At 7:30 PM, Mayor Meyer called the Regular meeting to order and roll call was taken. A motion was made by Council member Wolf, seconded by Reedy, and followed by a 4-0 affirmative vote to approve as sent the November 4, 2014 Regular meeting minutes. After review of claims, a motion was made by Council member Mewes , seconded by Neumann, and followed by a 4-0 affirmative vote to approve claims as follow: Direct -Bank Payment --NE Dept. of Rev. BROAD STREET REPAIR UNDERTAKING - ANY NEW IN FORMATION: John Berry (Gilmore) provided information for potential work on Broad Street from Jefferson to “A” - to construct new 3-inch asphalt overlay with some minor patching, per: (Total Construction Cost $70,000, Engineering $7,000, Project Observation, Contingencies, Administration $7,000 - Total $84,000. Variables were discussed. Council member Neumann suggested activation of bid-letting. Members were in agreement for Berry to initiate the plan process to create the project.
WALNUT STREET REPAIR PROPOSAL - NEW INFORMATION: John Berry provided information for potential work on Walnut Street, per: Option 1 - Remove and replace bad areas of curb and gutter, mill asphalt along edges approximately 8-feet in width, and place 3-inches of new asphalt along the milled areas. Install 24-inch CMP with flared end sections at south end of project on the west side. Total Construction cost $460,000, Engineering $46,000. Project Observation, contingencies, Administration $46,000, Total: $552,000 AND Option 2: Remove and replace existing paving, construct 8-inch concrete paving, install 24-inch CMP with flared end sections on south end of project on west side. Total Construction cost $450,000, Engineering $50,000, Project Observation, Contingencies, Administration $50,000, Total $550,000. Members agreed that the estimated prices, though believed to be “high,” would weaken City stance in the upcoming CDBG grant application process for paving (see potential streets below). John Berry noted that Walnut Street could be broken into projects. Employee Pike said he could use a bobcat and mill driveways on Walnut as part of a temporary fix.
SENDD (JEN OLDS/CDBG GRANT APPLICATION INITIATION INFORMATION): Jen Olds addressed Mayor and Council and provided handouts which in combination with dialog provided the following information: Based on the 2010 census, the City is 58% LMI (low/moderate income) compliant and in a position to apply for the grant without completion of a LMI survey. The 2014 grant maximum is $250,000, with a 50% match giving the maximum point of leverage. Also, completing the environmental review (consulting societies) gets more points. Olds identified the following timeline: January - application guidelines, National Objective approval 5/16, June - notification of eligibility, submission by July, award in Fall - (Sept 1), with a possibly less than 90-day release of funds. Olds indicated that “documentation of community activities” give strength to the application. Mayor Meyer inquired as to whether having been awarded two previous CDBG grants might minimize favorable outcome of the application, and Olds stated that there was no clear understanding of effect in that regard. If grant application has a favorable result, 2016 would be the beginning of construction. Olds requested that members decide (December meetings and let her know by January) which streets would be included in the project. Though only about half of the options can be chosen from a $1,000,000 pool, selections are anticipated to be made from the following: Saunders Street (Broad to Lincoln); Jefferson Street (Lincoln to ½ blk N of Irving); Washington Street (Cherry to Irving); Washington Street (Lincoln to Irving); Washington Street (Broad to Main); Johnson Street (Broad to 1st); Douglas Street (1st to 2nd); Douglas Street (Broad to 1st); 2nd Street (Hazen to Douglas); Hazen Street (Main to Broad); Main Street (Hazen to Douglas) Johnson Street (Main to Broad); Fouts Street (A to Washington); Fouts Street (A to Hazen); Fouts Street (Hazen to Johnson); Wilson Street (Fouts to Jones); - additional projects - Washington Street (Fouts to Jones); Washington Street (Main to Lincoln).
PLANNING & ZONING: No new applications.
CLEAN UP: No response from Carother’s letters to two property owners, so review will continue. No further information available about removal of personal possessions from a sub-standard structure, so review is ongoing. Review continues on another clean-up project. Two locations were removed from the list, one for resolution of issues and the other because it is now being legally addressed, with report to come, as applicable, from Carothers.

Council member Reedy reported that another property on the current list now has an approximately one-month expectation for initiation of removal of sub-standard structure, after property owner can remove possessions inside. Another property on the list continues to be mowed, and clean-up is anticipated to be on-going, but with no major changes within the last two-week period. A property with tall grass/weed infraction continues under review, with Attorney Carothers to draft a letter to the bank, --- with the property to be mowed by the City and a lien placed on the property on behalf of the City if the 5-day deadline for resolve is not met. Another property was removed from the list due to resolution of issue. One property owner is to be sent a certified letter requesting removal of exterior infractions. Attorney Carothers will put a lien against a property where City clean-up was performed.

DUMP TRUCK: Employee Pike told members that the recommendation of the mechanic was “not to fix the truck.” The mechanic said he would “keep an eye out” for one at upcoming auctions.
LAWN MOWERS: Employee Pike reported that the temporary fix is still holding .The hunt for an engine will continue. Council member Wolf suggested applying for an Exmark grant.
SPEED LIMIT SIGNS AT SCHOOL: Speed-related situations at/near the school were reported by Connie Mewes. Mayor Meyer, Council members Mewes, Neumann, Reedy, and Wolf, and Bob Widick recognized the problem and limits to Municipal response, agreeing, as stated by Wolf, that existing procedure is to “get the license number (of violator) and call the Sheriff.”
PLANNING & ZONING: Two building permit applications that met with the approval of the Planning and Zoning Commission on 10/20/14 were approved -- 1. Deck Replacement - Greg/Bev Atwater - motion to approve by Council member Wolf, second by Neumann, and a 4-0 affirmative vote (&) 2. Fence Construction - Connie Mewes - motion to approve by Council member Wolf , second by Neumann , and vote of Mewes - Abstain, Neumann - Yes, Reedy - Yes, and Wolf - Yes.
CLEAN UP: No action was indicated for debris removal at the site of a controlled burn - -smoldering continues. Council member Reedy reported communication issues with property owner of a sub-standard structure. Review continues at another site where another vehicle has been removed. City Attorney Carothers will be contacted for information about mowing situation on another property. Employee Pike will mow a property posted by the City. Council member Wolf reported a couch, love seat, and topper on another property, and a clean up letter was designated.

LAWN MOWER (Pike): Employee Pike reported on-going problems with both City mowers. He anticipated that the problem with the newer one might be that a push rod came off. “It ran good until 3PM, then wouldn’t start afterward. Head was taken off last week.” He will know more tomorrow. Motor replacement is an option for the other. (Options: Husa looking for one. Northern Hydraulics - $2,000. Specifics: 22 hp Pro-Command - horizontal shaft - both sides). Possibilities will be pursued, and price comparisons made.
DUMP TRUCK (Pike): Employee Pike stated that “something needs to be done” with the secondary dump truck (5-yd). Needs were listed: New rear end. Axle bent. Sticks in neutral. Lots of other issues. LAWN MOWER (Pike): Employee Pike reported on-going problems with both City mowers. He anticipated that the problem with the newer one might be that a push rod came off. “It ran good until 3PM, then wouldn’t start afterward. Head was taken off last week.” He will know more tomorrow. Motor replacement is an option for the other. (Options: Husa looking for one. Northern Hydraulics - $2,000. Specifics: 22 hp Pro-Command - horizontal shaft - both sides). Possibilities will be pursued, and price comparisons made.

2014-2015 BUDGET HEARING:
At 7:35 PM, Mayor Meyer called for a motion to open the 2014-2015 Budget Hearing. The motion was made by Council member Wolf, seconded by Mewes and received a 3-0 affirmative vote. Mayor Meyer called for comments and questions from Council and others in attendance and turned summarization over to Jennifer Busboom. Busboom covered points from the Budget Notes:
2014-2015 Budget Notes: The City appears to be continuing to produce revenues in excess of regular operating expenditures. The General All-Purpose Fund is producing roughly $28,000 per year (an increase from last year), and the Keno Fund is producing roughly $50,000 per year (decreased from previous). These funds produced are held in reserve available for capital outlays (paving, new equipment, water lines, etc.)... It is estimated that as of October 1, 2014, you will have cash reserves of about $187,000 General and $420,000 Keno. This compares to the prior year amounts of $195,000 General and $372,000 Keno... For the year 2014-2015, proposed budget property tax has been left at the levy limit of 45 cents, which increases the tax request from $28,712 to $28,858. This increase (of approx. .51%) is due to higher total assessed valuation for the City from $6,380,478 to $6,412,927... Of this increased valuation, $73,879 (approx. 1.16%) is attributable to new growth… Other operating revenues have been estimated conservatively at $120,000 based on the prior year amounts for the general funds. $450,000 has been included in other operating revenues based upon prior years’ estimated Keno game gross proceeds... $662,000 has been budgeted as potential capital outlay in the General All-Purpose Fund and no capital outlay has been budgeted in the Keno Fund beyond your normal operating expenditures. However, $490,000 has been budgeted to be transferred from the Keno Fund to the General All-Purpose Fund to assist in financing potential capital outlay projects. Normal operating expenditures have been budgeted liberally at $248,000 for the General All-Purpose Fund and $382,500 (includes game winner payoffs) for the Keno Fund at 85% payout... The budget process and document perform two legal functions: 1. Sets the property tax request-budgeted at $28,858. 2. Establishes an overall expenditure limit-budgeted at $1,782.500.... The budget must be adopted by September 20. The property tax requested in the budget will be final; however, the expenditure limit may be amended, if needed, throughout the year...The expenditure limit included in the proposed budget allows for expenditure of nearly all cash reserves which are expected to be available. Since some cash reserves will be necessary, we don’t expect, nor do we recommend, that the full amount budgeted of $1,782,500 be spent. GENERAL BUDGETING NOTES: The lid law is assigned to limit the growth of non-utility government revenues to inflationary increases. Exceptions are allowed for revenues required to pay off bonded debt, real estate improvement capital outlays, and interlocal agreements... Due to the Lid Law restrictions, it continues to be advantageous to pay real estate capital outlays, pay off of bonded debt, and participate in interlocal agreements from funds where property tax, sales tax, and state pass-through revenues are deposited (i.e. General and Street). This will help keep this law from limiting your non-utility source revenues...The lid law has become a significant factor for future budgets. Although you have adequate unused budget authority at this time, this is a factor that should be monitored.
Jennifer Busboom noted that the motion, vote, and approval to accept a 1% allowable additional increase in the Restricted Funds Authority was made at the July 15, 2014 Regular meeting.
No changes were required to the Budget, and a motion to adopt the Budget as proposed/published was made by Council member Mewes, seconded by Wolf and carried by majority vote -- Mewes - Yes; Reedy - Yes; Wolf - Yes.
At 7:45 PM, a motion by Council member Wolf, second by Mewes, and a 3-0 affirmative vote opened a Special Budget Meeting within the Budget Meeting, and a motion was made by Council member Wolf, and seconded by Mewes to approve Resolution #2014-3. Resolution #2014- 3 was read. (WHEREAS, Nebraska Revised Statute 77-1601.02 provides that the property tax request for the prior year shall be the property tax request for the current year for purposes of the levy set by the County Board of Equalization unless the Governing Body of the City of Blue Springs passes by a majority vote a resolution or ordinance setting the tax request at a different amount and WHEREAS, a special public hearing was held as required by law to hear and consider comments concerning the property tax request, and WHEREAS, it is in the best interests of the City of Blue Springs that the property tax request for the current year be a different amount than the property tax request for the prior year. NOW, THEREFORE, the Governing Body of the City of Blue Springs by a majority vote, resolves that-- 1. The 2014-2015 property tax request be set at $28,858.00. A copy of this resolution be certified and forwarded to the County Clerk prior to October 13, 2014. Passed and approved…..) The majority vote was Mewes - Yes; Reedy - Yes; Wolf - Yes to adopt Resolution #2014-3 for a property tax amount different than that of the previous year, and the dollar amount ($28,858.00 ) was noted.
The Budget Hearing was closed (Motion by Wolf, second by Mewes, and affirmative 3-0 vote) at 7;50 PM, which returned proceedings to Regular session.
WYMORE LIBRARY: ANNUAL DONATION CONSIDERATIONS (JANET ROBERTS): Following brief discussion, a motion was made by Council member Mewes, seconded by Wolf and received a 3-0 affirmative vote to donate $750.00 to the Wymore Public Library. Janet Roberts circulated books provided through previous Blue Springs donation (2+ a month, depending on book cost) , and Mayor Meyer and Council members Mewes, Reedy and Wolf were appreciative of City acknowledgment inside the cover of each book and supportive of the library which is utilized by many residents of Blue Springs.

CLEAN UP: Since asbestos has been removed and documented, Brad Robinson outlined the plan for a controlled burn as a training exercise, tentatively for September 20th. He asked if the gas line had been capped off at the alley, and Employee Pike agreed to contact the gas company to make sure it is done. The plan is for Robinson to prepare necessary documentation for the Fire Safety Training exercise (State), for Carothers to provide the legal description, for the City to pull the structure in, the subsequent burn, and the property owner (previously notified by Carothers) to haul off any remaining debris and fill the hole. -- Council member Reedy will contact another property owner to provide roll off cost ($295 - small; $395 - large) and it is anticipated that Milford Woutzke will scrap out the project. Although not much progress has been observed on another property, allowance will be given due to medical concerns, and review will continue. - Attorney Carothers will contact realtor (Buss) to clarify further mowing needs on another property. One property owner is to receive a certified letter for tall weeds/grass. - Three courtesy letters were requested for properties with tall weeds/grass.

Of this increased valuation, $73,879 (approx. 1.16%) is attributable to new growth… Other operating revenues have been estimated conservatively at $120,000 based on the prior year amounts for the general funds. $450,000 has been included in other operating revenues based upon prior years’ estimated Keno game gross proceeds... $662,000 has been budgeted as potential capital outlay in the General All-Purpose Fund and no capital outlay has been budgeted in the Keno Fund beyond your normal operating expenditures. However, $490,000 has been budgeted to be transferred from the Keno Fund to the General All-Purpose Fund to assist in financing potential capital outlay projects. Normal operating expenditures have been budgeted liberally at $248,000 for the General All-Purpose Fund and $382,500 (includes game winner payoffs) for the Keno Fund at 85% payout... The budget process and document perform two legal functions: 1. Sets the property tax request-budgeted at $28,858. 2. Establishes an overall expenditure limit-budgeted at $1,782.500.... The budget must be adopted by September 20. The property tax requested in the budget will be final; however, the expenditure limit may be amended, if needed, throughout the year...The expenditure limit included in the proposed budget allows for expenditure of nearly all cash reserves which are expected to be available. Since some cash reserves will be necessary, we don’t expect, nor do we recommend, that the full amount budgeted of $1,782,500 be spent. GENERAL BUDGETING NOTES: The lid law is assigned to limit the growth of non-utility government revenues to inflationary increases. Exceptions are allowed for revenues required to pay off bonded debt, real estate improvement capital outlays, and interlocal agreements... Due to the Lid Law restrictions, it continues to be advantageous to pay real estate capital outlays, pay off of bonded debt, and participate in interlocal agreements from funds where property tax, sales tax, and state pass-through revenues are deposited (i.e. General and Street). This will help keep this law from limiting your non-utility source revenues...The lid law has become a significant factor for future budgets. Although you have adequate unused budget authority at this time, this is a factor that should be monitored.
Jennifer Busboom noted that the motion, vote, and approval to accept a 1% allowable additional increase in the Restricted Funds Authority was made at the July 15, 2014 Regular meeting.
No changes were required to the Budget, and a motion to adopt the Budget as proposed/published was made by Council member Mewes, seconded by Wolf and carried by majority vote -- Mewes - Yes; Reedy - Yes; Wolf - Yes.
At 7:45 PM, a motion by Council member Wolf, second by Mewes, and a 3-0 affirmative vote opened a Special Budget Meeting within the Budget Meeting, and a motion was made by Council member Wolf, and seconded by Mewes to approve Resolution #2014-3. Resolution #2014- 3 was read. (WHEREAS, Nebraska Revised Statute 77-1601.02 provides that the property tax request for the prior year shall be the property tax request for the current year for purposes of the levy set by the County Board of Equalization unless the Governing Body of the City of Blue Springs passes by a majority vote a resolution or ordinance setting the tax request at a different amount and WHEREAS, a special public hearing was held as required by law to hear and consider comments concerning the property tax request, and WHEREAS, it is in the best interests of the City of Blue Springs that the property tax request for the current year be a different amount than the property tax request for the prior year. NOW, THEREFORE, the Governing Body of the City of Blue Springs by a majority vote, resolves that-- 1. The 2014-2015 property tax request be set at $28,858.00. A copy of this resolution be certified and forwarded to the County Clerk prior to October 13, 2014. Passed and approved…..) The majority vote was Mewes - Yes; Reedy - Yes; Wolf - Yes to adopt Resolution #2014-3 for a property tax amount different than that of the previous year, and the dollar amount ($28,858.00 ) was noted.
The Budget Hearing was closed (Motion by Wolf, second by Mewes, and affirmative 3-0 vote) at 7;50 PM, which returned proceedings to Regular session.
WYMORE LIBRARY: ANNUAL DONATION CONSIDERATIONS (JANET ROBERTS): Following brief discussion, a motion was made by Council member Mewes, seconded by Wolf and received a 3-0 affirmative vote to donate $750.00 to the Wymore Public Library. Janet Roberts circulated books provided through previous Blue Springs donation (2+ a month, depending on book cost) , and Mayor Meyer and Council members Mewes, Reedy and Wolf were appreciative of City acknowledgment inside the cover of each book and supportive of the library which is utilized by many residents of Blue Springs.
PLANNING & ZONING: No new applications.
CLEAN UP: Since asbestos has been removed and documented, Brad Robinson outlined the plan for a controlled burn as a training exercise, tentatively for September 20th. He asked if the gas line had been capped off at the alley, and Employee Pike agreed to contact the gas company to make sure it is done. The plan is for Robinson to prepare necessary documentation for the Fire Safety Training exercise (State), for Carothers to provide the legal description, for the City to pull the structure in, the subsequent burn, and the property owner (previously notified by Carothers) to haul off any remaining debris and fill the hole. -- Council member Reedy will contact another property owner to provide roll off cost ($295 - small; $395 - large) and it is anticipated that Milford Woutzke will scrap out the project. Although not much progress has been observed on another property, allowance will be given due to medical concerns, and review will continue. - Attorney Carothers will contact realtor (Buss) to clarify further mowing needs on another property. One property owner is to receive a certified letter for tall weeds/grass. - Three courtesy letters were requested for properties with tall weeds/grass.

The Regular Meeting of Mayor and Council was held on August 19, 2014, in the Blue Springs City Hall, Blue Springs, NE.

Notice of the meeting/hearing was given in advance by posting in at least three public places as shown by the certificate of posting placed on file. Notice of the hearing/meeting was simultaneously given to the Mayor and all members of the City Council and a copy of their acknowledgment of receipt and agenda are placed on file. Availability of the agenda was communicated in the advance notice and in the advance notice to the Mayor and City Council of the hearing/meeting. Proceedings hereafter shown were taken while the convened hearing/meeting was open to public attendance.
At 7:30 PM, Mayor Meyer called the Regular meeting to order and roll call was taken. A motion was made by Council member Wolf, seconded by Mewes, and followed by a 4-0 affirmative vote to approve as sent the August 5, 2014 Regular meeting minutes. CITY CELEBRATION: FINAL REVIEW, AS NEEDED: Public attendance alone qualified the event as a success. Only positive comments were made to Mayor Meyer, and Council members Mewes, Neumann, Reedy and Wolf. Connie Mewes did suggest need for caution to protect children in the area when several of the car show participants were leaving (speed above limit). Neumann stated that a minor incident occurred - health issue of Tractor show participant), but all ended well. Council member Mewes reported noticing a steady flow of visitors to the cabin (Count per Jan Morris - 100+ - “a record.”) Morris commented about the buffalo hide and fur trader trademark, and also was grateful for the recent electrical work done at the cabin. Reedy reported Car/Motorcycle participation -66; Neumann indicated there were 4 or 5 new Tractor participants, with count down 2-3 from last year. All things considered, (as same-day competitive events in surrounding area, for one of which inflated participation information was initially received), the result of promotion and a fine day of weather was an impressive turnout. Gratitude of Mayor and Council was expressed to: Tim Brown for volunteer mowing (providing his own equipment and fuel), cleaning the park shelter, fixing the table (providing materials), pursuit of door prizes, and other aspects. Connie Mewes was thanked for providing the Tractor Show pens at her own expense. The City crew was thanked for extra clean up efforts which made the City look good. Council member Wolf apologized for not (due to medical issues) taking an active role in this year’s preparations. In closing, Mayor Meyer thanked all facilitators and volunteers.
CHAMBERLIN MEMORIAL: FINAL REVIEW, AS NEEDED: Jan Morris indicated that the dedication went well, which included impressive public attendance, a high level of reception and public availability of the speakers and their faction, a pictorial by the Arbor State; and a video record (online). Council member Wolf noted that he saw “a very nice article and (Arbor State) pictures” on the Husker site. Success was in no small part attributable to Jan Morris herself who put forward a supreme and greatly appreciated effort, giving generously of her own time and personal assets. (Chamberlin donations prior to meeting: $3,060.00. Added at meeting: $210, with $10.00 of it previously logged, resulted in a current amount of $3,260 with at least one more donation anticipated in route by mail.)
PLANNING & ZONING, REQUEST TO RECLASSIFY RESIDENTIAL PROPERTY TO AGRICULTURAL (T. CARY): Gladys Cary was advised to provide all needed information for review of the situation to the Planning and Zoning Commission. Positive reception to the request would result in a Public Hearing of the Planning and Zoning Commission and Public Hearing of the City Council (with Ordinance prepared). It was noted that, within the process, specifics must be posted - Legal description of property for which request is made, and descriptions of surrounding properties. Attorney Carothers noted that “spot zoning is frequently struck down” (Supreme Court).
WAIVE RENTAL FEE FOR HALL USE -- WOLF: Council member Wolf requested consideration for waiving rental fee for Thursday night (8/21) for use of City Hall for cookie bake (use of oven) for upcoming Cystic Fibrosis Stride Walk. No objections were made. Wolf will provide access to building.
CLEAN UP: Attorney Carothers reported on progress at one property - : Trailer is gone and property owner has reported he is in the process of following up on DHHS advisement to contact the landfill for handling specifics (asbestos concerns - fire damaged house). Carothers will call property owner again on Friday, and if timely follow-up is not maintained, he will go ahead with the legal filing. Council member Reedy reported on contact with another property owner. Reedy reported that the property owner is receptive to removal of the sub-standard trailer from the property, and would like to know the cost of a roll off. Employee Pike will provide Reedy with that information so he can report back to the property owner. An interested party was determined to be available for the scrapping process. Progress continues on one property on the list, with review to follow. Current information (Neumann/Carothers) supports possibility of a sale pending of one property with mowing considerations. A request will be made with Buss Realty (Carothers) for mowing the property. Two properties were added to the current list by Council member Neumann (for mowing), with courtesy letters (with 9/2 deadlines) to be sent.
