The Regular Meeting of Mayor and Council of Blue Springs, Nebraska, was held starting at 7 PM, November 7, 2023, at the Blue Springs City Hall.
Mayor Meyer called the meeting to order, and roll call was taken.

PLANNING & ZONING - APPLICATION FOR BUILDING PERMITS (as submitted): No new applications.
DEMOLITION PROJECT: Asbestos testing being set up for two properties. Trees must be cleared for demolition or for controlled burn. In the event controlled burns can be done, the foundation may be removed after ash is removed. Not all consents have been acquired for one property. Another property is tentatively entered in the project for planned demolition in December. Carothers has sent letter/consent form to one property owner.
ARRANGEMENTS FOR CITY ACQUISITION OF PROPERTY - 300 W 2nd St, Lot 38, Jacob Casebeers Addition #006872000, Final arrangements.: Carothers did a title search. Determination was made that it was the only property in the deceased mother’s name. Carothers indicated that a small estate affidavit can be signed by the seller. Bockman can be contacted regarding asbestos, and demolition may be scheduled when title is clean and second party interest extinguished. Closing statement will be provided to City for the issuance of a check. Transfer to real estate will follow, and eviction of tenant as proves necessary.
CLEAN-UP/VEHICLES: Contact was made (letters/telephone) by Carothers in several circumstances to address ongoing clean-up infractions.
BLUE SPRINGS CITY PARK PROJECT 2023, INCLUDING PLANS, MATCH-FUND POSSIBILITIES/IN-KIND DETERMINATIONS, TIMELINES, ETC.: No new information. To be removed from agenda and returned at such time as supportive information and an action plan is in place.
RAISES (EMPLOYEES) - (Sedlacek): To be revisited in December.
CITY ENGINEER (REPLACEMENT): Sedlacek is meeting with CES Engineering tomorrow on behalf of Wymore, and Pike to attend as well, whereat, by suggestion of Reedy, the CES representative be invited to attend the next meeting of Blue Springs Mayor and Council.
EQUIPMENT (PIKE): Pike suggested selling new backhoe (limited usage , too big). Other equipment/materials were discussed and a plan suggested for sale on Purple Wave. Carothers asked for a list of items to enable him to draft a Resolution (#2023-4) to authorize sales.

ARRANGEMENTS FOR CITY ACQUISITION OF PROPERTY - 300 W 2nd St, Lot 38, Jacob Casebeers Addition #006872000, Final arrangements: Agreement has been signed between seller and buyer. A minor title issue is to be resolved by Carothers. It is understood that the occupant will receive $1,000 from OPAT at the time of evacuation. Should evacuation not transpire, there will be no $1,000 payment and the buyer (City) will begin eviction proceedings.
CLEAN-UP/VEHICLES: Application to sell the property has been drafted for one property, and property owner is to remove wanted materials from the property. If this is not done by November 1st, Carothers will draft nuisance notices to applicable individuals. If results of that action are not satisfactory, court filing against the owner will transpire. Carothers reported on other actions he had taken on other clean-up issues -- one property owner is slated for a December trial date. Carothers communicated with other property owners: spoke to one; will send nuisance notice to one occupant , in support of which Reedy will get the license plate number for Carothers. It was reported that Karen Dodge thanked all those involved with clean-up on one property. A courtesy clean-up letter will be drafted by the City Clerk for a property owner with a “blowing trash” issue. Carol Hughes volunteered to take pictures for Carothers of a nuisance infraction.

Rex Adams brought a worrisome situation, and expressed concern that the property owner apply for a building permit and review of safety standards in the situation. Carothers identified City adoption of building code options/conditions/ problems. No decisions were made at this time.
DEMOLITION PROJECT: Preparations continue for demolition/burn of project structures.
Adams noted that a second Summerfield house is planned in 2024. A structure built in 1857 was discussed with regard to potential salvage planned by owner Many options are being considered.
ARRANGEMENTS FOR CITY ACQUISITON OF PROPERTY - 300 W 2nd St, Lot 38, Jacob Casebeers Addition #006872000, Final arrangements: Carothers provided copies of drafted agreements. A few changes, primarily date) were made to the original draft. The closing was changed to November 1. The City will pay the legal fees. Owner is to pay one half of title insurance to acquire a good title). OPAT has $1,000 payment in place with Carothers for occupant
upon vacation of property. Owner is to contact Carothers to arrange an appointment whereat both agreements might be signed at the law office.
CLEAN-UP/VEHICLES: Determinations were made for letters to be sent as well as discussion with property owners who have come forward with questions about the nature of needed clean-up procedure. Letters already sent and legal actionin places were discussed.

STREET SIGNS/REPAIR/REPLACEMENT LIST OF NEEDS/ ACTION PLAN: Determination followed suggestion by Neumann that the street signs to be replaced/repaired would be only those missing or damaged.
EQUIPMENT - (INTERNATIONAL TRACTOR) - Pike: Pike indicated that the City should consider selling the tractor currently in inventory. Skid loader lease (Sedlacek) was suggested. Pike stated that a skid loader would not be as handy and potentially not as long-term cost effective for the City, and suggested purchasing another tractor. Sedlacek suggested cab with heat/air. Neumann suggested Pike contact dealers and determine what he could “live with.”

The Budget Hearing of Blue Springs, Nebraska was held the 5th day of September, 2023, at the Blue Springs City Hall. Notice of the budget hearing was published in the Fairbury Journal - News newspaper on August 30, 2023. Notice of the hearing/meeting was simultaneously given to the Mayor and all members of the City Council and a copy of their acknowledgment of receipt and agenda are placed on file. Availability of the agenda was communicated in the advance notice and in the advance notice to the Mayor and City Council of the hearing/meeting.

The budget hearing was opened at 7 PM, September 5, 2023. : Motion (Sedlacek), Second (Riensche), followed by 3-0 affirmative vote) Three copies of the proposed budget statement were available to the public.
Attorney Andrew Carothers made a presentation outlining the key provisions of the proposed budget statement as directed in the prepared budget notes, including, but not limited to, a comparison with the prior year’s budget.
The floor was then opened for public comment on the proposed budget statement. All members of the public wishing to address the governing body were provided a reasonable amount of time to do so.
There being no further business, a motion was made by Sedlacek, seconded by Riensche, and followed by a 3-0 affirmative vote (Neumann, Riensche, Sedlacek) to adjourn the budget hearing at 7:20 PM.
The Special Hearing of Blue Springs, Nebraska was opened: Motion (Neumann), Second (Riensche), followed by a 3-0 affirmative vote (Neumann, Riensche, Sedlacek) - at 7:21 PM on the 5th day of September , 2023, at the Blue Springs City Hall. Attorney Andrew Carothers presented the information related to the setting of the final tax levy as published. The related resolution # 2023-2 was prepared. The floor was opened for public comment on the tax levy. All members of the public wishing to address the governing body were provided a reasonable amount of time to do so.

Discussion ensued regarding asbestos testing, OPAT $1,000 donation to speed evacuation of resident, City Acquisition from Raineys for $5,500, all necessary paperwork to be put in place, and Mid-October potential scheduling. CONTINUED DISCUSSION: SETTING LEVY FOR 2023-2024 BUDGET: New valuations will not be available until August 20, 2023. Based on current values/but subject to notification of significant evaluation changes and advisement for change of accountant (Blobaum/Busboom), a motion was made (Sedlacek), seconded (Reedy), and followed by a 4-0 affirmative vote to leave levy at current percentage.
PLANNING & ZONING - APPLICATION FOR BUILDING PERMITS (as submitted): No new applications.
DEMOLITION PROJECT: One property has been returned to the demolition project list, and designated for consideration of City acquisition ($5,500) {Public Hearing Acquisition plans added to next agenda}. An OPAT initiated contact prompted parties to agree to declare agreement between them void and the occupant to vacate the property. Carothers will prepare the two-party declaration for signatures, and also obtain written consent for asbestos inspection of the premises. Another property is under consideration for addition to the demolition list .
CLEAN-UP/VEHICLES-LETTERS SENT BY ATTORNEY: Five letters were designated for clean-up infractions. Follow-up continues on previously drafted letters. (2). Verlyn Dodge expressed interest in development of a new section of town (duplex/new homes), and pursuit of property ownership identification and purchases.

SEWER/WATER TAP FEES: Discussion resulted in determination for Attorney Carothers to draft documentation (Ordinance # 474) to set the Sewer tap fee at $50, and the Water tap fee at $250.00 (up to 5/8 -3 / 4- / plus actual cost of meter if above).
STREET SIGNS/REPAIR/REPLACEMENT LIST OF NEEDS/ ACTION PLAN: A data base (quantities/prices) will be established for sign replacement needs (to replace black/white signs - (Midwest - supplier), and caps, posts, as may be required.
EQUIPMENT - (REF: INTERNATIONAL TRACTOR, BUSH HOG) - (PIKE): Pike described limitations of City tractor. A suggested price for a replacement unit was estimated: $3,000-$4,000, but with no options currently noted as available. Sedlacek suggested - “skid loader (lease). Prices will be researched and discussion will continue at the next Regular meeting.

PRELIMINARY DISCUSSION: SETTING LEVY FOR 2023-2024 BUDGET: Evaluations are anticipated to go up (residential market). Carothers advised evaluation/review to keep up on the issue. Debate will continue.
PLANNING & ZONING - APPLICATION FOR BUILDING PERMITS (as submitted) : No new applications for building permits. Due to moving outside of the community, Curt Hagerman gave verbal notice of his resignation from the Planning & Zoning Commission. He will be asked to submit a written resignation for the record.
Also: NEW P & Z MEMBER CANDIDATES: The name of Verlys Dodge was submitted for membership. Motion (Sedlacek), second (Reedy), and a 4-0 affirmative vote approved the acceptance of Verlys Dodge as a new member of the Planning & Zoning Commission.
DEMOLITION PROJECT: Attorney will send another round of letters . Trial for authorization of guardianship anticipated to conclude to move property sale (2 interested parties) forward to enable October-November clean-up (take down/or salvage as proves necessary). One property chosen by Fire Department for controlled burn. Other properties in the demolition projected are under consideration for controlled burns. Carothers will draft letter to one individual regarding request to inspect premises. Verlyn Dodge suggested members consider/evaluate a system of development on adjacent lots beginning with research into ownership identification.
CLEAN-UP/VEHICLES: Carothers agreed to take pictures in support of clean-up efforts. Adams will provide pictures also. Letters (by Carothers) will be sent for properties with junked vehicles.
BLUE SPRINGS CITY PARK PROJECT 2023, INCLUDING PLANS, MATCH-FUND POSSIBILITIES/IN-KIND DETERMINATIONS, TIMELINES, ETC.: Adams suggested research into grant possibility and feasibility study of a splash pad on Blue Springs City property (“caters to daycare age children, enhances the community.”) Dean Cole continues to pursue opportunities/grants/areas of interest.
JOHNSON SERVICE COMPANY: STUDY OF “LINING” COST : COST CALCULATIONS/ FUND TRANSFERS: Sedlacek provided data: Cost $55,014 to do lining on 5 sections of previously evaluated line (clay pipe), with mobility cost of an additional $500, resulting in a motion (Reedy), second (Neumann), and a 4-0 affirmative vote to proceed with the project.
SEWER/WATER TAP FEES: Tap fees will be reviewed/discussed further when all members are present.
STREET SIGNS/REPAIR/REPLACEMENT: A list will be made of signs that need to be replaced, as well as determinations of need for brackets, pole, etc. for decisions to be made potentially at the next Regular meeting.
