The Regular Meeting of Mayor and Council was held on May 15, 2018, in the Blue Springs City Hall, Blue Springs, NE.

PRESENT: Mayor Meyer, Council members Carmichael, Mewes, Neumann, Reedy

ABSENT;

OTHER ATTENDEES: Connie Mewes, Mike Pike, Andy Carothers, Rex Adams


Notice of the meeting/hearing was given in advance by posting in at least three public places as shown by the certificate of posting placed on file. Notice of the hearing/meeting was simultaneously given to the Mayor and all members of the City Council and a copy of their acknowledgment of receipt and agenda are placed on file. Availability of the agenda was communicated in the advance notice and in the advance notice to the Mayor and City Council of the hearing/meeting. Proceedings hereafter shown were taken while the convened hearing/meeting was open to public attendance.


At 7:30 PM, Mayor Meyer called the Regular meeting to order and roll call was taken.


Motion, second and vote (Neumann, Mewes, 4-0 affirmative) to approve as sent minutes for the May 1, 2018 Regular meeting.


After review -- motion, second, and vote (Mewes, Carmichael, 4-0 affirmative ) to approve claims as follow: Bank Direct - NE Dept. of Revenue (10) - $278.64; Payroll: $2,149.64; B & J Hill Construction (Intersection/Manholes/Sidewalks) - $22,970.00; Beatrice Board of Public Works - $311.00; Black Hills Energy - $29.68; Chelsea Chab - (Meter Dep. Ref.) - $24.21; Concrete Industries - $1,296.00; Constellation Energy - $63.99; Jan Morris (Reimb.) - $100.00; Morris Used Cars - $1,449.03; Municipal Supply - $730.30; Nationwide (Clerk Bond) - $100.00; One-Call Concepts - $4.53; Milton Pike (Postage Reimb.) - $24.70; Postmaster - $70.00; Security First Bank (Pike-IRA) - $55.00; T.O. ANNUAL CITY CELEBRATION: Date of Annual Celebration was determined: Sunday, August 19, 2018. Motion (Mewes), second (Carmichael) and vote (4-0 affirmative) set the annual celebration budget at $5,000.


PLANNING & ZONING: No applications under consideration.

CLEAN-UP: Review continues to determine corrective action to be taken for garbage accumulation in a building. Legal action has been activated for a property owner with “accumulated trash” infraction. Review continues on two other properties. Future clean-up action will be determined for “worst violation first” for other general clean-up and junked/unlicensed/inoperable vehicle (and other). Attorney Carothers updated members on the Thomas Foundation grant application, speculating a thirty-forty thousand dollar grant request, with determinations yet to be made regarding the amount of City contribution to the demolition project. Receipt is still pending (Carothers/) of a Tax Deed for one included property.


EMPLOYEE HANDBOOK: Attorney Carothers called for clarification (office hours, shop hours, possibility of PTO designation rather than sick leave/vacation leave classification with consideration for closing employee balances (pay - Vacation, lose - Sick leave) at termination). Draft will be provided for copying and distribution to members for further review prior to the next Regular meeting.

KENO REVIEW: March Keno report review and analysis continues by Charitable Gaming and the City to determine basis for and amount of any prospective reimbursement to Keno Operator. Review led to speculation of a total, but final and official determination cannot be made until the review process is completed and the report is received. Debated issues included: Operator compliance with Nebraska Gaming regulations (changing out game balls - manufacturer specifications, Nebraska Gaming regulations, ), and contractual obligations, as well as need for Operator to contact City members in the event of high/unusual payout situations (has been done in the past, but not recently). A meeting between Charitable Gaming representative(s), Attorney Carothers, and Keno Operator Ruby Morris will be held (May 16th - at the Keno Lounge) to clarify procedures, expectations, inattention to mandated operational procedure, etc.) A motion Carmichael), second (Neumann) and 4-0 affirmative vote authorized Attorney Carothers to notify Keno Operator that “ball draw” option will not be approved should contractual payments to the City (April report) not be made.

MFO: (City of Beatrice check: $919.17) Members again determined to keep the funds in the Fire Fund of City Regular checking account, to be available for review and reallocation should the Fire Department approach the City with a qualifying request.


DONATION TO RURAL WATER:($100.00?): It was noted by City Attorney Carothers that Rural Water (Hellbusch) has been instrumental in rate studies, and is always quick to respond, without compensation to the organization, on a wide range of project requests. Carothers felt a larger donation than $100 would be in line. Members agreed. A $500 donation was authorized by a motion (Reedy), second (Carmichael) and a 4-0 affirmative vote. Check to Nebraska Rural Water will be included in claims at the next Regular meeting.


OTHER: (1) Increasing incidents of “dogs-running-at large” were discussed, with determination that “pictures be taken and dated” to support legal address of violations. (2) As a result of completion of roof repairs, it was the determination of Mayor and Council to proceed with necessary replacement of ceiling tile, electrical fixtures (LED) under the “general maintenance” program. (3) Council member Reedy inquired about status on a past “storage container” situation designated to legal action. Carothers indicated he would “go forward on it.”
