The 2019-2020 Budget Hearing and Regular Meeting of Mayor and Council were held on September 3, 2019, in the Blue Springs City Hall, Blue Springs, NE.

Notice of the hearing/meeting was simultaneously given to the Mayor and all members of the City Council and a copy of their acknowledgment of receipt and agenda are placed on file. Motion (Mewes) and second (Carmichael) to open the Budget Hearing: (Vote: 4-0 affirmative).
Call for comments and questions (if any), summarization by Blobaum of the Budget Notes (herein included) :
2019-2020 Budget Notes: The City appears to be continuing to produce revenues in excess of regular operating expenditures. The General All-Purpose Fund is producing roughly $40,000 per year (nearly the same as last year), and the Keno Fund is producing roughly $15,000 per year (an increase from the previous year). These funds produced are held in reserve available for capital outlays (paving, new equipment, water lines, etc.)... It is estimated that as of October 1, 2019, you will have cash reserves of about $280,000 General and $245,000 Keno. This compares to the prior year amounts of $295,000 General and $230,000 Keno.… For the year 2019-2020, proposed budget property tax has been left at the levy limit of 45 cents, which increases the tax request from $29,836 o $30,329. This increase (of approx. 1.6%) is due to higher total assessed valuation for the City from $6,630.423 to $6,739,894 All of the increased valuation of $109,471 is attributable to new growth… Other operating revenues have been estimated conservatively at $120,000 based on the prior year amounts for the general funds. $600,000 has been included in other operating revenues based upon prior years’ estimated Keno game gross proceeds... $550,000 has been budgeted as potential capital outlay in the General All-Purpose Fund and no capital outlay has been budgeted in the Keno Fund beyond your normal operating expenditures. However, $335,000 has been budgeted to be transferred from the Keno Fund to the General All-Purpose Fund to assist in financing potential capital outlay projects. Normal operating expenditures have been budgeted liberally at $330,000 for the General All-Purpose Fund and $510,000 (includes game winner payoffs) for the Keno Fund at 85% payout... The budget process and document perform two legal functions: 1. Sets the property tax request-budgeted at $30,329. 2. Establishes an overall expenditure limit-budgeted at $1,725,000.... The budget must be adopted by September 20. The property tax requested in the budget will be final; however, the expenditure limit may be amended, if needed, throughout the year...The expenditure limit included in the proposed budget allows for expenditure of nearly all cash reserves which are expected to be available. Since some cash reserves will be necessary, we don’t expect, nor do we recommend, that the full amount budgeted of $1,725,000 be spent. GENERAL BUDGETING NOTES: The lid law is assigned to limit the growth of non-utility government revenues to inflationary increases. Exceptions are allowed for revenues required to pay off bonded debt, real estate improvement capital outlays, and interlocal agreements... Due to the Lid Law restrictions, it continues to be advantageous to pay real estate capital outlays, pay off of bonded debt, and participate in interlocal agreements from funds where property tax, sales tax, and state pass-through revenues are deposited (i.e. General and Street). This will help keep this law from limiting your non-utility source revenues...The lid law has become a significant factor for future budgets. Although you have adequate unused budget authority at this time, this is a factor that should be monitored.
Motion (Reedy), second (Carmichael), vote: Carmichael -Yes, Mewes - Yes, Neumann - Yes, Reedy - Yes, to approve a 1% increase in 2019-2020 Restricted Funds Limitation (On lid computation LC-3 Item 3, included in budget.)
No changes were required to the Budget: motion (Mewes) second (Carmichael) to accept the 2019-2020 Budget: (Vote: 4-0 affirmative = Carmichael - Yes, Mewes - Yes, Neumann - Yes; Reedy - Yes) .
Motion (Carmichael) and second (Mewes) (,vote 4-0 affirmative) to open a Special Budget Meeting within the Budget Meeting.
Resolution #2019-5 was read (Blobaum)--- (WHEREAS, Nebraska Revised Statute 77-1601.02 provides that the Governing Body of the City of Blue Springs, passes by a majority vote a resolution or ordinance setting the tax request, and WHEREAS, a special public hearing was held as required by law to hear and consider comments concerning the property tax request; NOW, THEREFORE, the Governing Body of the City of Blue Springs resolves that: 1. The 2019-2020 property tax request be set at $30,329.00. 2. The total assessed value of property differs from last year’s total assessed value by 2%. 3. The tax rate which would levy the same amount of property taxes as last year, when multiplied by the new total assessed value of property, would be $0.442678 per $100 of assessed value. 4. The City of Blue Springs proposes to adopt a property tax request that will cause its tax rate to be $ 0.449992 per $100 of assessed value. 5. Based on the proposed property tax request and changes in other revenue, the total operating budget of City of Blue Springs will exceed last years by 2%. 6. A copy of this resolution be certified and forward to the County Clerk on or before October 13, 2019. Motion by Reedy, seconded by Carmichael to adopt Resolution 2019-5, Voting yes were Carmichael, Mewes, Neumann, Reedy/ Voting no were ___None__. Dated this 3rd day of September 2019.

BUILDING INSPECTOR - CONDEMNED BUILDINGS: Excerpt from email received from Carothers: “I am meeting tomorrow at 11:00 with Rob Mierau and Chet McCrury (City of Beatrice Building Inspectors) to discuss having them do inspections under our unsafe buildings ordinance. I will be at the next meeting to report whether they are willing to serve in that capacity, and if so, what they would charge to do the inspections.”
PLANNING & ZONING: No new applications. Mayor Meyer indicated that primary concern in reference to building projects was “setback compliance,” and although reservations exist at committee level about the timing of applications received, it was noted that projects underway can be stopped if compliance violation or other prohibitive factors exist.
CABIN PRESERVATION ISSUES: A Johnson Cabin Museum Update by Jan Morris is attached to the office copy of the minutes and available for public review. Primary focus at the meeting was the disconnection of electricity from the cabin prior to the move, and an on-site inspection will follow the meeting to assure the discontinuance of power.
PAVING: Start date is anticipated to be before Sept. 15th.
CLEAN-UP: Excerpt from email from Carothers: “With respect to clean up of nuisance properties, I have not received any requests for charges from Tony Shepardson, so I am not sure at this point in time where he is at getting compliance with our nuisance ordinances. I would suggest having Tony come to one meeting per month to have him report on what progress is being made.”
Other: Dale Crumb addressed members in regard to a problem experienced at his property, which relates primarily to the “width of the street and parking limitations.” Carol Klee also showed interest in having the street at her location scrutinized. Mayor Meyer asked that Employee Pike contact Gilmore & Associates to have them come down and make assessments/determinations/surveys regarding the streets at both locations. Pike will be contacting Gilmore representatives.

PLANNING & ZONING: Approval of # 19-2 Application for Building Permit (Daryl Mailahn - lean-to) by motion - Mewes), second (Neumann) and 4-0 affirmative vote (Previously approved by P & Z Commission, but with disappointment expressed by Connie Mewes, that it was another structure erected prior to completion of an application and review by the P & Z) was approved. Applicant will be notified of approval and fee.
CABIN PRESERVATION ISSUES: Preservation activities have begun. Footings have been poured.
ARMOR COATING/PAVING: Armor coating subject to contractor availability, so removed from agenda until a later date. Paving is anticipated to begin (Walnut Street) after Labor Day.
TRUCK: Previous problem seems to be corrected.
CLEAN-UP: Adams provided a list of properties recommended for demolition/burning, as well as other problem properties needing varied clean-up action. Copies were provided to members, and one is attached to the office copy of the minutes. Adams also reported that some street signs need to be replaced.
LIQUOR PERMIT - OCT. 3 - FIREMAN’S MEMORIAL HALL (ONE PROPERTY AT A TIME): Rex Adams presented the Special Designated License Local Recommendation (Form 200) for review for the 10/3/19 - 5 PM - 11:59 PM
One Property at a Time Fund Raising Banquet at the Fireman’s Memorial Hall. No objections were made. Municipal approval was given by motion (Mewes), second (Carmichael), and a 4-0 affirmative vote which authorized Mayoral signature.
Other: Employee Pike advised members of the 8/21 plans of the Wymore Crew to replace the meter off the Wymore main (Blue Springs expense), which might possibly be limited to changing the insides of the meter.

DILAPIDATED BUILDINGS (ONGOING PROCEDURES): Project completed satisfactorily. One incidental issue remaining which is expected to be finalized shortly - concrete/misc. materials from one site - Council member Reedy volunteered to remove concrete, Joel Fossler to remove remaining elements. Rex Adams asked about any provisions in the works for two properties , and Attorney Carothers said he would make arrangements for a building inspector to determine condemned-status.
ANNUAL CELEBRATION: Motion by Council member Neumann, second by Reedy, and 4-0 affirmative vote to authorize a $5,000 budget for the Annual celebration. It is expected that cost will be less. Reedy told of arrangements made for contractor setups, portable toilets, Cosco selling memberships, Bounce House (for which help will be needed), Van’s Chicken, One Property at a Time - burgers/chips).
PLANNING & ZONING: No new applications.
CABIN PRESERVATION ISSUES: Thomas Foundation Grant awarded in the amount of $18,500. Contractors advised and discussions held. Project underway, but not to begin before the August 18th celebration day. Employee Pike asked if a “larger base” was a possibility for the plow, this to facilitate mowing around it, and Reedy said it should be possible.
ARMOR COATING/PAVING: Paving (Walnut Street) expected to begin in mid-August. No further information available for armor coating.
TRUCK: Anticipated repairs for the City truck - cam shaft sensor, with scheduling for Friday.
CLEAN-UP: Rex Adams inquired as to how the Ordinance Enforcement Officer (Shepardson) was proceeding, and a list of properties was given to Adams for his review. No properties have been turned over to Carothers for charges at this time, and Carothers will follow-up with Shepardson on his progress, with one property a primary concern. Carothers also stated that he had sent a letter - regarding an occupied dwelling without utility services), and that he intends to contact the owner of same.
Other: Employee Pike reported that his phone used for City business is having speaker problems, and a trip to Verizon will be necessary.

ARMOR COATING/PAVING: Paving (Walnut Street) expected to begin in mid-August. No further information available for armor coating.
TRUCK: Anticipated repairs for the City truck - cam shaft sensor, with scheduling for Friday.
CLEAN-UP: Rex Adams inquired as to how the Ordinance Enforcement Officer (Shepardson) was proceeding, and a list of properties was given to Adams for his review. No properties have been turned over to Carothers for charges at this time, and Carothers will follow-up with Shepardson on his progress, with one property a primary concern. Carothers also stated that he had sent a letter - regarding an occupied dwelling without utility services), and that he intends to contact the owner of same.

MANDATORY GARBAGE PICKUP (BALLOT LANGUAGE): Attorney Carothers provided copies of Resolution 2019-3, with Council member Reedy making the motion, and Neumann seconding to approve, and Carothers read the resolution: (Excerpt - “WHEREAS, several residents have requested that the City institute mandatory garbage pickup for residential, commercial and industrial properties; WHEREAS, the issue of whether to institute mandatory garbage pickup for residential, commercial and industrial properties is a proper ballot issue; and WHEREAS, the Mayor and City Council of the City of Blue Springs, Nebraska, have determined that there is interest in determining whether to institute mandatory garbage pickup for residential, commercial and industrial properties…. A full copy of the resolution is attached to the office copy of the minutes and available, upon request, to interested parties. The reading was followed by a 4-0 affirmative vote to approve. Carothers stated he will provide the initiating documentation to Dawn Hill, County Clerk.
OIO OFFICER TONY SHEPARDSON REPORT: Shepardson addressed members, provided a progress report, and a listing of properties to be addressed next. A copy of the locations is attached to the office copy of the minutes, and available for public review. Shepardson indicated that “rain” was, but is no longer a prohibitive factor in regard to expectations for resolution of clean-up issues. He also requested to know the primary “go-to individual/individuals” in regard to his location choices and activities. He was told to report to the council (as well as including Carothers).
GENERAL CLEAN-UP: Carothers agreed to send one citizen a letter for violating Ordinance #460, which disallows occupancy in a dwelling not served by public utilities Carol Klee identified a property which has tall weeds (thistles), and an effort will be made to identify the property owners, but Reedy agreed to mow the west side prior to demolition of the trailer at that location. A question was raised by Reedy as to the court proceedings which were previously determined for a storage container, and Carothers replied that since it was in place before the passage of Ordinance # 455, action for removal was suspended.

Reedy told that it would be the first time they had approved a grant for cabin preservation.
ARMOR COATING/PAVING: On hold.
MANDATORY GARBAGE PICKUP (BALLOT?): Attorney Carothers reported on his contact with Dawn Hill, Gage County Clerk, and the estimate for “simple ballot language” is anticipated to be $250.00 to put the issue on Primary ballot (Feb. 1st -- deadline). After discussion, members (Motion: Neumann, Second: Reedy, 4-0 affirmative vote) authorized Attorney Carothers to put together for consideration of members - a resolution to put on the Primary ballot, basically, “Should Blue Springs have Mandatory Garbage Pickup?” If passed by the vote of the people, the various factors/conditions of service would be reviewed and decisions made.
CLEAN-UP: Several properties are under address by OEO Shepardson and Carothers will initiate address of a property wherein a person is believed to be residing without any utility services. Tony Shepardson was added to the next meeting agenda.
OTHER: Employee Pike indicated that he had done “a little work” where Carol Klee reported problems, and said, “I think I see what the problem is.”

DILAPIDATED BUILDINGS (ONGOING PROCEDURES): Attorney Carothers stated that demolition is scheduled to begin the end of June, and he will call Digger’s Hotline to initiate flagging properties, as well as Norris Public Power to determine clearance. Council member Reedy provided information to Attorney Carothers (for future issues) - regarding demolition rules (NEDQ). No changes were reported to the previous rules. Rock from the structure can be used for fill, but needs to be “put on the deed.” The last burn debris removal situation was stated to have cost $80 to remove the ash.

CABIN PRESERVATION ISSUES: Council member Reedy stated that he attended the recent Gage County Tourism meeting with Jan Morris, at which “anticipated approval” was given for the $19,000 grant application, but with “formality” of final approval June 19th at the Gage County Supervisors meeting, which Reedy plans to attend. Reedy told that it would be the first time they had approved a grant for cabin preservation.
ARMOR COATING/PAVING: On hold.
MANDATORY GARBAGE PICKUP (BALLOT?): Attorney Carothers reported on his contact with Dawn Hill, Gage County Clerk, and the estimate for “simple ballot language” is anticipated to be $250.00 to put the issue on Primary ballot (Feb. 1st -- deadline). After discussion, members (Motion: Neumann, Second: Reedy, 4-0 affirmative vote) authorized Attorney Carothers to put together for consideration of members - a resolution to put on the Primary ballot, basically, “Should Blue Springs have Mandatory Garbage Pickup?” If passed by the vote of the people, the various factors/conditions of service would be reviewed and decisions made.
CLEAN-UP: Several properties are under address by OEO Shepardson and Carothers will initiate address of a property wherein a person is believed to be residing without any utility services. Tony Shepardson was added to the next meeting agenda.
OTHER: Employee Pike indicated that he had done “a little work” where Carol Klee reported problems, and said, “I think I see what the problem is.”
Council member Reedy reported contact with Sapp Brothers who would be willing to deliver whatever gallons required by the City, and at a lower rate than pump price.

MFO FUNDS (CITY OF BEATRICE ($849.28) & NEW INTERLOCAL COOPERATION AGREEMENT: Acknowledgment of MFO funds received. Motion, second (Neumann, Mewes) to approve/accept Resolution 2019-2, per:
WHEREAS, the Nebraska State legislature has passed the Mutual Finance Assistance Act, which provides an opportunity for increased funding for fire districts, villages, and first-class cities;
WHEREAS, in order to participate in an application for such funding, municipalities must join in an interlocal agreement with fire districts comprising at least 80% of the rural population of Gage County, Nebraska;
WHEREAS, an agreement has been prepared that will meet the requirements of the Mutual Finance Assistance Act, and will result in specific state aid to Gage County for fire and rescue purposes, in addition to currently available funds;
WHEREAS, the City of Blue Springs, Nebraska is authorized to enter into such an agreement pursuant to the Interlocal Cooperation Act, and the Nebraska Mutual Finance Assistance Act; and
WHEREAS, this Council must appoint a representative and an alternate representative to sit on the joint board provided for in the reference agreement.
NOW, THEREFORE, BE IT RESOLVED by this body that the City of Blue Springs, Nebraska is authorized to execute the Interlocal Cooperation Agreement which accompanies this Resolution, providing for a uniform levy of three cents on each $100 of taxable valuation of a property subject to levy, and which distributes aid one-half on the basis of property valuation, and one-half on the basis of population.
BE IT FURTHER RESOLVED, that Brad Robinson shall serve as a representative on the joint board for the Interlocal Agreement and Gene Reedy will serve as an alternative representative to such board.
PASSED AND APPROVED this 4th day of June, 2019. - (Resolution read by Carothers, and received a 3-0 affirmative vote, that thereby approved and authorized Mayoral signature on the Resolution and the new Interlocal Cooperation Agreement.

ANNUAL CELEBRATION: Ongoing efforts to obtain trophy sponsorship, as well as considerations regarding “cash prizes” supported by increased entry fees. Hughes inquired as to procedure to follow by person/groups interested in setting up a booth at the event, and charges. Council member Reedy said to contact him, and each interested party will be addressed individually as to situation-based charges.
PLANNING & ZONING: No new applications.

grant approval possibilities.
ARMOR COATING/PAVING: Employee Pike indicated Pavers will be beginning work in Wymore in 3 weeks to a month, and Walnut Street in Blue Springs is anticipated to follow. Council member Reedy called for a variable review of possible applications for Broad Street (‘A’ to river), and Mayor Meyer suggested that it be addressed more precisely after Walnut Street and armor coating is completed, as the extent of work in other areas will be dependent on remaining available City funds.
MANDATORY GARBAGE PICKUP (HUGHES): Hughes addressed members, (providing a personal narrative which is attached to the office copy of the minutes, and available to interested parties upon request) stating beneficial factors anticipated from the implementation of mandatory garbage pickup (previously considered by members --with review closing negatively November 2017) . Steve Porter lent support to the possibility of mandatory garbage pickup. Pros and cons were briefly discussed. Attorney Carothers agreed to contact Dawn Hill for a cost analysis for putting it on the ballet, and will email results to the City office for disposition to members for their review and consideration. Mayor Meyer also stated that time should be given to the implementation of Shepardson as the Ordinance Enforcement Officer, to analyze impact, and so to determine/eliminate need for other possible avenues of approach to clean-up issues.
DRAINAGE ISSUE: (500 Block-East 2nd) - CAROL KLEE: Klee described drainage problems. Several approaches to corrective action were debated, with none providing totally satisfactory expectation of results. Determination was made to contact Gilmore & Associates for trouble shooting, analysis of the problem, and suggestions. They will be requested to contact Employee Pike to make arrangements.
CHILDREN CLIMBING ON TOP OF PARK SHELTER (MEWES): Council member Mewes reported that three women in the community reported seeing children on top of the park shelter, at one time “eight of them.” Members agreed that it is recommended that pictures be taken when it is happening and the Sheriff notified. Within troubleshooting discussion, Council member Reedy suggested “a trail cam focused at the top of the shelter, and which could be used in various other beneficial manners by the City,” and obtaining the equipment will be pursued.
CLEAN-UP: OEO addressing issues. Carothers will contact Shepardson for updates of actions taken, and will email results to the City Office for sharing with members.
OTHER:
Council member Mewes asked Pike how the truck was running, and Pike said it has been quitting on them, but a solution to the problem has not yet been found. The truck was reported to have at least 100,000 miles on it.
