½% CITY SALES TAX: Attorney Carothers introduced Resolution 2024-01 for review. (Planned for the May 14th ballot, certification by March 1st. -- ½ % sales tax designated for general municipal purposes rather that for specific project (to pay off bonds) for a “sunset” project. ) Carothers indicated that he could get figures from the Department of Revenue as to how much revenue would be generated at the ½% rate. Sedlacek indicated he would like to see the figures first, and all members were in agreement. Carothers also indicated that it could go up to 1 ½ %.

DEMOLITION PROJECT: Consent for asbestos testing not yet received for two locations . Consent was given by one property owner. Plan is to schedule all asbestos testing within the same timeline, if possible.
ARRANGEMENTS FOR CITY ACQUISITION OF PROPERTY - 300 W 2nd St, Lot 38, Jacob Casebeers Addition #006872000, Final/closing arrangements: Since estate affidavit needs all sibling signatures and getting one signature could be difficult, an alternate avenue of action was discussed by members. Carothers indicated that an individual is interested in the property after City acquisition. Members discussed pros and cons of continuing along the path of acquisition, but recognized existing obstacles encountered (to get clear title) and leaned toward legal measures for gaining inspection which would move toward the City tearing the property down without City acquisition.
CLEAN-UP/VEHICLES: Court date soon to be determined for one property owner, and no response to letters to others contacted. After the first of year, complaints will be filed.
CITY ENGINEER (REPLACEMENT)/ Options to date: CES , JEO: Debate/decision delayed. No active projects at this time. Removed from agenda until need arises.
CRACK-SEALING SUB-CONTRACTING: Hosfelt pricing: $15,000 for 25 blocks. Primary concern area: 1st and 2nd Streets from A to Walnut, all of Walnut, A street from Broad to creek. Reedy volunteered to ride around with Mike to more clearly determine need, and Sedlacek will discuss a price for crack sealing with a second contractor - Tiemann.

DEMOLITION PROJECT: Carothers has sent another round of letters. Authorization has been received for two demolition sites. No authorization has been received for two others . Rex Adams may be asked to make contact with individuals who have not given authorization. Asbestos testing is planned for January. Inspection by Bockman is a possibility for one property and eviction proceedings as may prove necessary. An individual has shown interest in limestone, with some cleanup included from a burn site. OPAT has demolition of a trailer added to their list.

Charge state allowed amount for engineering/street superintendent for streets, water, sewer, trails, aquatic, flooding.; serve over 100 municipalities. CITY ENGINEER (REPLACEMENT)/ CES ENGINEERING: Rob Peschel, President of Engineers, Architects, Surveyors 605 Broadway, Marysville, Ks 66508 introduced himself, provided a brief overview (Street, Sewer, Water - Civil, with another office in Great Bend, Ks., 25 year experience - streets, 20 years experience - watershed, dams, 25 years experience highways, floods, with Diller, Plymouth, Beatrice affiliations, and answered questions (Reedy) regarding area served, experience, and (Sedlacek ) about stance to be taken on existing (approved) projects in regard to collaborative efforts. Considerations will be given, with decision pending.

SURPLUS EQUIPMENT LIST/RESOLUTION 2023-4: Not yet compiled. Employee Pike suggested delaying until Spring (tractor main source for cleaning streets) And he suggested consideration of upgrading the old dump truck in Spring as well.
SIDEWALKS/STREETS (REEDY): Replacement of sidewalk leading to City Hall (and going east) (Contractor: Taylor pricing of $2,800) was discussed with motion by Riensche, second by Neumann, and a 4-0 affirmative vote to proceed with the project. Sedlacek will make some calls (Lovell - Geneva one option) regarding pricing for subcontracting needed street sealing activity.
OTHER: Adams noted (resulting from recent County meeting about bridges) that surveys were/are being conducted and Federal assistance solicited for replacement of the Blue River Bridge, which might include a walkway, and kayak landing in the park. Determination was made at the meeting that the City Park bridge falls under City responsibility, and it was suggested (Sedlacek) that the approach be repaired and the tonnage lowered.

DEMOLITION PROJECT: Asbestos testing being set up for two properties. Trees must be cleared for demolition or for controlled burn. In the event controlled burns can be done, the foundation may be removed after ash is removed. Not all consents have been acquired for one property. Another property is tentatively entered in the project for planned demolition in December. Carothers has sent letter/consent form to one property owner.
ARRANGEMENTS FOR CITY ACQUISITION OF PROPERTY - 300 W 2nd St, Lot 38, Jacob Casebeers Addition #006872000, Final arrangements.: Carothers did a title search. Determination was made that it was the only property in the deceased mother’s name. Carothers indicated that a small estate affidavit can be signed by the seller. Bockman can be contacted regarding asbestos, and demolition may be scheduled when title is clean and second party interest extinguished. Closing statement will be provided to City for the issuance of a check. Transfer to real estate will follow, and eviction of tenant as proves necessary.
CLEAN-UP/VEHICLES: Contact was made (letters/telephone) by Carothers in several circumstances to address ongoing clean-up infractions.
BLUE SPRINGS CITY PARK PROJECT 2023, INCLUDING PLANS, MATCH-FUND POSSIBILITIES/IN-KIND DETERMINATIONS, TIMELINES, ETC.: No new information. To be removed from agenda and returned at such time as supportive information and an action plan is in place.
RAISES (EMPLOYEES) - (Sedlacek): To be revisited in December.
CITY ENGINEER (REPLACEMENT): Sedlacek is meeting with CES Engineering tomorrow on behalf of Wymore, and Pike to attend as well, whereat, by suggestion of Reedy, the CES representative be invited to attend the next meeting of Blue Springs Mayor and Council.
EQUIPMENT (PIKE): Pike suggested selling new backhoe (limited usage , too big). Other equipment/materials were discussed and a plan suggested for sale on Purple Wave. Carothers asked for a list of items to enable him to draft a Resolution (#2023-4) to authorize sales.

ARRANGEMENTS FOR CITY ACQUISITION OF PROPERTY - 300 W 2nd St, Lot 38, Jacob Casebeers Addition #006872000, Final arrangements: Agreement has been signed between seller and buyer. A minor title issue is to be resolved by Carothers. It is understood that the occupant will receive $1,000 from OPAT at the time of evacuation. Should evacuation not transpire, there will be no $1,000 payment and the buyer (City) will begin eviction proceedings.
CLEAN-UP/VEHICLES: Application to sell the property has been drafted for one property, and property owner is to remove wanted materials from the property. If this is not done by November 1st, Carothers will draft nuisance notices to applicable individuals. If results of that action are not satisfactory, court filing against the owner will transpire. Carothers reported on other actions he had taken on other clean-up issues -- one property owner is slated for a December trial date. Carothers communicated with other property owners: spoke to one; will send nuisance notice to one occupant , in support of which Reedy will get the license plate number for Carothers. It was reported that Karen Dodge thanked all those involved with clean-up on one property. A courtesy clean-up letter will be drafted by the City Clerk for a property owner with a “blowing trash” issue. Carol Hughes volunteered to take pictures for Carothers of a nuisance infraction.

PLANNING & ZONING - APPLICATION FOR BUILDING PERMITS (as submitted): There were no new applications. Rex Adams brought a worrisome situation, and expressed concern that the property owner apply for a building permit and review of safety standards in the situation. Carothers identified City adoption of building code options/conditions/ problems. No decisions were made at this time.
DEMOLITION PROJECT: Preparations continue for demolition/burn of project structures.
Adams noted that a second Summerfield house is planned in 2024. A structure built in 1857 was discussed with regard to potential salvage planned by owner Many options are being considered.
ARRANGEMENTS FOR CITY ACQUISITON OF PROPERTY - 300 W 2nd St, Lot 38, Jacob Casebeers Addition #006872000, Final arrangements: Carothers provided copies of drafted agreements. A few changes, primarily date) were made to the original draft. The closing was changed to November 1. The City will pay the legal fees. Owner is to pay one half of title insurance to acquire a good title). OPAT has $1,000 payment in place with Carothers for occupant
upon vacation of property. Owner is to contact Carothers to arrange an appointment whereat both agreements might be signed at the law office.
CLEAN-UP/VEHICLES: Determinations were made for letters to be sent as well as discussion with property owners who have come forward with questions about the nature of needed clean-up procedure. Letters already sent and legal actionin places were discussed.
