The Regular Meeting of Mayor and Council was held on June 16, 2020, in the Blue Springs City Hall, Blue Springs, NE.

At 7:00 PM, Mayor Meyer called the Regular meeting to order and roll call was taken.

DEMOLITION PROJECT (ANY NEW INFORMATION): No new information.

MANDATORY GARBAGE STIPULATIONS /ORDINANCE # 462: All members contributed to discussion which included basic price categories, as 96-Gallon Temps receptacle - $20.00; 65-Gallon Temps receptacle - $18.00; up to 35-Gallon receptacle (owned by property occupant - with lid and handles) - $14.00. Determination needs to be made (contact with Shelby Temps as to the pricing of commercial accounts) as charges for various size/quantity of disposal units (dumpsters). Further determination was made to establish mandatory garbage for each and every water/sewer customers on line, with exception to be made for garden meters and structural properties that, though they have water/sewer/electrical service, are not occupied. It was also noted that an on-line utility commercial customer may utilize one of the residential-size Temps containers at the residential price if their refuse does not exceed capacity size of that specific size Temps container. Carothers recommended that the City would not take collection-responsibility for any past due bills Temps may have at the time of transition, but that the City would begin collection responsibility on August 1st, with charges that would post for August and be mailed to customers on September 1st. Attorney Carothers will draft a narrative to be used by the City Clerk to send to citizens delineating the terms and conditions of the mandatory garbage program.

CAMPING STIPULATIONS: All members contributed to discussion, and Carothers posed questions to facilitate developing language for determinations regarding campers (all types) at Feit’s Memorial Park (the City Park not included), as: length of stay - 7 days, drop box (arrival date) for camper information follow-up, etc., and will make initial information available for further debate at the next Regular meeting (July 7).

UNSAFE STRUCTURE - BROAD STREET (DEVELOPMENTS/RESULTS): The building is down, with much local interest in obtaining materials from the site to be used for various outdoor projects. Such interest should not be directed to the City, but to the property owner - Dale Carpenter. It is the intent of Mayor and Council to continue to review property improvement status to assure timely removal of any remaining debris and the dirt-fill process that would result in a “buildable” lot.

ANNUAL CITY CELEBRATION (CAR SHOW/TRACTOR SHOW): It is not possible to ascertain definite timeline for further reduction or renewed application of restrictions due to Covid-19. It is possible that a City celebration can be held, with “advisory signs” (Carothers) posted.

PLANNING AND ZONING: No new applications.

KENO LOUNGE (ALLEY OPENING): Becca Lillibridge (Lucky Bridge Lounge) requested members to consider allowing use of the alley behind the Lounge and extending to Walnut Street (for business delivery traffic). It was noted that the drainage tube was previously removed, and that matter may need to be re-addressed. Lillibridge told members that a neighbor adjacent to the Lounge property has arranged for a surveyor (Witkowski - Beatrice) to address another issue on June 17th, and Attorney Carothers (as per agreement of Mayor and Council) will contact Witkowski tomorrow morning to request him to (while on site) determine the exact position of the alley (set stakes - in support of further evaluation and decision on the matter of allowing the flow of delivery traffic).

OTHER:
1. Documentation provided by Jan Morris encapsulated stages/results of the Cabin Restoration Program supported by Thomas Foundation and Nebraska Tourism grant funds, as well as by personal revenue and labor of volunteer(s), and it further included Ms. Morris’ personal view of the endeavor and her hopes for future protection of the historical significance/value of the cabin . (A copy of this information is attached to the office copy of the minutes.)

DEMOLITION PROJECT (ANY NEW INFORMATION): Attorney Carothers advised members that The Margaret and Martha Thomas Foundation grant application for $15,000 was successful, and he presented a check to the City in that amount. The project will begin necessary procedures on targeted structures. On an separate demolition issue, Reedy agreed to speak to Bruce Dunn about removal of a trailer.

MANDATORY GARBAGE STIPULATIONS (INPUT FROM SHELBY TEMPS): Shelby Temps and members discussed options, with general consensus to initiate a “simple-as possible” program…. with three potential options: 96 Gallon Temps container - $20.00; 65 Gallon Temps container - $18,00; customer provided up to 35 Gallon container with lid and handles - $14.00. All active water accounts (except for garden meters) would be charged. Attorney Carothers will draft an ordinance for 6/16 review by council.

CAMPING STIPULATIONS: Carothers provided members with a draft of potential issues to address, and members were asked to review the particulars and be prepared to provide input at the next regular meeting.

UNSAFE STRUCTURE - BROAD STREET (DEVELOPMENTS): Employee Pike told members that the property owner (Dale Carpenter) is willing and appreciative of any help the City can give him on the project. Employee Pike advised that considerations for “brick salvation, as per Ecco store in Lincoln, might be an issue for future consideration, but that now getting the building down is the primary concern. He said the City could “hook onto and remove the vehicle” and use the backhoe to push everything into a pile. Council member Reedy stated concern for employee safety and Workers Compensation concerns, but Pike expressed that utmost precautions would be taken, and Mayor Meyer gave the go-ahead for the project.

THOMAS FOUNDATION GRANT APPLICATION FOR DILAPIDATED BUILDING DEMOLITION PROJECT, AND MAY INCLUDE BUILDING INSPECTIONS, ASBESTOS TESTING, ETC.: Attorney Carothers identified proposal particulars: as, $15,000 grant funds/ $15,000 City for 4 demolitions with all necessary aspects, as asbestos testing and remediation, etc., but if asbestos is not noted and remediation not required, funds may be available for a 5th demolition (another house?/trailer?). A copy of the Grant Application Form (with identified properties) was provided for the file, and Mayor Meyer signed the Margaret & Martha Thomas Foundation Grant Application Form.

MANDATORY GARBAGE - STIPULATIONS: Attorney Carothers provided a draft of an Ordinance previously under consideration, which included definitions, mandatory service, service rates, and offenses. These will fall under review once more, with updating as proves necessary. Shelby Temps of Temps Disposal Service will be provided with a copy of this document to assist him with his needs assessment, and he will be invited to attend the next Regular meeting (June 2nd, 2020) to support determination of conditions for mandatory garbage service.

CAMPING STIPULATIONS: Council member Reedy made suggestions. As: Campers should “check-in” (City Clerk/Street Supt.) and “check-out.” Time span for stay might be “7-14 days.” Regulations should be determined for “no open fires.” Attorney Carothers will provide a draft of particulars for consideration of Mayor and Council.

UNSAFE STRUCTURE - BROAD STREET: Employee Pike reported that the owner (Dale Carpenter) has been notified, and is concerned and fully intends to address the issue as soon as possible. In the interim, after discussion of variable regulatory action, such as fencing off the area with roll out plastic netting (Reedy), and Carothers indication that he would look at the situation after leaving the meeting, Mayor Meyer asked that Pike close the alley and the street (north).


Other:

1. Carmichael asked if it was known when Pavers would be in town (for Walnut Street Project), and Pike reported that they anticipate June arrival.
2. Carmichael and Neumann noted the need for armor coating.
3. Carmichael and Mewes reported “holes” near the bridge, and determination was made to determine (contact Gilmore about lane miles) if the problem area is City or County responsibility.
4. Reedy asked that Pavers be asked (by Pike) to make a bid on “overlay” on Broad from ‘A” to the Fire Dept, and after the work done already by the Fire Department, the remaining stretch to the bridge.
5. Mayor Meyer reminded members that it would not be possible financially to complete the Walnut Street Project, do the necessary armor coating (with Neumann stressing the importance of that), and then overlay the identified sections of Broad Street, BUT no objections were raised to the estimation of costs for the other aspects of road repair.
6. Mewes described the need for sidewalk repair/replacement (in front of City Hall), and repair will be addressed.

APPROVAL OF BUILDING PERMIT APPLICATIONS: Mayor Meyer indicated that he did not want to “step on the toes” of the Planning and Zoning Commission that reviewed the project applications but did not come back with a firm ‘approval’ or ‘disapproval,’ Following discussion by members: Motion (Mewes), second (Carmichael), followed by 3-0 affirmative vote to approve building permit applications: Janelle/Steve Hurley (#20-2 for fence), and Robert Bradley (#20-1 for building). Applicants will be notified of approval and fees.

GRANT APPLICATION: HOUSE DEMOLITION (CAROTHERS):City Attorney Carothers was available by speaker phone. Issues addressed and supported by agreement of Mayor and Council were: 1. City agreement for (4-structure) participation ($15,000 indicated as City input) in a Thomas Foundation Grant (Wymore & Blue Springs) for another project of demolition of dilapidated buildings. Carothers will have application prepared for approval at next Regular meeting. 2. Carothers will contact Rob and Chet (building inspectors), (had not done so to date due to impact of Covid-19 restrictions/suggestions) and will make provisions for the issuance of an inspection warrant for properties selected for upcoming demolition project.

OTHER: 1. Carothers will continue effort with an individual in reference to assisting with the execution of an quick claim deed, with end result anticipated to be City acquisition of the property. It was noted that the individual is back living on the premises (per Reedy). It was reported by Carothers (in response to Reedy inquiry), that a previous City acquisition with unresolved issue to taxes/ownership listing has been resolved (through contact with Assessor and Treasurer) , and resulting also in a desirable (noted by Mewes) reduction in yearly taxes. 2. It was noted that there is a full-time camper (tent) in Feit Memorial Park, and complaints have been made. In absence of City restrictions about camping, Carothers will request Gustafson to send an officer to “visit with the camper” to establish intent, and suggested “that type of contact may well encourage the camper to move on.” 3. It was also noted that a request (by Dean Cole) has been made that the tennis court be power- spray cleaned, and also that the table in Feit Park be painted - “hopefully within the next two weeks.” 4. Employee Pike indicated that the “auger is fixed,” and also, when asked by Mayor Meyer, that all other equipment is in working order.

The Regular Meeting of Mayor and Council was held on March 17, 2020, in the Blue Springs City Hall, Blue Springs, NE.

PRESENT: Mayor Meyer, Council members Carmichael, Mewes, Neumann, Reedy

ABSENT:

OTHER ATTENDEES: Employee Mike Pike, Connie Mewes, John Hill

Notice of the meeting/hearing was given in advance by posting in at least three public places as shown by the certificate of posting placed on file. Notice of the hearing/meeting was simultaneously given to the Mayor and all members of the City Council and a copy of their acknowledgment of receipt and agenda are placed on file. Availability of the agenda was communicated in the advance notice and in the advance notice to the Mayor and City Council of the hearing/meeting. Proceedings hereafter shown were taken while the convened hearing/meeting was open to public attendance.

At 7:00 PM, Mayor Meyer called the Regular meeting to order and roll call was taken.

Motion (Mewes) , second (Carmichael) and vote (4-0 affirmative) to approve as sent minutes for the March 3, 2020 Regular meeting.

After review -- motion (Neumann), second (Carmichael ), and vote (4-0 affirmative) to approve claims per: Bank Direct - NE Dept. of Revenue (10) - $251.03; Payroll $2,222.40; Arbor Ink - $186.76; Beatrice Iron & Metal - $41.66; Black Hills Energy - $46.69; Constellation Energy - $70.21; Lauby Plumbing/Heating/Air - $41.05; One-Call Concepts - 2.30; Postmaster - $256.00; Security First Bank - (Pike/IRA) - $55.00; Temps Disposal (Demolition Project) - $1,850.00; Wex Bank/Shell - $112.36; Wymore Arbor State - $144.28; Wymore Oil Company - $288.26; TOTAL CLAIMS: $5,568.00.

BRIDGE - JOHN HILL: John Hill provided preliminary information about CBMP eligibility (Urban Local Roadway classification, ADT: 300 Roadway paved. Existing Structure is a 2 span 39’ steel girder bridge with 18 ft (deck to flow line). Not within a ZONE A. Preliminary estimate could be a single 12’ (wide) x 8’ (rise) concrete box culvert. Following discussion, a motion was made by Council member Reedy, seconded by Mewes, and approved in a 4-0 affirmative vote for the County Engineer (rather than City engineer, based on wide experience with bridge needs assessments) for estimated cost for changes. Within a Bridge Match opportunity, State 55% of cost, City 45% of cost or City $45,000 of estimated $100,000. Bridge Match program would be presented in fall and a next year potential project.

GENERAL CLEAN-UP, INCLUDING: BUILDING INSPECTION ISSUES, ASBESTOS TESTING: No new information.

CABIN PRESERVATION ISSUES: Estimates are under review. Concrete work still being pursued.

FEIT PARK (SEWER HOOK-UP, RELATED ASPECTS); CITY PARK (MULCH, OTHER): Plans on hold due to corona virus concerns.

PLANNING & ZONING: No new applications.

OTHER: Contact will be made with Andy Carothers regarding the initiation process/procedure/approval of a COVID-19 Pandemic Emergency Declaration for the City of Blue Springs.
