The Regular Meeting of Mayor and Council was held on December 6, 2016, in the Blue Springs City Hall, Blue Springs, NE.


PRESENT: Mayor Meyer, Council members Carmichael, Mewes, Neumann, Reedy

OTHER ATTENDEES: City Employee Milton Pike, City Attorney Andy Carothers, Connie Mewes


Notice of the meeting/hearing was given in advance by posting in at least three public places as shown by the certificate of posting placed on file. Notice of the hearing/meeting was simultaneously given to the Mayor and all members of the City Council and a copy of their acknowledgment of receipt and agenda are placed on file. Availability of the agenda was communicated in the advance notice and in the advance notice to the Mayor and City Council of the hearing/meeting. Proceedings hereafter shown were taken while the convened hearing/meeting was open to public attendance.


At 7:30 PM, Mayor Meyer called the Regular meeting to order and roll call was taken.


Motion, second and vote (Mewes, Carmichael, 4-0 affirmative) to approve as sent the November 15, 2016 Regular meeting minutes.

CDBG PROJECT # 15 PW-015: ANY PERTINENT INFORMATION: No new information.



PARK SIDEWALK- PLANS: Postponed until Spring. Council member Neumann stressed the importance of attention to mandatory specifications for handicapped access.


PLANNING AND ZONING: Motion, second, vote (Mewes, Neumann, 4-0 affirmative) to approve application for building permit for Glen Bence (building) which has received approval of the Planning and Zoning Commission. Applicant will be notified of approval and fee. Members addressed a problem created when a shipping container was brought onto a property. Carothers told that shipping containers do not meet requirements of an “accessory building,” and so would need to be removed. He will write a letter to request the owner to remove the container from the property and the Municipality.


DANGEROUS DOGS: Attorney Carothers will give attention to two situations: 1) Follow up with Gus in reference to a previous situation. Carothers advised that photographs (time/date noted by neighbors) would support legal action. 2) Second letter (warning of filing a court complaint) to address relocation of a previously designated dangerous dog from the Municipality.


MFA/MFO: Disposition of funds - (City of Beatrice Check #29629 for $925.28): Determination was made to hold the funds in the Fire Fund of the General checking account until such time as a Fire Department- related need is identified and a request made.


PRELIMINARY WORKUP OF ONE AND SIX YEAR PLAN: (Relative to receipt of materials): Materials not yet available.


EQUIPMENT (PIKE): Employee Pike provided materials including “auction-close” information on a street sweeper. “Having more paved streets now increases sweeping needs,” told Mayor Meyer. Council member Carmichael indicated he wanted whatever was the “best benefit to the town.” He said he had spoken with a Wymore Council member, and from that conversation determined there might be a possibility of hiring Wymore for Blue Springs street sweeping needs. Employee Pike identified a problem in that regard, stating that wear and tear on the Wymore equipment was a valid concern which could well prohibit Wymore from entering into an arrangement with Blue Springs. Buying at auction was discussed. Procedure which might be utilized was: Determination of specific-cap purchase authority for a person designated to bid at auction, or calling a special meeting (3-day advance posting required) when a promising purchase option arises.



CLEAN-UP: A burn-site clean up issue was discussed, with Attorney Carothers reporting a potential mid-to-late January court date. Council member Reedy indicated that he was in the process of purchasing the property and cleaning it up. A title search is underway. The complaint will be dropped against the current property owner when purchase is official.
