 wind/hail deductible and cosmetic roof limitation endorsement” excerpt from February 24th letter.)  Motion (Neumann), second (Seeman), 3-0 affirmative vote approved $15,265.00 annual premium payment.

DEMOLITION PROJECT: Asbestos testing (Sedlacek) is in the upcoming plan for two properties, with removal to follow, and demolition based on the best case scenario at the time, whether it be by using City operator and available leased equipment, or soliciting the services of Fossler/Lottman/(or other) demolition contractor with required liability insurance.  A second round of demolition options are to be entered into the inspection phase shortly (Rob/Chet to be contacted). Another property was also discussed, with particular reference to tax payment matters.    

CLEAN-UP (including) SPRING CLEAN-UP DAY:   Date designated: April 21 with -- Usual notification process. Review of several properties continues.

PLANNING AND ZONING: No new applications.

SENDD: ORDINANCE ENFORCEMENT ISSUES:  Was invited to the March 16th meeting .  No confirmation was received, and they will be contacted again.  The intent of members is to allow the current Ordinance Enforcement Officer Tim Hanson three weeks (until the next Regular meeting) to determine if it is possible for him to continue in the position based on conflicting time schedule with his employment as a Gage County Law Enforcement Officer.  SENDD will be requested to follow up with the City regarding their attendance at a meeting in the near future in regard to their capacity/updated cost/desire to serve as the City’s Ordinance Enforcement team should Hanson/the City find it necessary to make a change.

CLEAN-UP:  Council President Reedy asked that SENDD be invited to the next Regular meeting (regarding ordinance enforcement), as it was suggested (with all members in agreement) that the current method of addressing clean-up infractions “isn’t working.”  It was stated by members and Rex Adams that additions are added to the clean-up list, but none are resolved.  Sedlacek suggested that Pike contact individuals on the current list to (in person) solicit their cooperation in resolving clean-up issues.    Reedy is to provide a list of locations, and Pike may contact them on his own during work hours, or request Reedy to accompany him (after hours).

COMMUNITY REDEVELOPMENT/TAX INCREMENT FINANCING; BLIGHT AND SUBSTANDARD  STUDY/ORDINANCE# 466( as applies), DESCRIPTIONS, SURVEYOR’S QUOTE, ANY NEW INFORMATION:  Revised Proposed Redevelopment Area Maps were provided to members (with a copy attached to the office copy of the minutes) which included Blue Springs Corporate Limits - 509 Acres; Redevelopment Area - 245 Acres (232.2 Acres within Blue Springs Corporate Limits; Blight Coverage (Pre-Annexation = 45.6 Percent of City of Blue Springs; Blight Coverage (Post -Annexation) = 48.1 Percent of City of Blue Springs, and it illustrated the proposed redevelopment area boundary.   Members were asked to evaluate the revised map and come forward with suggestions if changes are wanted. It was noted that besides the already identified interest in development for which investors are being sought/accumulated - (per Trevor Lee - Ngage), there are contractors interested in building duplexes or houses, but there is also a need for further information (boundaries/legal descriptions - by a land survey tech for a designated fee of $1,500 from the City), and a motion was made (Neumann), seconded (Sedlacek), and approved by a 3-0 affirmative vote to direct Attorney Carothers to notify the surveyor that the City has approved the action and cost.  Carothers also advised the the Blight and Substandard Study should be completed within the next couple of weeks  (Hanna-Keelan).

DEMOLITION PROJECT:  Carothers advised that within 30-45 days it will be possible to take down two properties ).  Demolition is expected to be completed by the City (based on provisions/availability of demolition equipment (Dan Crawford’s), and a cost analysis will be made (Sedlacek) as to cost for removal of debris (Shelby). A pertinent remaining need is to notify utilities (Norris Public Power/Black Hills Energy) about the utilities to be checked out and taken care of for each property.   


CLEAN-UP:   Carothers indicated that he has not received updated information from Tim Hanson (OEO) regarding re-inspection of properties, or inspection on the next round of choices.

KENO OPERATOR AGREEMENT, ORDINANCE # 467 (IF YET APPLIES):  Motion (Neumann), second (Sedlacek) to suspend the rule of three reading for Ordinance # 467. Motion (Neumann), second (Seeman), to to approve Ordinance # 467.  Ordinance was read (Carothers: , and received a 3-0 affirmative vote for approval.
ORDINANCE NO. 467:  
AN ORDINANCE TO APPROVE STEVE BORGMAN, DOING BUSINESS AS PAPA B’S, AS THE CITY OF BLUE SPRINGS’ KENO CONTRACTOR; TO GRANT STEVE BORGMAN, DOING BUSINESS AS PAPA B’S THE NON-EXCLUSIVE RIGHT TO OPERATE FOR THE CITY A KENO STYLE LOTTERY WITHIN THE CITY’S CORPORATE LIMITS; TO AUTHORIZE THE MAYOR AND CITY CLERK TO EXECUTE THE LOTTERY OPERATOR AGREEMENT; TO REPEAL CONFLICTING ORDINANCES OR SECTIONS; TO PROVIDE FOR AN EFFECTIVE DATE.
WHEREAS, a majority of the registered voters of the City of Blue Springs, Nebraska, at a regularly scheduled election have approved the establishment of a municipal lottery pursuant to the Nebraska County and City Lottery Act, Neb. Rev. Stat. §§ 9-601 through 9-653; and WHEREAS, Steve Borgman, doing business as PaPa B’s, desires to serve as the City of Blue Springs’ keno contractor and the City of Blue Springs desires to grant Steve Borgman, doing business as PaPa B’s, the exclusive right to operate a keno style lottery within the City’s corporate limits. NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF BLUE SPRINGS, NEBRASKA that Steve Borgman, doing business as PaPa B’s, be, and hereby is, approved to serve as the City of Blue Springs’ keno contractor, and that Steve Borgman, doing business as PaPa B’s, is granted the non-exclusive right to operate a keno style lottery within
the corporate limits of the City Blue Springs at 619 West Broad Street, Blue Springs, Nebraska.
BE IT FURTHER ORDAINED that the Mayor and City Clerk are authorized to execute the lottery operator agreement with Steve Borgman.
That any other ordinance or section passed and approved prior to passage, approval, and publication or posting of this ordinance and in conflict with its provisions, is hereby repealed. This ordinance shall take effect and be in full force from and after its passage, approval, and publication or posting as required by law. Passed and approved this 16th day of February, 2021. Keno percentages were reviewed, and the responsibilities of the City and the Keno Operator stressed/clarified.  The Lottery Operator Agreement was authorized for Mayoral signature, and Steve Borgman will be contacted to come into the office to review and sign the agreement which will be included with other documentation to fulfill the requirements of Nebraska Charitable Gaming.

COMMUNITY REDEVELOPMENT/TAX INCREMENT FINANCING; BLIGHT AND SUBSTANDARD STUDY/ORDINANCE(S) - FIRST READING ORDINANCE # 466/ AND ANY NEW INFORMATION:  Various aspects of the project were discussed by Attorney Carothers, Mayor Meyer, and Council members Neumann, Reedy, and Sedlacek --  including unknown status of “formal negotiations” for a potential commercial venture, interest of other parties in housing development (utilizing empty lots); timeline for clarification of “unclear” mapping, which was described (Carothers) as “not as big as rush as previously anticipated,” difference of opinion among members about specific annexation area possibilities (including crossing the highway), costs ($12,000 to $15,000 City outlay in the event a proposed project does not go through.   Carothers will attempt to get an accurate description of applicable areas (annexation considerations), and if that is not possible, he will bring to the next meeting a surveyor’s quote for discussion/approval of members. 

DEMOLITION PROJECT:  “Approximately 30 days left” (per Carothers) --  (on current projects) until demolition may be enacted.  Preparations/inspection warrants pending on new project properties. 

CLEAN-UP:  Council member Reedy and Ordinance Enforcement Officer Hanson to follow-up/evaluate (this weekend) properties for which letters to property owners have been mailed, and which may also include evaluation of other properties to be brought to the attention of Mayor and Council for determination of a new round of clean-up notifications.

PLANNING AND ZONING: Motion (Sedlacek), second (Neumann), and 3-0 affirmative vote to approve Steve Borgman’s Application for a Building Permit (concrete pad - Keno Lounge).  Applicant will be notified of approval and fee.  P & Z Commission member Mewes had questions regarding properties with changed classification, as residential to commercial, commercial to residential, and process necessary for changes in property evaluations, and if information could be added to the application for building permits to expedite reassessment of County Assessor.
