Review activated to determine possibility of “controlled burn” at part of demolition sites. Plans yet for Public Hearing. Carothers to talk to parties for negotiation, hopefully get in place for fall demolition program. Also Carothers to draft letter to address violation ---occupancy without water/sewer service.

OTHER:
Hughes thanked the City for cooperation with One Property at a Time’s June 3 Special Event (Fund Raiser, and to heighten the experience and awareness of Community Improvement), with Adams, and Borgman, as well as Mayor and Council complimenting efforts and results all round. Adams indicated that there might have been improvement possible by changing the order of events and improving on parking options, but all were pleased with general “show casing of the community” (with several VIPs in attendance), and the end results.

DEMOLITION PROJECT: Six houses included in the next round. Current activity: Need to knock hole in foundation of one property for asbestos abatement. Schlake may be requested to operate the trac machine for the upcoming demolition project. Attorney Carothers will prepare consent form for consent for asbestos inspection. Ron Cary was notified about the need for the removal of volunteer trees, but reported financial hardship for the demolition cost of two houses. He expressed desire to maintain ownership of the property after demolition. Arrangements will be made in support of that scenario.
PROPERTY ACQUISITION DRAFT AND ANTICIPATED SCHEDULING OF PUBLIC HEARING TO DECLARE INTENT TO PURCHASE: A signed agreement between parties is in place . A PUBLIC HEARING is scheduled for June 6th - 7PM - Blue Springs City Hall to address City acquisition of the Rainey property adjacent to the school. Further, review will be made of title insurance, 30-day notice for occupants in violation of contractual rent/purchase agreement, with eviction to be pursued as necessary.
CLEAN-UP: Another letter was sent to one property owner . District Court date schedule pending for another. Review will continue for another property. Adams asked if members were willing to now (since after Clean-up day) address inoperable/unlicensed/junked vehicles. Not only will the OPAT group (with consent of Mayor and Council) compile at their upcoming meeting a list of the 5 worst offenders. but Mayor Meyer suggested that members review the situation to assure a mutual focus on infractions. Adams identified a tall weed situation and discussion resulted in the request for a letter to property owners, but also identified it as a problematic situation created by a disputed divorce, legalities, and so the anticipated length of time before correction of infractions might be expected. In another issue, Mewes expressed disappointment regarding a personal interest property pictured in the blight study, which she was advised was part of a photographic record compiled by Hanna Keelan and not the City.
ZITO MIDWEST CONTRACT/ORDINANCE #473: Despite conflicting schedules which have prevented resolution of contractual differences of opinion, efforts will continue toward reaching mutual agreement.

FIRE DEPARTMENT NON-STANDARD USE OF WATER/EQUIPMENT (HALTERMAN): Halterman addressed members about an incident described as tanker used to fill a private swimming pool. Carothers said the council was a good starting point for her to state her case, a situation she described as undesirable due to drought condition and financial and public accountability questions, but she should take it to the Rural Fire Protection Board. Halterman thanked members for their time and the guidelines provided.

DEMOLITION PROJECT: Discussion focus (Carothers): 1. Thomas Foundation meeting on Friday to determine outcome of City’s demolition grant application. 2. OPAT house difficulty at one property - Furnace (asbestos issues) needs to be removed by breaking through foundation, possibly by City prior to availability of Trac machine (Schlake). Carothers suggested Bockman to Rex Adams (for asbestos abatement).
CLEAN-UP: Discussion focus (Carothers): 1. One property targeted for removal of pickup trailers and beds, silver car. Camper on property, blue trailer that looks to be in good shape and licensed not a current concern. Carothers to send follow-up letter. 2. One property looks in worse condition, with infractions including - car without windows, demolition pickup, multiple tires, pickup bed trailer with appliances. Carothers to arrange for District Court trial. 3. One property still has a mini landfill situation, and District Court scheduling will be initiated. In support of that action, Adams will be asked to look at property to more clearly identify other issues, one of which has been identified as a boat that is not on a trailer. 3. One property for which a temporary guardian is in place, and acquisition and speedy clean-up plans are underway, but resisted 4. One property is expected to be available for acquisition (Potential price: $5,500) either by OPAT, or more likely by the City. Confirmation of the sales opportunity will be sought, and a contract will be drafted prior to the next Regular meeting whereat City interest will likely be supported by the scheduling of a public hearing to publish intent of acquisition. If acquired, it is further anticipated that the property will be included in the Fall demolition project. It was noted that after the property is cleared it might be of interest to the school for a parking lot.
ZITO MIDWEST CONTRACT/ORDINANCE #473: No new information. Effort to achieve repeatedly attempted contact will continue by Carothers.
BLUE SPRINGS CITY PARK PROJECT 2023, INCLUDING PLANS, MATCH-FUND POSSIBILITIES/IN-KIND DETERMINATIONS, TIMELINES, ETC.: No new information.
BRIDGE/NORTH SIDE APPROACH (BY CITY PARK)/ESTIMATE: Pike indicated he could contact Gilmore to have them look over deteriorating aspects of the location, as: settling of sewer line, preventing optimal drainage and threatened further by settling of wing wall. General deterioration of the walls was noted. It was discussed (Sedlacek) that the County is to inspect the bridge in August. The Hosfelt Paving estimated for the irregular bridge approach (in the amount of $5,600) will not be activated at this time. Millings have been used (Pike) as a temporary solution. Mayor Meyer and Council members have requested Carothers to do a record search to attempt to determine ownership (County/or/City) of the bridge prior to any further corrective action being taken. Sedlacek will contact individuals who may have information helpful for determination of ownership.

BRIDGE/NORTH SIDE APPROACH (BY CITY PARK)/LOVELL ESTIMATE: Contact made with several service providers, but no conclusive information at this time.
KENO OPERATIONS: WHICH MAY INCLUDE RECOMMENDED PROCEDURES, ASSESSMENT OF LATE CHARGES, AND TIMELY REPORTING: Carothers has discussed circumstances with Steve Borgman. 1. Impact of time lapse between previous operation of Keno Lounge and new ownership. 2. Need to run more games to stimulate interest. 3. Need to run more complex games, a progressive game? 4. Idea to send Keno writers to other locations to observe operations.
LIFT STATION INSURANCE INCREASE: Contact to be made (Clerk) with insurance agent/company to request amount of premium that would be charged to raise coverage from 40T to 150T.
SECURITY CAMERAS (RECOMMENDED BY TIM HANSON: Discussion included what was described as “often unsatisfactory” outcome/end result at other locations where cameras were used when crime was committed, as well as equipment limitations in general. Determination was to “address the issue” (general security& burn site) “when /if security becomes a problem.”
WATER LINE (MEWES): Mewes requested consideration for line work due to habitual rust in water. The area was scheduled within the Water Main Project that has been put on hold due to annual close of the State funding program. As soon as possible (next week?) after the close of Clean-up Day activity, Pike will take necessary steps to “flush” the line and assess results/further needs.

The Regular meeting of Mayor and Council of Blue Springs, Nebraska, was held 7:00 PM, April 4, 2023, at the Blue Springs City Hall.
Mayor Meyer called the meeting to order, and roll call was taken.

PLANNING & ZONING - APPLICATION FOR BUILDING PERMITS (as submitted) : Building Permit 23-1 (Devin Dorn - fence, etc.) was discussed, and the following decision was made as a result of P & Z recommendations and review by Mayor and Council: Motion to approve (Riensche), Second (Neumann) 4-0 affirmative vote.
DEMOLITION PROJECT: Pending issues: (Carothers): 1. Upgrade to $40,00 Thomas Foundation Grant application, with necessary paperwork -- (expected to be approved at the next Thomas Foundation meeting), as related to potential demo cost assist of homes via Lottman demolition bid, and advisement that $10,000 was built into the application for asbestos remediation. 2. No word yet about removal of personal contents at one site 3. Need to get asbestos inspections in place.
CLEAN-UP: One property owner is working on cleanup following receipt of a letter allowing 30 days for resolution of problems. Letter sent outlining infractions, requesting resolution within 30 days, and encouraging participation in City Clean Up Day - April 19th. Carothers to draft two more clean-up letters.
ZITO MIDWEST CONTRACT/ORDINANCE #473: Zito onboard with most City-requested changes wanted. Carothers will work on getting “some language” back, and since the contract is for 25 years, to determine future plans so that the contract does not need to be “re-addressed in a couple years.”
BLUE SPRINGS CITY PARK PROJECT 2023, INCLUDING PLANS, MATCH-FUND POSSIBILITIES/IN-KIND DETERMINATIONS, TIMELINES, ETC.: Park rules have been included on the website. A portable toilet will be rented again this year (Feit Memorial Park), and will hopefully be in place by April 15th.
BRIDGE/NORTH SIDE APPROACH (BY CITY PARK): Schuller provided (email) information from Mark Kuhnke covering Statute 17-567 -(Highways, streets, bridges; maintenance and control), articles 1,2,3,4; 2 - Liability for neglect of duty; 3 - Regulation; 4- Miscellaneous (a copy of which is attached to the office copy of the minutes and available for public review upon request)…. And the following determination was made after it was brought up that the bridge would be inspected later this summer. Pike will contact Lovell Asphalt to determine corrective cost-only at this time.
WYMORE-BLUE SPRINGS SHARED BURN SITE: Burn site is open for public use. Leaves, grass may be taken to 1st and G in Wymore until further notice.
KENO OPERATIONS: WHICH MAY INCLUDE RECOMMENDED PROCEDURES, ASSESSMENT OF LATE CHARGES, AND TIMELY REPORTING: Carothers continues with plans to contact and discuss.
ANNUAL INSURANCE PACKAGE: Insurance personnel (Joy)- provided an overview of coverage, and called for comments, desired changes, additions, deletions: The following was determined: Members will evaluate coverage of lift station in reference to raising value ($40,000 coverage to 80 or 90).

PLANNING & ZONING - APPLICATION FOR BUILDING PERMITS (as submitted): No new applications.
DEMOLITION PROJECT: Pending actions/concerns: Two houses pending scheduling for inspection (asbestos). (South of Blue River Pallets). House on West I Street needs consent for asbestos testing and schedule for removal of personal goods. One structure purchased by OPAT. One property may be purchased after guardianship procedures completed/Court approval. Carothers focused on having as many properties as possible within the demolition project in position for asbestos testing on same timeline. Mayor Meyer asked Pike for an update on one property, and Pike reported that the materials, including foundation have been removed and it is ready for “dirt fill”, and Adams indicated that OPAT should be forwarded the bill for the dirt needed at that location.
CLEAN-UP: Pending concerns/actions: Letter sent regarding household waste, landfill-like situation, and 30 days were given for resolution, or the matter would be addressed in District Court. Carothers drafted a letter to be sent giving 30 days for removal of household waste and identification/removal of inoperable/unlicensed vehicle(s), and if not resolved the matter would be addressed in District Court. Two properties were discussed in regard to legal actions underway. Hagerman indicated that the nuisance situation that exists and continues growing at one property could be building into a safety issue (near school) where children are often seen walking/riding bikes on the grass) and he suggested “sidewalks.”
ZITO MIDWEST CONTRACT/ORDINANCE #473: No input yet from Zito.
BLUE SPRINGS CITY PARK PROJECT 2023, INCLUDING PLANS, MATCH-FUND POSSIBILITIES/IN-KIND DETERMINATIONS, TIMELINES, ETC.: Cole reminded members that time is running out for the identification of needs determined for the City Park and Feit Park, and he asked for plans to be identified by members in order for him to orchestrate grant applications to incorporate in-kind funds/match funds ($2,000) inclusion outside of direct City responsibility. Discussion resulted in the identification of focus: mulch for the City Park, trash receptacles/ possibly benches for the City Park, benches/safety rail for Feit Park. Although a toilet for Feit Park was discussed, determination was made, following suggestion by Cole that it be moved ahead to a future grant application. Reedy asked that particulars from Ordinance #469 be added to the information about parks on the website, as length of stay, charges, and Jan Morris will be asked to add that information on a “noticeable” place on the website. Cole reported that April-May has been identified to be the timeline for the tree survey previously discussed. Sedlacek asked that contact be made with the City insurance carrier to determine the coverage/potential assessment/compensation for hail damages to the “barrel of fun” house at the City Park .
BRIDGE/NORTH SIDE APPROACH (BY CITY PARK): No information yet regarding meeting attendance/or information from Don Schuller. Speed bumps were briefly discussed which would call for drafting an Ordinance.
WYMORE-BLUE SPRINGS SHARED BURN SITE: Sedlacek reported that the fence is up, the road halfway built, a sign is to be made, and by the end of the week the site should be useable, but no definite information was released about when the public would be released to use the site.
CABIN EAVES (Gene Reedy): Reedy provided an overview of cabin history, and addressed the matter of “removal of eaves” since relocation has removed their practicality, and it is historically in error to have eaves on an 1857 cabin. No objections were raised to prevent removal of the eaves.
51C DELINQUENT FEES - 2 QUARTERS: Since documentation sufficient for the City to submit timely 51C reports to Charitable gaming was not provided by the Lounge, the delinquent fees are to be billed to the Keno Lounge. Carothers is to enter into conversation with Borgman about this, and related Keno concerns, and further discussion will be an agenda topic at the next Regular meeting.
