The Regular Meeting of Mayor and Council was held on June 18, 2013, in the Blue Springs City Hall, Blue Springs, NE.

At 7:32 PM, Mayor Meyer called the Regular meeting to order and roll call was taken. A motion was made by Council member Wolf, seconded by Reedy, and followed by a 4-0 affirmative vote to approve as sent the June 4, 2013 Regular meeting minutes. CONTINUED PLANNING (AS NECESSARY) FOR ANNUAL CAR/TRACTOR SHOW: Council member Reedy provided information about a “burn-out” trailer. No objections were made, but precautionary
steps will be taken, as fence. Per Reedy, the mud-volleyball event which was an activity planned independent of the City has met with potentially prohibitive factors in reference to alcoholic beverage plans. A special use license would require “organization” setup. Inclusion in Fire Department Special Use License was presented as an option, but was thought by all to be a low-likelihood possibility. Council member Neumann stated his understanding that the individual(s) involved (should the event continue) would be responsible to obtain their own insurance, not the City. Neumann also inquired about changes to the mock-up flyer --- to include cabin opening, the carousel, and changing the header to Blue Springs Celebration.


CABIN OPENING (REMINDER ADS): No new information. Council member Wolf has not yet received the requested supplemental cost quote from Beatrice Daily Sun. Additionally, re-evaluation of open dates is underway, with the attendance of the next couple openings to be used to determine advisability of subsequent opening dates. Attendance was lower that anticipated (10 individuals) during the Sam Wymore Day cabin opening.


PLANNING & ZONING: Following review, a motion was made by Council Member Mewes, seconded by Neumann, and received a 4-0 affirmative vote to approve the Ronnie Rainey (garage) application for a building permit which was approved 5-0 at the 6/17/13 P & Z Commission meeting. Applicant will be notified of approval and fee.


CLEAN UP, CURRENT ISSUES: Council member Reedy noted that one property where debris remains after a controlled burn is “good to go,” now, and he indicated that, to his understanding, the property owner has contacted a contractor. Regarding another property where a trailer caught fire and clean-up is being pursued, Mayor Meyer and Council members Mewes, Neumann, Reedy, and Wolf were in agreement for City Attorney Carothers to proceed per the details of his 6/17/13 email to the City.

ANNUAL INSURANCE PACKAGE (Discussion as needed): Insurance package was reviewed, with primary concern clarified. -- Lift Station/Loc. 002 (building and pumps) is covered (with standard $500 deductible in the blanket coverage of $400,800). Payment for Annual Insurance Package ($12,485.00) was included in motion of approval for current claims.



CONTINUED PLANNING (AS NECESSARY) FOR ANNUAL CAR/TRACTOR SHOW: Council member Neumann, with support by Mewes, presented for consideration the possibility of including a Carousel Unit to be set up in the park adjacent to Tractor Show activities during the annual celebration (August), and it was favorably received.



CABIN OPENING (REMINDER ADS): Information (advertising) is not yet available from the Daily Sun (Wolf) . Council member Wolf brought up dampness issues at the cabin, and the need to initiate a drainage system around the cabin to minimize problems. Input was provided by all. Employee Pike will review the situation, with plans in mind to trench around the cabin and set perforated pipe in place to provide south drainage.



PLANNING & ZONING:  No new issues.


MFO FUNDS/$847.24: Determination was made by Mayor and Council to hold the received MFO money in the Fire Fund of General Checking, for application toward hydrant purchases in the Phase II/III Broad Street Water Main Project to be conducted during 2013.



SOFTBALL TOURNAMENT: STREET CLOSING REQUEST:  A motion was made by Council member Mewes, seconded by Neumann, and followed by a 4-0 affirmative vote to allow for street closing (Cherry Street - at Adam’s, at Izer’s at dead end/North) 8:AM - 10PM - June 7, 8, 9, 2013 for the Softball Tournament.



CLEAN UP, CURRENT ISSUES: Several properties were removed from the clean-up list due to resolution of issues. Properties were designated to be posted for mowing, and Pike is again to document mowing events to support lien-attachment at season end. Attention was given to procedural needs following controlled burns by Fire Department, which in the recent case involved the activities of private citizens with the Fire Department, and this included NEASHAP/Fire Training forms. Clarification will be pursued, and necessary paperwork and actions will follow. City Attorney Carothers summarized the procedure in situations where property clean-up is needed at sites where ownership is not clearly established. Topics included suggestions for City representative to attend Sheriff’s sales, explanation of the three-year ride of redemption and treasurer’s tax deeds, and foreclosure to reduce judgment, etc. Though many sub-standard properties were identified for potential arrangements for property inspection/condemnation procedures. and various clean-up options discussed, with Mayor Meyer and Council members Mewes, Neumann, Reedy and Wolf each providing input (which was in some cases not in agreement), potential for future address of such properties was left open, and primary focus fell to one property on the current list. City Attorney Carothers will research the status of that property/sheriff sale scheduling, and will contact Lancaster County law enforcement as necessary to try to get an address for the property owner on record.

CONTINUED PLANNING (AS NECESSARY) FOR ANNUAL CAR/TRACTOR SHOW: Council member Reedy will hand out flyers at the upcoming Marysville Car Show.

CABIN OPENING (REMINDER ADS): Council member Wolf placed initial notice ads in Beatrice Daily Sun and Wymore Arbor State. Notice has/will be placed on Blue Springs, Wymore, Tourism, and Library (Valentinos) websites. Mention will be made by Rhonda Brownawell (SGCPG), Mark Meints (during upcoming parade radio coverage). Council member Reedy will provide Wolf with an additional Daily Sun contact, with object to be discussion for an improved rate on subsequent reminder ads. Laughlin- Hoevet will include notice on their calendar of events, VanBoening on the community calendar. Neumann suggested reminder notice to be made in Arbor State. Reminder newspaper ads will continue under review. Coverage has been provided for “cabin open” dates as follows: Memorial Day - Tom Wolf 10-11AM; Jan Morris 11AM-3PM; June 1st probably Tom Wolf; July 4th - Jan Morris, August 17 - Jan Morris, Labor Day - Jan Morris, providing no conflict exists between this and her commitment to a tour activity.

PLANNING & ZONING: No new applications were submitted.

CLEAN-UP, CURRENT ISSUES: Some progress was noted as a result of the mailing of one courtesy letter. One property owner and recipient of a courtesy letter for clean up after a controlled burn will continue under
review. Council member Reedy provided information which clarified that removal of debris can not be conducted until 30 days after the burn. “Lineweber or Beatrice Landfill will not accept until then.” “And a receipt must be provided.” The City Attorney will be contacted for assistance with one clean up project (trailer burned) for which a mailing address is not available, and will be requested to attend the next meeting to provide information. Employee Pike was requested to “post” those properties the City will need to mow again this season.

CONTINUED PLANNING (AS NECESSARY) FOR ANNUAL CAR/TRACTOR SHOW: Council member Reedy advised members that he plans to add 3rd place for cars this year, and “selecting judges” rather than “pulling” from those available. This will cause a minimal increase in Car Show activity cost. Council member Neumann indicated he may have a slight increase in Tractor Show cost as well. Both will still be within approved budget.


PLANNING & ZONING: No new applications.


POTENTIAL ARMOR COATING PROJECT: Armor Coating review which initially resulted from contact of citizens with Council member Neumann was discussed. Mayor and Council concluded that an armor coating project will not be activated at this time (perhaps next year), due to the time constraints involved with the current active Broad Street Water Main Project - Phase 11/111.


CLEAN-UP (REVIEW OF CLEAN-UP DAY, AND REGULAR CONCERNS): Clean-up Day was noted to have been successful, with three 30 yard roll-offs utilized. Two households included materials outside the range of accepted items, and this was or will be brought to their attention to avoid repetition in future Clean-Up events. In matters of general clean-up concern, three courtesy letters were requested, two for clean up after controlled burns, one for accumulation of garbage. Mandatory garbage pickup was briefly discussed, with no action taken. Mayor Meyer requested members to look around the community and bring up locations needing clean-up attention-- at the next Regular meeting.


CABIN: OPENING DATES/PUBLICATION: Council member Wolf inquired into the possibility of publishing in local newspapers the dates the Cabin will be open for public visitation. Mayor and remaining Council favorably reviewed the plan, which will begin as a posting to the City website, and Jim Spangler’s Website (Tourism). Local ads will be placed (Arbor State/Beatrice Daily Sun) which will list the following openings 10AM - 3PM - May 27th - Memorial Day, June 1st - Sam Wymore Days, July 4th - Independence Day, August 17 - Blue Springs Annual Car & Tractor Show, and September 2nd - Labor Day. Reminders of upcoming dates from this list may be also placed in the newspaper, depending on cost to be obtained by Wolf and reported to Mayor and remaining Council.


METER DEPOSIT REVIEW FOR EXCEPTION: Mayor and Council reviewed the request of a new utility customer who purchased a local residence for not having to submit a meter deposit, and a letter of excellent payment record was provided by the new customer’s previous utility company, as a basis for determination. Mayor and Council discussed the matter and concluded that no exception will be made.

ANNUAL INSURANCE PACKAGE (DAVIDSON INSURANCE CO.) Mark Davidson indicated that the policy is not yet available. Council member Wolf inquired about lift station coverage, and Davidson told that the information would be included in the insurance package which will be mailed to the City for review/payment in the near future. The topic will remain on the agenda for the address of any issues, should there be any, when the policy is submitted for payment.

WAGES: PART-TIME, TEMPORARY EMPLOYEE: After discussion and a suggestion by Mayor Meyer for temporary re-hire of Milford Woutzke at $10.00 an hour (primarily for the Broad Street Water Main Project expected to begin May 1st), a motion was made by Council member Mewes, second by Wolf, and a 3-0 affirmative vote followed to activate the updated hourly salary of Woutzke at $10.00.

PUBLIC HEARING FOR COMMENTS/CONCERNS: ZITO MEDIA FRANCHISE RENEWAL Following the opening of the Public Hearing at 7:32 PM (Motion by Council member Wolf, Second by Mewes, and 4-0 affirmative vote), Mayor and Council, City Attorney Carothers, Employee Pike and Delbert Bartels, Evelyn Michaelis, Janet Roberts and Roberta Hopkins entered into discussion following a brief overview by Carothers. (Zito Media Franchise expires in three years. Formal and informal renewal process required by Federal Cable Act. Purpose of public hearing for subscribers to express concerns.) Shared concerns included: Incidents of poor reception - “squiggles on a daily basis,”, incidents of “picture without sound, sound without picture”, “channels lost but price increased”, “incidents of automatic bank payment wherein increased pricing came into effect without notification to customer”, “service calls answered but without improvement”, “long wait and continued unavailability of acceptable reception boxes (HD)”, “can’t get Major League Baseball.” Alternate option service provider was discussed, but it was noted that larger companies cannot be attracted to the community. Satisfaction was expressed in regard to Zito internet service. The Public Hearing closed at 7:55 PM ( Motion by Council member Wolf, Second by Neumann - 4-0 affirmative vote). Franchise renewal study will continue.


KENO OPERATOR CONTRACT RENEWAL: Attorney Carothers provided drafts of the new (annual renewal 5/1/13 - 5/1/14) Operator’s Agreement. No changes had been requested by the Operator. The Operator will be advised of the availability of the agreement at the City Office. Signature by all parties will be followed by distribution of copies.




ANNUAL INSURANCE PACKAGE (DAVIDSON INSURANCE CO.) : Compilation of data continues by Davidson Insurance. Topic will be forwarded to next agenda.


CONTINUED PLANNING (AS NECESSARY) FOR ANNUAL CAR/TRACTOR SHOW: Council member Reedy provided information for the following inclusions for the annual celebration: Mud Volleyball (Independent of City - Brent Maxson (own insurance); Horseshoe Pitch - East of Fire hall, Bounce House (from Beatrice this year). Council member Neumann noted that the Elevator will again sponsor plaques for the Tractor Show.


STATE FIRE CONFERENCE AD (Continued review): Council member Reedy circulated a copy of the proposed ad. Following discussion, Mayor Meyer advised against placing an ad in the State Fire Conference booklet, due to limited advertising impact of the ad. Neumann opt for placement of the ad in local media as: Arbor State, Daily Sun, Lincoln Journal. Wolf noted the ad was intended not only to advertise the local event, but also to support the Fire Department (Conference). Neumann said he would rather it had been an opportunity to support the Blue Springs Fire Department. Council member Mewes made a motion, followed by a second by Neumann, and a passing vote of (Reedy - Yes, Wolf- No (by reason that the motion was not necessary since local advertising of the event had already been decided), Neumann - Yes, Mewes - Yes).


PLANNING & ZONING: Determination was made on a question posed by a local farmer (Gale Hardin), who had inquired about a building permit at the County Office, and was told that his location falls under the jurisdiction of the City. Reference materials were reviewed, and confirmation reached. A building permit application will be mailed to Hardin for his completion and return.

The Regular Meeting of Mayor and Council was held on March 19, 2013, in the Blue Springs City Hall, Blue Springs, NE.

Notice of the meeting/hearing was given in advance by posting in at least three public places as shown by the certificate of posting placed on file. Notice of the hearing/meeting was simultaneously given to the Mayor and all members of the City Council and a copy of their acknowledgment of receipt and agenda are placed on file. Availability of the agenda was communicated in the advance notice and in the advance notice to the Mayor and City Council of the hearing/meeting. Proceedings hereafter shown were taken while the convened hearing/meeting was open to public attendance.


At 7:30 PM, Mayor Meyer called the Regular meeting to order and roll call was taken. A motion was made by Council member Wolf, seconded by Neumann, and followed by a 4-0 affirmative vote to approve as sent the March 5, 2013 Regular meeting minutes. After review of claims, a motion was made by Council member Mewes, seconded by Neumann, and followed by a 4-0 affirmative vote to approve claims as follows: Salaries - $1,810.93; Bank-Direct Payment - NE Dept. of Revenue (#10) - $232.95; NDHHS - Public Health - $375.00; NE Public Health Environ. Labs - $14.00; Roehr’s Machinery - $589.29; Security First Bank - (Pike - IRA) - $55.00; Windstream - $65.10; TOTAL CLAIMS: $ 3,142.27.
