ANNUAL INSURANCE (MARK DAVIDSON): Mark Davidson gave the annual insurance package presentation and called for questions. No issues were described. The annual premium payment was authorized within the payment of claims, as detailed above.
SENDD/GILMORE - CDBG PROJECT # 15 PW-015 ASPECTS, AS ENGINEERING CONTRACT FOR REVIEW AND SIGNATURES, DESIGN, LETTING, ETC.: David Taladay (SENDD) gave an overview of new developments and changes at the Humboldt office. He advised that personnel in the Lincoln office were in place to administer the CDBG grant for the City. Keith Gilmore (Gilmore & Associates) provided information about the project -- “Right on schedule, time and budget.” Plans are in place for preparation of specifications, bid-letting, (April-May) with projected “late summer construction.” and follow-up reviews and inspections.) Motion by Reedy, second by Neumann , and vote: Carmichael - Yes, Mewes- Yes, Neumann - Yes, Reedy - Yes to accept/authorize signatures of Mayor Meyer and Andy Carothers (approval of legal form) and approve the Engineering Contract with Gilmore for the #15-PW-015 CDBG Paving Project, and wherein the Consultant shall complete, in a satisfactory and proper manner as determined by the City, the work activities described within, and the City will provide such assistance and guidance as may be required to support the objects set forth in the agreement and will provide compensation for services as set forth therein. The document is available for review in the City office. Further discussion included the possibility of additional work independent of the CDBG paving project, but in a possibly nearly simultaneous timeframe (Church/Walnut Street) because of having equipment/materials already on site. Next Monday, John Berry (Gilmore) will confer with Pike, make observations to evaluate needs on Walnut Street.
MFA AGREEMENT: Agreement not yet received for review, designation of representatives, and signature.
CITY CELEBRATION (REEDY): No objections were raised to plans/preparations for an annual (160th anniversary of City) Car/Tractor Show, which is projected to be held the 3rd Saturday of August. Neumann and Reedy provided basic information, which included Cabin inclusion issues (Reedy), and the possibility of a Memorial Tractor Show to honor deceased organizer/participants of previous years (Neumann, Seachord, Carmichael). Cabin needs were discussed- north side gutter work. Local contractor Hutchison indicated close to the same color guttering is a possibility. Council member Neumann suggested a metal/wood lining combination, and that idea was well-received by members. Also discussed was the purchase of a 20-foot, - 3-trunk river birch at Pinecrest (donations were solicited by/arrangements made by Jan Morris), with planting planned about April 1st. )
PLANNING AND ZONING: No new building permit applications submitted for review. Roland Hardin addressed members regarding plans to replace, extend the fence (west side, and to be like “the Church of Christ fence in Wymore”) at the Church, and asked if it could be built to within approximately “2 feet of the sidewalk.” Attorney Carothers indicated, “it should not be a problem.” A building permit application was provided so that the project might be reviewed at the next meeting (3/21) of the Planning and Zoning Commission.
CLEAN-UP: Mayor Meyer suggested the scheduling of the annual Spring Clean-Up Day. Employee Pike recommended April 13th (Wednesday). Members determined that to be a good choice. Arrangements will be made, which include notification of service providers (Temps, landfill), and flyers mailed to citizens (2-3 weeks before the scheduled event). The current clean-up list was reviewed, with one location removed due to resolution of issues. The concern on one site is expected to be resolved after frost is out of the ground. Removal of infractions on one property is reportedly underway, with review to continue. Council member Reedy volunteered to help with the project. Legal action regarding situation involving a dog-at large, may be activated if the complainants are willing to appear in court. They will be contacted regarding such participation in the legal process. Legal process of one issue continues.

ENGINEERING (GILMORE) DESIGNATION FOR CDBG PROJECT/ AND/OR OTHER CDBG ISSUES, AS FUND RELEASE: Motion by Council member Mewes, second by Neumann, and 3-0 affirmative vote to designate Gilmore as the Engineer for CDBG Project #15-PW-015. John Berry will invite SENDD representative and Gilmore engineer to attend the next Regular meeting on 3/1/16. CDBG aspects, as engineering contract (for review and signature), design, and letting are to be addressed.
REQUEST TO WAIVE HALL RENTAL FEE FOR BAKE: (DARCY JESONEK): Renee Lauby represented the (Lightning) Softball Association to request free hall rental. A motion by Council member Mewes, second by Carmichael, and 3-0 affirmative vote waived hall rental fee for a fund-raising bake on March 11, 2016.
PLANNING AND ZONING: Motion by Council member Mewes, second by Neumann, and 3-0 affirmative vote to approve the building permit application (fence) for Julie Hautzenroder. Planning and Zoning Commission approved the permit application at February 15, 2016 meeting. Applicant will be notified of approval and fee.
CLEAN-UP: Several properties remain on the current list for continuing review. Legal issues continue for update by Attorney Carothers. Mayor Meyer commented on media coverage of clean-up issues, for which he attempted to clarify that the City does not currently have any demolition/controlled burning projects underway or planned, and that all efforts currently activated or planned in that regard are “private” endeavors. Meyer also reiterated his media-reported comment, that “one man’s trash is another man’s treasure,” a reality that poses difficulty in any clean-up process. He added that the media did not fully report his comments, leaving out his view that benefit would be derived and clean-up projects simplified if those who purchased tax deeds/mortgages could be held responsible for clean-up issues on acquired properties.

Mayor Meyer called for a motion to open the Public Hearing, which was made by Mewes, seconded by Reedy, and followed by a 4-0 affirmative vote. Mayor Meyer called for comments on the One & Six Year Plan. No comments were made. In keeping with the desired timeline and to allow for late arrivals, the Public Hearing continued, but with Regular meeting agenda topics being discussed, the results of which are documented below (and officially addressed after close of Public Hearing).
At 8 PM, a motion by Council member Mewes, second by Neumann, and an affirmative 4-0 vote closed the Public Hearing and returned proceedings to Regular Session.
A motion by was made by Council member Reedy and seconded by Mewes to adopt Resolution 2016-4. The resolution was read: WHEREAS: Section 39-2115 and Section 39-2119, 1969 C.S. - R.S. of Nebraska 1943 requires that each County and Municipality prepares a one and six year, specific road or street improvement plan and to file same with the State Highway Commission on or before March 1, 2016, and WHEREAS: The Mayor and City Council of the City of Blue Springs, in compliance with the statutes and regulations of the State Highway Commission, did hold a public hearing on the proposed one and six year specific street improvement plans in the City Hall on February 2, 2016, in accordance with the “Notice of Public Hearing,” a certified copy of such notice is attached, and WHEREAS, There were no objections filed or amendments made to the one and six year plan on file with the City Clerk and as presented at the hearing now, THEREFORE BE IT RESOLVED: That the City Council does hereby approve said one and six year plan as filed with the City Clerk, a copy of which is attached hereto, BE IT FURTHER RESOLVED: That the Mayor of the City is authorized to sign this resolution on behalf of the City Council and the City Council hereby approves the proposed one and six year plan... Adopted this 2nd day of February 2016. The vote was taken: (Council member Carmichael - Yes; Mewes - Yes; Neumann - Yes, Reedy-- Yes) to approve and adopt Resolution 2016-4.
ANNUAL INSURANCE: MARK DAVIDSON: Insurance representative was not present. Topic tabled until next Regular meeting.
ANNUAL KENO PROCEEDS FUND REVIEW/FUND TRANSFER:. (Fund Balance from last Treasurer‘s Report - $62,881.46: Acceptable fund minimum balance - $15,000. -- Transfer may be less but should not exceed: $47,881.46). Mayer Meyer called for comments from Ruby Morris. She said she “would like to see Keno funds being used instead of just sitting in the bank account,” but that she was primarily “here to listen.” Mayor Meyer noted that a large portion of the fund would be used in the upcoming CDBG paving project, but that some might remain for other issues (as armor coating) , which would be later discussed. Council member Reedy made a motion to transfer $47,881.46 from the Keno Proceeds Account to the General Fund within Regular checking and to then transfer $47,881.46 from the General Fund to the Keno Fund within Regular checking and to purchase a Keno CD in the same amount. The motion was seconded by Council member Mewes, and followed by a 4-0 affirmative vote.
PLANNING AND ZONING: No new applications.
CLEAN-UP: One property was removed from the clean-up list due to resolution of issues. Review will continue for remaining properties on the list, with Andy Carothers requested to provide follow-up data where legal issues are being addressed. Steve and Katherine Pomeroy reported a property with clean-up issues, and that property was put on the current list, with a courtesy letter to be sent.
The Pomeroys also reported canine issues, which are to be forwarded to Attorney Carothers for his input/and action. Tim Brown stated that he felt getting advice from the City attorney “would be right way to handle it.”

ANNUAL KENO PROCEEDS FUND REVIEW/FUND TRANSFER:. (Fund Balance from last Treasurer‘s Report - $62,881.46: Acceptable fund minimum balance - $15,000. -- Transfer may be less but should not exceed: $47,881.46). Mayer Meyer called for comments from Ruby Morris. She said she “would like to see Keno funds being used instead of just sitting in the bank account,” but that she was primarily “here to listen.” Mayor Meyer noted that a large portion of the fund would be used in the upcoming CDBG paving project, but that some might remain for other issues (as armor coating) , which would be later discussed. Council member Reedy made a motion to transfer $47,881.46 from the Keno Proceeds Account to the General Fund within Regular checking and to then transfer $47,881.46 from the General Fund to the Keno Fund within Regular checking and to purchase a Keno CD in the same amount. The motion was seconded by Council member Mewes, and followed by a 4-0 affirmative vote.
PLANNING AND ZONING: No new applications.
CLEAN-UP: One property was removed from the clean-up list due to resolution of issues. Review will continue for remaining properties on the list, with Andy Carothers requested to provide follow-up data where legal issues are being addressed. Steve and Katherine Pomeroy reported a property with clean-up issues, and that property was put on the current list, with a courtesy letter to be sent.
The Pomeroys also reported canine issues, which are to be forwarded to Attorney Carothers for his input/and action. Tim Brown stated that he felt getting advice from the City attorney “would be right way to handle it.”

Glennis McClure/ NGage: McClure notified members of a County-wide housing study underway (growth, development, plan for dilapidated structures - seeking both public and private support) and several meetings and workshops to be held. She indicated that a membership drive ($1,000 annual membership for a municipality) is currently being conducted, and she left membership information for the review and consideration of Blue Springs Mayor and Council.
Clean-Up; Two courtesy clean-up letters were determined, and Employee Pike will contact one property owner. City Attorney Carothers will follow up on legal issues underway.

Review of Meeting Date/Potential Change from Tuesdays to Mondays (temporarily?): All members contributed to conversation of pros and cons of changing the regular meeting schedule from the 1st and 3rd Tuesday of each month to the 1st and 3rd Monday, but a motion by Mewes, second by Carmichael, and a 4-0 affirmative vote held to the existing schedule by ordinance of : 1st and 3rd Tuesdays of each month.
Workup for One & Six Year Plan: John Berry advised members that we will shortly be receiving documentation to set and advertise the Public Hearing of the One and Six Year Plan (for February). At this time, no changes were indicated to the previous plan.
Zito Contract Renewal (?): No information has been received from Zito, which is currently operating in the Municipality without the benefit of contract.
Planning and Zoning: No new applications.
Glennis McClure/ NGage: McClure notified members of a County-wide housing study underway (growth, development, plan for dilapidated structures - seeking both public and private support) and several meetings and workshops to be held. She indicated that a membership drive ($1,000 annual membership for a municipality) is currently being conducted, and she left membership information for the review and consideration of Blue Springs Mayor and Council.
Clean-Up; Two courtesy clean-up letters were determined, and Employee Pike will contact one property owner. City Attorney Carothers will follow up on legal issues underway.

Tree for Left Side of Cabin - (Jan Morris/Radar Reedy), By Donation, Possibly City Contribution: It was noted by Council President Reedy that Jan Morris is soliciting contributions for a tree (River Birch - Pinecrest, work by David Trauernicht) to shade the cabin. It was reported that about 2/3 of the goal has been reached in contributions. Members were in agreement for the City to kick in for the remaining balance ($100?) if total donations are not received to cover the expected price.
