December 28, 2021 A Special meeting of Mayor and Council was called for the purpose of reviewing/approval of Ordinance # 470 (See below). WHEREAS, the qualified electors of the City of Blue Springs elect members to the Blue Springs City Council by election districts, or what is more commonly known as “wards”; WHEREAS, the City of Blue Springs is divided into two (2) wards, and two qualified electors from each ward are elected as members of the Blue Springs City Council; WHEREAS, the last time the election district boundaries were redrawn was in 1991, and Blue Springs City Council did not redraw the election district boundaries after the 2000 Census of Population data was published, or after the 2010 Census of Population data was published; and WHEREAS, the Mayor and Council of the City of Blue Springs, Nebraska, deem a need and necessity to adjust the boundaries of the election districts due to changes and shifts in population of residents in the City of Blue Springs. NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF BLUE SPRINGS, NEBRASKA: Section 1. That the attached Election District Boundary Map, be, and hereby is, adopted as the official Election District Boundary Map for the City of Blue Springs, Nebraska. Section 2. That the City Clerk certify a copy of this ordinance and the official Election District Boundary Map to the Gage County Clerk on or before December 30, 2021. Section 3. That any other ordinance or section passed and approved prior to passage, approval, and publication or posting of this ordinance and in conflict with its provisions, is hereby repealed. Section 4. DEMOLITION PROJECT: New information: Per Carothers, two properties are lined up for inspection, and two properties in the present demo project remain, with one with asbestos removed. The plan for the other is to “be sprayed when taking it down. ” “Asbestos not removed at the time demo equipment was available” prevented completion of the project (response to Reedy inquiry). Per Carothers, “looks like five houses will be in the next round.” It was noted that the concrete debris at one location has been removed, and material still needs to be removed from another, and some dirt work is needed at certain sites. CLEAN-UP: Improvement was noted at one clean-up location. Review will continue. Another property was designated to receive a clean up letter, and Hanson was asked to take pictures of that property for Carothers in the event further action is indicated. On person has a court date (14th) for removal of vehicles - six remaining. No movement was noted at another property and efforts will continue to try to get results. PLANNING AND ZONING: No new applications. BUILDING INSPECTOR/ ADOPTION OF BUILDING CODE: Described (Carothers ) “as a good thing, but people to do the inspections are needed.” Pros and cons were discussed before removing the topic from current consideration and the agenda at this time. GWORKS PROPOSAL/REDISTRICTING: Motion (Neumann), second (Seeman), and a 4-0 affirmative vote approved the Basic Plan ($1,000) of study, designation and mapping of Blue Springs Wards, this to be in compliance with State mandate. REVIEW OF WATER CHARGES: Water revenues were a subject of interest at the recent annual audit, and resultantly, Nebraska Rural Water will be contacted and requested (by Sedlacek) to have representation (Hellbusch) at the December 21st Regular meeting -- regarding a water study. Carothers stated that it is a good idea to have this done every 2-3 years. REPAIR/REPLACE PICKUP (Sedlacek): Problems with the current City truck (transmission slipping, using oil, front end off, etc.) have increased awareness that it is time to consider purchasing a replacement. Various avenues, as local car lot inquiry, looking into Federal surplus, etc. and prices were considered to locate a suitable replacement. Employee Pike will begin researching the options. Carothers indicated that any purchase should be supported proportionately by funds from the water, sewer, and street funds. Other: Hanson indicated his attendance was as a Law Enforcement member to ask members for concerns. Vehicles exceeding the speed limit in the mornings was discussed, as were vehicles driving through the City Park draw, and also illegal camping, shooting. Hanson urged that all unusual situations indicative of harmful possibilities be reported. Lights (out) at the City Park were discussed, with Meyer stating that Norris has been troubleshooting the problem, and wanted to verify that the lights are still wanted at the location, and to advise the City that Norris will continue with the restoration effort, (possibly at no or little cost to the City). (Adams) - Arrangements are in the works for relocation of “removed asbestos” to Milford disposal area. It was also noted (Adams) and agreed upon by members that Jay Woodyard is to be commended not only for the fine condition of his property, but his help in the demolition project, as well as his humanitarian support. CLEAN-UP: Of the four courtesy clean-up letters sent, one has removed the infraction and two have made contact to express intent to rectify the problem on their properties. Another property owner has been designated to receive a clean-up letter. Mayor Meyer advised that Dean Cole is seeking permission to pursue a grant for watching wildlife, and of his wish to have certain trees professionally removed in Feit Park, and which Adams expanded upon by indicating that removal of trees did not appear to be a frontline aspect of the grant guidelines, unless it somehow encompasses a plan for a platform, bench, etc. where people might sit and appreciate nature. It was believed that the grant requires 20% Municipal financial participation. No absolute decision was made. In further regard of Feit Memorial Park, Sedlacek asked that a copy of Ordinance 469 Park Regulation be sent to him so he can check into having a sign made to post in the park. PLANNING AND ZONING: No new applications. BUILDING INSPECTOR/ ADOPTION OF BUILDING CODE: Although it was not considered a timely topic by all members at this stage of community development, it was suggested as something of value (Seeman) to at least have a look at. Tabled until the next meeting. PLANS/SPECS FOR WATER LINE EXTENSION (GILMORE): Plans - Jefferson/Irving Streets have been prepared and will be submitted to the State for approval (a project expected to be in the area of $125,000), but may vary in cost depending on bid-letting to contractors, or if a decision is made for City workers to provide a primary or secondary work effort. OLDER BACKHOE/DUMP TRUCK (Purchase interest : Cemetery): It was noted (Meyer) that the City could sell the equipment directly only to another municipality, and that it should be let out for bids (Sedlacek, Adams) or put on Purple Wave. Although the equipment under scrutiny might be considered for sale at a future date, there are no current plans to remove them from City inventory. BLUE SPRINGS CEMETERY/GRAVE OPENING UPDATED RATE: A rate sheet of cities in the surrounding area was reviewed (and is attached to the office copy of the minutes). Comparative analysis established that the previously voted in rate of $450 per grave opening was competitive and sufficient to cover City costs, with no intent of “making money.” Martin indicated that the Cemetery would be making payment to the City for each opening rather than an annual payment for all openings. CLEAN-UP: Tim Hanson submitted statement information Calculations will be completed and payment to Hanson included in claims at the next Regular meeting. Hanson also provided a list of “Fall Property Issues” - fifteen properties, and was requested to identify and photograph five of the most pervasive for the City to send letters. A copy of that list is attached to the office copy of the minutes. Hanson stated that “municipal reputation” has been improving over the last few years, and he suggested the possibility of “Yard of the Week” recognition as positive reinforcement. Adams noted that there are various individuals who purchased property or are interested in purchasing/building in the municipality, with all hopeful that plans will be implemented in the near future. Two properties were removed from the clean up list, one for resolution of formally addressed issues (but with contact to be made about restricted tarping of vehicles), and another who has made minimal improvements, and in fact worsened the condition of the property (wood added) and so has a court date of October 26th. PLANNING AND ZONING: Fence application for Borgman/Wallman was approved by the P & Z Commission. Motion (Sedlacek), second (Neumann), 3-0 affirmative vote of Council to approve the fence permit. CHICKENS WITHIN CITY LIMITS: ORDINANCE # 468: Public Hearing of Planning/Zoning and Mayor/Council will be scheduled for Nov. 16, 2021, with notice in the local newspaper to be completed by Carothers CAMPING REGULATIONS (ORDINANCE # 469) : SIGNAGE/DROP BOX: Motion to suspend the rule of three readings of Ordinance # 469 (Neumann), second (Sedlacek), followed by a 3-0 affirmative vote. Motion to approve Ordinance 469 (Neumann), second Sedlacek, followed by the reading of the ordinance by Carothers, and then a 3-0 affirmative vote to approve/pass Ordinance # 469. BLUE SPRINGS CEMETERY: It was noted that the City needed to establish rate for “opening graves” based on determination of costs - including wages, machines in use, repairs/insurance, etc, thus last meeting’s motion, second, vote, to establish a rate of $450 per opening. Martin noted that the current cemetery cost to families is $350 to a weekend charge of $395. The City previously charged $65 per opening. Subsidized service by the City could be construed as misuse of taxpayer money. At the previous meeting members voted to approve raising the rate to $450 per grave opening, but members are open to further discussion supported by documentation and further research into the costs at other comparable communities. The topic will be revisited at the next Regular meeting, whereat the new rate may be re-determined, and the cemetery board can decide to accept the rate or may pursue the service elsewhere. Determination was made to put “Blue Springs Cemetery” on the next agenda to determine if the new rate will be accepted or service will be pursued elsewhere. CHICKENS WITHIN CITY LIMITS: ORDINANCE # 468: Changes were requested to the initial draft. November 2 (the date of the first Regular Meeting in November) was determined to be the date of the Public Hearing of the Planning and Zoning Commission and the Mayor and Council for consideration of passage for Ordinance # 468. GRAVE DIGGING RATES: Review continues for determination of increased charges for grave openings.Study into other community charges has thus far identified costs from $400 to $1,000. CHICKENS WITHIN CITY LIMITS: ORDINANCE # 468: Carothers provided all members with a copy of proposed Ordinance # 468, and he asked that everyone review it. Carothers indicated that it “will need public hearings before the Planning Commission and City Council”. A copy of the proposed ordinance is attached to the office copy of the minutes. CAMPING REGULATIONS: SIGNAGE/DROP BOX: Members discussed changes to Ordinance # 463 (Camping Regulations in Municipal Parks), to describe allowable camping as tents or campers, and clarifying (along with other prohibitive factors) that the park will not be available to those pulling into the park and desiring to sleep in their cars. A charge of $10.00 a night was also suggested for qualifying electrical hookup. It is in the current plan to have a sign made/and a drop box placed.
