The PUBLIC HEARING for Zoning Ordinance # 456, and the Regular Meeting of Mayor and Council was held on May 16, 2017, in the Blue Springs City Hall, Blue Springs, NE.


PRESENT: Mayor Meyer, Council members Carmichael, Mewes, Neumann, Reedy

OTHER ATTENDEES: SENDD Executive Director Tom Bliss, Planning & Zoning Commission member Connie Mewes; Employee Milton Pike, City Attorney Andy Carothers, Shelby Temps, Ronda Mewes (and minor child); Rex Adams, Chelsea Chab, Tim Brown, Hope Brown, Lance Spencer


Notice of the meeting/hearing was given in advance by posting in at least three public places as shown by the certificate of posting placed on file. Notice of the hearing/meeting was simultaneously given to the Mayor and all members of the City Council and a copy of their acknowledgment of receipt and agenda are placed on file. Availability of the agenda was communicated in the advance notice and in the advance notice to the Mayor and City Council of the hearing/meeting. Proceedings hereafter shown were taken while the convened hearings/meeting was open to public attendance.


At 7:30 PM, Mayor Meyer called the Regular meeting to order and roll call was taken.


Motion, second and vote (Mewes, Carmichael, 4-0 affirmative) to approve as sent minutes for the May 3, 2017 Regular meeting.


After review -- motion, second, and vote (Neumann, Carmichael, 4-0 affirmative) to approve claims as follow: Bank Direct - NE Dept. of Revenue (10) - $284.81; Salaries $ 1,960.29; Black Hills Energy - $25.01; Constellation Energy - $36.59; Nationwide Insurance - (Clerk Bond) - $100.00; One-Call Concepts - $4.53; Milton Pike (Postage Reimb. - Water Samples) - $46.70; Postmaster - $166.00; Katherine Roche (Postage Reimb - Cert Letter) - $6.59; Security First Bank (IRA/Pike) - $55.00; Temps Disposal (Clean-up Day Roll-offs) - $356.37; Windstream - $71.60; Wymore Lumber - $23.23; TOTAL CLAIMS: $3,136.72.


7:30 PM - PUBLIC HEARING: ZONING ORDINANCE # 456- -- Hearing called to order (7:45 PM (after address of certain regular agenda topics) - Motion - (Neumann), second - (Carmichael), vote 4-0 affirmative) to open hearing. )


Attorney Carothers conveyed Planning & Zoning Commission statement of recommendation to Council to approve Ordinance # 456. Following discussion, motion (Mewes), second (Neumann) and 4-0 affirmative vote to close Public Hearing and return to Regular session.


ZONING ORDINANCE #456 - Rule of three readings suspended by (Motion -Carmichael, second - Mewes, 4-0 affirmative vote). Attorney Carothers read Ordinance # 456. Motion to approve Ordinance # 456 by Mewes, second by Neumann, followed by 4-0 affirmative vote. Per Employee Pike, contact will be made, as specific to support timeline of a “Special“ permit application to address potential upcoming issues.


PLANNING AND ZONING, WHICH MAY INCLUDE NEW MEMBERSHIP: Becky Reedy was offered as a potential member of the Commission, and no objections were stated. Mayor Meyer designated Becky Reedy a new member.


TOM BLISS (EXECUTIVE DIRECTOR - SENDD): Introduction only: Tom Bliss introduced himself to Mayor and Council. His message was one of continuing good will and cooperation for Blue Springs participation in SENDD services. He took with him the second signed Request for CDBG Project Funds for Activities -- DD # 12 - $71,860.10, and the gratitude of Mayor and Council.


RYAN WIESE (INSURANCE PACKAGE - ALTERNATE COVERAGE OPTION): Cancelled due to weather. Will be carried forward on agenda.


EQUIPMENT: WHICH MAY INCLUDE, GENERAL REVIEW OF OPERATIONS, OUTSIDE SERVICES/
PURCHASE As might include - SWEEPER, BACKHOE, ETC: Focus was primarily on the sweeper purchase option presented by Council member Carmichael. - (Particulars: Used 1996 Elgin Pelican - Serial # P-1932-S; 3 Wheel; Front Dump - 3.5 yd, High Dump; Gutter Brooms - 1; No Lube System; No High Pressure Water Wand; No Catch Basin Cleaner) Sale Price - $7,150, delivered priced $8,500.00 -- Supplier: Wm. Nobbe & Co - 9 Sainte Genevieve, Missouri 63670, Phone (573) - 883-5703). Carmichael conveyed the following extra information: Unit has 12,000 miles on it. Was purchased new and used in a 5,000 population city, that traded it in for another new unit. Was fully serviced to function as rental equipment, with some new parts (as brooms) and all parts in working order. The possibility of requesting sales warranty agreement - 90 days- was discussed, but not required since it would be a “dealer sale, not from an auction.” Also, warranty insurance was discussed, but not determined. Motion to purchase the sweeper was made by Council member Mewes, seconded by Neumann, and approved within a 4-0 affirmative vote. Since up-front total payment is required by the vendor for the $8,500 delivered price, wire service arrangements will be made.


PARK SIDEWALK/MEASUREMENTS-DRAWINGS TO SUPPORT LOCAL CONTRACTOR-PRICING: No drawings are yet available, but Council member Reedy and Employee Pike will meet to take measurements to facilitate the project. Also, all members were in agreement for the City to remove the tree that is damaging sidewalk and curbing, and Council member Mewes asked for attention to another tree nearby that he described as posing traffic visibility issues at an intersection. It was also noted (Meyer) to contact Bob Allen regarding planting “smaller trees” at a later date.


MANDATORY TRASH PICKUP; TEMPS PROPOSAL (Shelby): Shelby Temps gave the presentation: City could bill customers for the service on Water/Sewer bill. $1.00 each account (96 gallon & 65 gallon pick-ups only, not any reduced - as senior citizen lower rate pick-ups) paid to City for collection. Prices to customers: 96 gal - $21.00; 65 gal - $20; own container - $18; second bins - half price--Senior citizen - (Reedy suggestion) - $14.00? Shelby anticipated revenue to City for collection at about $1,300 annually. Temps would continue to bill for roll-offs, one-call dumpsters, extra pick-ups.


Mayor Meyer questioned the advisability of increased administrative time (office and bank collection) and overall cost in a situation of minimal gain (only 8-13 locations not getting trash pick-up already). Adams countered, “Mandatory trash pick-up is a step in the right direction for community clean-up ….proactive….because doing nothing changes nothing.” Mayor Meyer held firm to his previous stance on cost-effectiveness, advisability, and support of present clean-up procedure. A motion was made by Council member Reedy, seconded by Neumann, and approved in a 4-0 affirmative vote for Attorney Carothers to draw up an ordinance for mandatory garbage pick-up. Carothers requested a copy of the current trash removal contract with Temps for considerations of correlation, amendment, and updating.


ABATEMENT OF STORAGE UNIT: LEGAL ACTION: Attorney Carothers informed members that he has drafted and sent a letter to the owner of a storage container to request its removal from location at C-1 designated area. Chelsea Chab requested clarification, citing that it “looks better than many places in town,” and that there are other storage containers (owner and address not provided) situated around the community. Carothers requested details, but none were provided. Members attempted to clarify the “grandfathered-in” aspect of the situation, but Ms. Chab was not satisfied with that explanation, and suggested as a solution - building a building over the unit or applying for “special” use permit.


PENNY PRESS DELIVERY RESTRICTIONS: Rex Adams told of his contact with the Lincoln publisher, and indicated that someone would be getting back to him in regard to policy revision for distribution. It was suggested that people might sign up to get the Penny Press, rather than continued random distribution. It was, however, noted that the “littering” aspect of the present delivery system has diminished somewhat, with less copies noticed accumulating or lying around.


MFO DISTRIBUTION: $925.28: Hold funds in Fire Fund (or) give to Fire Department?: Following discussion, Mayor Meyer suggested that the money be held in the City Fire Fund to be available for the replacement of hydrants as needed, and also for allocation to the Fire Department for projects for which funds might be requested. Employee Pike will contact Brad to share information in this regard.


CLEAN UP: Mayor Meyer requested that further review be made toward compiling a list of unlicensed vehicles to address at the next Regular meeting. One clean-up issue remains on the current list .
