April 5, 2022 The Public Hearing for Ordinance # 468 (Poultry/Fowl) and the Regular meeting of Mayor and Council of Blue Springs, Nebraska was held on the 5th day of April, 2022, at 7PM at the Blue Springs City Hall. PRESENT: Mayor Meyer; Council members Neumann, Reedy, Sedlacek, Seeman ABSENT; OTHERS PRESENT: Attorney Carothers, Employee Pike, Curt Hagerman Notice of the Hearing/Regular meeting/hearing was given in advance by posting in at least three public places as shown by the certificate of posting placed on file. Notice of the hearing/meeting was simultaneously given to the Mayor and all members of the City Council and a copy of their acknowledgment of receipt and agenda are placed on file. Availability of the agenda was communicated in the advance notice and in the advance notice to the Mayor and City Council of the hearing/meeting. Mayor Meyer called the Regular meeting to order at 7 PM. Motion (Neumann), second (Seeman) , and vote (4-0 affirmative) to approve as sent minutes for the March 15, 2022 Regular meeting. Close Public Hearing and Return to Regular Session - 7:15 PM by Motion (Reedy), Second (Neumann), 4-0 affirmative vote. Followed by Regular session: ORDINANCE # 468 (POULTRY): Motion (Neumann), second (Seeman), 4-0 affirmative vote to suspend the rule of three readings. Motion (Neumann ), second (Sedlacek), to approve Ordinance # 468. Ordinance # 468 read (Carothers), followed by 4-0 affirmative vote to approve. A copy of Ordinance # 468 is attached to the Office copy of the minutes and posted on the website. COMMUNITY REDEVELOPMENT/TAX INCREMENT FINANCING/ BLIGHT STUDY REVIEW/ORDINANCE# 466 - First Reading), ANY NEW INFORMATION: Further action pending advisement of State questions (right-of-way) regarding Witulski survey. Hagerman requested information about opportunity for receipt of TIF taxes (for sidewalks primarily). Reedy presented view about possibility/advisability of proceeding with the project (for benefit of current developers) without the proposed annexation. Carothers told that rescheduling of the annexation would result in additional fees but probably not a substantial assessment. Reedy suggested deliberation and further discussion at the next Regular meeting. Reedy will also contact Witulski to get current status of the survey. Potentiality of sewer provision in the area to be annexed was also discussed. DEMOLITION PROJECT/THOMAS FOUNDATION GRANT TIMELINE: Arrangements continue for inspections. Carothers also suggested grant application amount request options from the Thomas Foundation for the next round of demolitions, ranging from $35,000 - $50,000. CLEAN-UP: No new properties added to the list at this time. PLANNING AND ZONING--ZONING CHANGES REGARDING ESTABLISHING LOT CORNERS: Carothers submitted for review/consideration an initial draft of Ordinance #472, regarding applications for building permits…. requirement to hire a licensed surveyor to locate and establish lot corners for new construction, and potential fine for failure to comply. Will be further addressed at the next Regular meeting. TEMPS DISPOSAL- CONTRACT RENEWAL/CONSIDERATIONS: Motion to accept contract/authorize Mayoral signature on Temps Disposal Contract was made by Sedlacek, seconded by Seeman, and followed by 4-0 affirmative vote for approval. The agreement will be mailed to Shelby Temps for his signature, and Carothers will be provided with a copy of the signed document when it is returned to the City. US CENSUS BOUNDARY & ANNEXATION SURVEY/ ANDY CAROTHERS: Carothers has completed the forms, and is working on the map, with City approval/Mayoral signature expected at the next Regular meeting (to be in compliance with the May 31st deadline). REQUEST FOR CONSIDERATION FOR BLUE SPRINGS AS A SECOND-CLASS CITY TO PURSUE “AT LARGE” STATUS RATHER THAN VOTING WARDS: Motion (Reedy), second (Seeman), to put the proposed voting change on the ballot, resulted in a vote of Reedy (Yes), Seeman (Yes), Sedlacek (No), Neumann (No). Mayor Meyer did not vote, but suggested that those interested in the change arrange to circulate a petition. WATER LINE EXTENSION/ ADDITIONAL LOCATIONS/ SCOPE/NEEDS SURVEY/ LOAN OPPORTUNITIES: Sedlacek stated some financial options/conditions of financing infrastructure improvements, indicating that a Preliminary Engineering Report would be required, and possibility exists for 30% to 50% or 60% forgiveness on loans. Some requirements/ and factors were identified, as evaluation of water rates - (that might and might not need to be raised - since City recently already increased charges. Sedlacek provided qualification/compliance requirements in various documents which will be completed/submitted for consideration.
