CDBG PROJECT # 15 PW-015: ANY PERTINENT INFORMATION : No new business.
HARD-SURFACING ACROSS FROM CHURCH: The cost is anticipated to come in at about $3,000, which members were in agreement would be paid in full by City funds (Motion: Reedy, second: Mewes, vote -4-0 affirmative).
PARK SIDEWALK: Options for repairs, as discussed: 1. Replace only areas of upheaval from tree roots. 2. Replace all park sidewalk - south, and east side to bridge. Mayor Meyer expressed preference for option 2, and asked that City Attorney Carothers attend the next Regular meeting to clarify State requirements as apply to curbing issues and handicapped (accessible) approaches, and any need for a bidding process for sidewalk replacement. Further on-site inspection was discussed, as were weather factors. It was general consensus to get clarifications from Attorney Carothers before making further plans.
CITY CELEBRATION - PLANNING: Council member Neumann noted that next year is Nebraska’s birthday, also that the city celebration is planned for one day prior to the eclipse.
PLANNING AND ZONING: No new applications. The flyer drafted for mailing (to inform the public of requirements and timing for building permit applications) was discussed, with one more element of information to be included: (Neumann) cost per square foot, and minimum cost for fences.
DANGEROUS DOGS: Information was inconclusive to determine if the officially requested relocation of a “dangerous” dog was accomplished, but observations reported leaned toward non-compliance.
CITY SWEEPER BID OPENING: One bid was submitted by T. J. Sutter, for $1,000. The bid was accepted (Motion: Reedy, second: Neumann, vote 4-0 affirmative) which not only accepted bid price but authorized Mayor and Clerk to prepare/sign necessary paperwork to effectuate the sale. Discussion turned to replacement sweeper options, as possibility of entering into an agreement to have City streets swept, or to pursue purchase of another unit. Review will continue, with determinations to be made at a later date to assure the service in the next season.
CLEAN-UP: Two properties were removed from the list due to resolution of issues. If contacted (as per previous agreement with spokesman for one property owner), Council member Reedy will still assist with the removal of infraction. One property remains on the list, and for that, a District Court date is scheduled for some time in October. City Attorney is to be asked to provide information regarding the placement of end-of-season mowing liens on properties, (List was provided at close of season), and also to clarify such-type lien advantages (Can City recover costs, including legal, from the person who purchases the property before new owner gets a clear title?) and disadvantages (Does someone from City have to be on hand at the sale of property to assure payment of lien? (and) Do risk factors of non-payment of the lien support a “mow it and forget it” philosophy?

CABIN - GUTTERS (ANY NEW INFORMATION, AS SCHEDULING): Motion, second, vote (Reedy, Mewes, 4-0 affirmative) to approve/accept Pickrell Lumber bid of $530.00 for materials and installation of new gutter materials on both north and south side of cabin.
CITY SWEEPER (JUNK/BID-LETTING) - (RESOLUTION # -2016-9) It was noted that an offer has been made to Employee Pike. Motion, second, (Reedy, Carmichael) was followed by reading of resolution, and then a 4-0 affirmative vote to approve/accept Resolution # 2016-9. (Bid deadline: Tuesday, Oct. 4, 2016 - 7:30 PM. Bid opening: Tuesday, Oct. 4, 2016 Regular meeting. As so stated in the resolution, the City reserves the right to reject any and all bids.
PLANNING AND ZONING: Motion, second, vote (Reedy, Carmichael ,4-0 affirmative) to approve Application for Building Permit for Gary Trump’s fence, which was approved by the P & Z Commission at the 9/19/16 meeting. Applicant will be notified of approval and fee. Planning & Zoning member Connie Mewes suggested a mailing to citizens, covering primary information about situational needs and effective submission timing for building application permits. A draft of primary issues will be prepared and provided to members of the P&Z for their input prior to mailing to citizens.
PAVING ACROSS FROM CHURCH (ROLAND HARDIN): Roland Hardin asked members if they were still considering hard surfacing across the street (parking area) from the church. Questions arose regarding previous discussion of the matter (Excerpt 4/19/16 meeting minutes: ASPHALT PROJECT (CHURCH) (South Side - Approx. $3,000 per Gilmore - 1497 sq. ft.) REQUEST FOR CONSIDERATION FOR CITY TO PAY HALF?: Since this project is planned “outside grant activity,” decision will be delayed pending ultimate grant cost-factor outcome (availability of funds). Mayor Meyer will seek clarification through discussion with Employee Pike as to impetus for previous calculations and the recorded payment option. Hardin also suggested sidewalk replacement at the park. He described “fall-hazard” areas. Members will evaluate the situation.

2016-2017 BUDGET HEARING:

Call for comments and questions, summarization by Brian Blobaum -- (some/all) of the Budget Notes (herein included) :
2016-2017 Budget Notes: The City appears to be continuing to produce revenues in excess of regular operating expenditures. The General All-Purpose Fund is producing roughly $37,000 per year (nearly the same as last year), and the Keno Fund is producing roughly $50,000 per year (decreased from previous). These funds produced are held in reserve available for capital outlays (paving, new equipment, water lines, etc.)... It is estimated that as of October 1, 2016, you will have cash reserves of about $285,000 General and $370,000 Keno. This compares to the prior year amounts of $220,000 General and $395,000 Keno... For the year 2016-2017, proposed budget property tax has been left at the levy limit of 45 cents, which increases the tax request from $28,801 to $29,087. This increase (of approx. .99%) is due to higher total assessed valuation for the City from $6,400,281 to $6,463,841.... In this increased valuation, $51.610 (approx. .81%) of increase is attributable to new growth… Other operating revenues have been estimated conservatively at $215,000 based on the prior year amounts for the general funds. CDBG grant income of $589,500 has also been included. $600,000 has been included in other operating revenues based upon prior years’ estimated Keno game gross proceeds... $1,307,500 has been budgeted as potential capital outlay in the General All-Purpose Fund (this includes $589,500 for the CDBG street project) and no capital outlay has been budgeted in the Keno Fund beyond your normal operating expenditures. However, $459,000 has been budgeted to be transferred from the Keno Fund to the General All-Purpose Fund to assist in financing potential capital outlay projects. Normal operating expenditures have been budgeted liberally at $266,000 for the General All-Purpose Fund and $510,000 (includes game winner payoffs) for the Keno Fund at 85% payout... The budget process and document perform two legal functions: 1. Sets the property tax request-budgeted at $29,087. 2. Establishes an overall expenditure limit-budgeted at $2,542,500.... The budget must be adopted by September 20. The property tax requested in the budget will be final; however, the expenditure limit may be amended, if needed, throughout the year...The expenditure limit included in the proposed budget allows for expenditure of nearly all cash reserves which are expected to be available. Since some cash reserves will be necessary, we don’t expect, nor do we recommend, that the full amount budgeted of $2,542,500 be spent. GENERAL BUDGETING NOTES: The lid law is assigned to limit the growth of non-utility government revenues to inflationary increases. Exceptions are allowed for revenues required to pay off bonded debt, real estate improvement capital outlays, and interlocal agreements... Due to the Lid Law restrictions, it continues to be advantageous to pay real estate capital outlays, pay off of bonded debt, and participate in interlocal agreements from funds where property tax, sales tax, and state pass-through revenues are deposited (i.e. General and Street). This will help keep this law from limiting your non-utility source revenues...The lid law has become a significant factor for future budgets. Although you have adequate unused budget authority at this time, this is a factor that should be monitored.

DANGEROUS DOGS: Acknowledgement of letter sent by Carothers requesting relocation (by Wednesday, September 14, 2016) of dangerous dog to outside corporate limits of Blue Springs, based on Ordinance # 448, 6-120, and official decision of members as made at the August 16, 2016 Council Meeting and recorded in the minutes. Matt Mittan reported an unrelated incident involving a dog he described as “dangerous.” Information about the incident that was reported to law enforcement will be provided to the City Attorney, who is being asked to review the situation and initiate contact with Gage County Sheriff to discuss/determine options for legal action.
WYMORE PUBLIC LIBRARY: DONATION (JANET ROBERTS): (Last Donation: $750): Roberts addressed members, advising that Blue Springs funds from previous donations have been used to purchase large-print books (Historical Non-Fiction series, or Fiction books. A $750 donation was approved by motion, second, vote (Mewes, Carmichael, 4-0 affirmative).
GOLF CARTS (MEWES): Mewes told members he would like to see an ordinance passed to allow Golf Cart travel (by licensed drivers, over 16, insurance, flags) on City streets. Several individuals in town have the carts, and Mewes described the vehicles as, “safer than 4-wheelers, or the handicapped scooters seen around.” A motion, second, vote (Reedy, Neumann, 4-0 affirmative) approved requesting Attorney Carothers to draw up an ordinance allowing golf cart travel in the municipality, and which Mayor and Council might discuss/approve at the next/ and/or subsequent regular meetings.
CABIN (GUTTER) - MORRIS: A materials list (Morris - fr/Wymore Lumber) was reviewed. Reedy calculated the expenditure for putting gutters on the cabin to be $247.03 - both sides, less if only one side is done. The materials would be “rounded, old-fashioned - as used in the 20s. Volunteers are available to install gutters.” Approval to forward the project (both sides) was reached by motion, second, vote (Neumann, Mewes, 4-0 affirmative).

2016-2017 Budget Notes: The City appears to be continuing to produce revenues in excess of regular operating expenditures. The General All-Purpose Fund is producing roughly $37,000 per year (nearly the same as last year), and the Keno Fund is producing roughly $50,000 per year (decreased from previous). These funds produced are held in reserve available for capital outlays (paving, new equipment, water lines, etc.)... It is estimated that as of October 1, 2016, you will have cash reserves of about $285,000 General and $370,000 Keno. This compares to the prior year amounts of $220,000 General and $395,000 Keno... For the year 2016-2017, proposed budget property tax has been left at the levy limit of 45 cents, which increases the tax request from $28,801 to $29,087. This increase (of approx. .99%) is due to higher total assessed valuation for the City from $6,400,281 to $6,463,841.... In this increased valuation, $51.610 (approx. .81%) of increase is attributable to new growth… Other operating revenues have been estimated conservatively at $215,000 based on the prior year amounts for the general funds. CDBG grant income of $589,500 has also been included. $600,000 has been included in other operating revenues based upon prior years’ estimated Keno game gross proceeds... $1,307,500 has been budgeted as potential capital outlay in the General All-Purpose Fund (this includes $589,500 for the CDBG street project) and no capital outlay has been budgeted in the Keno Fund beyond your normal operating expenditures. However, $459,000 has been budgeted to be transferred from the Keno Fund to the General All-Purpose Fund to assist in financing potential capital outlay projects. Normal operating expenditures have been budgeted liberally at $266,000 for the General All-Purpose Fund and $510,000 (includes game winner payoffs) for the Keno Fund at 85% payout... The budget process and document perform two legal functions: 1. Sets the property tax request-budgeted at $29,087. 2. Establishes an overall expenditure limit-budgeted at $2,542,500.... The budget must be adopted by September 20. The property tax requested in the budget will be final; however, the expenditure limit may be amended, if needed, throughout the year...The expenditure limit included in the proposed budget allows for expenditure of nearly all cash reserves which are expected to be available. Since some cash reserves will be necessary, we don’t expect, nor do we recommend, that the full amount budgeted of $2,542,500 be spent. GENERAL BUDGETING NOTES: The lid law is assigned to limit the growth of non-utility government revenues to inflationary increases. Exceptions are allowed for revenues required to pay off bonded debt, real estate improvement capital outlays, and interlocal agreements... Due to the Lid Law restrictions, it continues to be advantageous to pay real estate capital outlays, pay off of bonded debt, and participate in interlocal agreements from funds where property tax, sales tax, and state pass-through revenues are deposited (i.e. General and Street). This will help keep this law from limiting your non-utility source revenues...The lid law has become a significant factor for future budgets. Although you have adequate unused budget authority at this time, this is a factor that should be monitored.

HAZARD MITIGATION AGREEMENT/RESOLUTION 2016-7 (JEFF HENSON (corrected to Tim Stutzman) : Tim Stutzman gave the presentation, focusing on Blue Springs needs. Information included: Procedure is done every 6 years to allow City to request grant funding for applicable issues (NEMA - disaster declarations: storms, lightning, wind, hail, drought, winter storm, hazardous spills, with considerations also based on age-related risks of general population. Critical structures were identified - city hall, fire department, lift station. A copy of the complete Hazard Mitigation manual is available at the City office for public review. INTENDED RELOCATION OF DANGEROUS DOG TO BLUE SPRINGS: Acknowledgment of receipt of information packet from Attorney Carothers and distribution of same information to members. Discussion, followed by motion, second, vote (Mewes, Neumann, 4-0 affirmative) to DISALLOW relocation. of the previously established DANGEROUS DOG into the City of Blue Springs., which as Mewes stated, “is only a couple blocks from the school). It was noted by members that relocation has transpired without benefit of jurisdictional consent. Carothers will address the issue in accordance with acceptable procedure to have the animal removed from the Municipality.
CAT 416 F BACKHOW LOADER SPECS: Receipt of specs was acknowledged, and the materials will be kept with other bids for future review (most likely at the completion of the paving project).
CLEAN-UP: Council member Reedy will continue to work with one property owner to achieve desired results. One property was removed due to resolution of issue. Review of general clean-up issues continue on another property. Two properties were acknowledged as “works in progress.” Council member Reedy will cut tall weeds on another property “described as hillside,” and as circumstances permit, try to generate removal of a junked/inoperable/unlicensed vehicle from in front of the property on Broad Street. That same property is currently under arrangements of sheriff’s sale (Collection Associates), and it will be kept under review. Court date has been determined as October 18th for another pending legal issue.

Council member Neumann stated that “all is well for the tractor show.”
PLANNING AND ZONING: Motion, second, vote (Mewes, Neumann, 4-0 affirmative to approve Building Permit Application for Art Linsenmeyer (pole building) - and which was previously approved by the Planning and Zoning Commission. Applicant will be notified of approval and fee.

HAZARD MITIGATION AGREEMENT/RESOLUTION 2016-7 (JEFF HENSON (corrected to Tim Stutzman) : Tim Stutzman gave the presentation, focusing on Blue Springs needs. Information included: Procedure is done every 6 years to allow City to request grant funding for applicable issues (NEMA - disaster declarations: storms, lightning, wind, hail, drought, winter storm, hazardous spills, with considerations also based on age-related risks of general population. Critical structures were identified - city hall, fire department, lift station. A copy of the complete Hazard Mitigation manual is available at the City office for public review. He asked if members had any reservations or if there were any zoning considerations prohibitive to opening a tobacco shop. No negative response was given, with members in agreement that a new business would be “a good thing.”

Jan Morris suggested that Blue Springs pursue grant available to municipalities for next year’s festivities (150) , and she will work with Council member Reedy for timely initiation of that process, to “make next year’s celebration bigger and better than ever.”
COST COMPARISON/EQUIPMENT TRIAL - BACKHOE: Mike Petersen provided information for a 580 NEP - Cooperative Purchasing venture ($78,500 - no financing available as in his previous quotation of equipment and no trade in option, but the City would need to join. Future purchase of other municipal equipment/office machines a possibility. (Petersen left paperwork for application to the cooperative, and website information.) Equipment (2017) delivery would be possibly October or the first part of November. Other information: 4WD, 84” wheelbase, but cab roomier, and tinwork larger. Purchase of quick attachments varied and optional. Air conditioning, auto ride, radio, cold weather start, 19.5 tires, extend hoe, 2-phase warranty. Tier 4 final unit - meets standards. Comparison was made to information provided by Council member Carmichael (fr/Hiawatha - 2014 - new unit at $73,500). Employee Pike indicated that the City’s current unit is “still a good machine,” but problems could arise due to the age of the machine. Review will continue.

CABIN GUTTER QUOTATION: BLUE VALLEY DOOR COMPANY: Jan Morris noted that 90 individuals have visited the cabin this year, with 23 attending on July 4th. She described three options for cabin gutter installation: 1. Blue Valley Door quotation - North side gutter work only - $247. Both sides - $475.25. Some work would need to be done (carpentry) in preparation for the professional work. 2. A Chicago company has available 5” half - round guttering. 3. Patty Novotny has half-round guttering which could be taken from a property of hers. The downspout could be taken also , but a replacement would be necessary. Paint would need to be removed from the guttering, and end caps would need to be found. Council member Neumann stated that the Blue Valley Door option might be the quickest and simplest solution. Morris indicated that Wymore Lumber has some guttering. Council member Reedy will find out what is available at Wymore Lumber.
TIRE AMNESTY: JANICE COHORST: Janice Cohorst (with supporting comments from Kirby Cohorst and Lori Novotny) addressed members. She indicated that arrangements (call ahead with particulars) are in place for the Blue Springs/Wymore area tires to be accepted at the amnesty site. Summary of needs: Need help loading tires. Have two trucks in line, but need at least two more for hauling. Need to set dates for Blue Springs, dates for Wymore. Discussion resulted in agreement by City members for the City to copy and mail out the Blue Springs flyers in a timely fashion once all information is resolved and the original flyer is provided.

Mayor Meyer asked Employee Pike to take care of that.
