The Regular Meeting of Mayor and Council was held on April 21, 2015, in the Blue Springs City Hall, Blue Springs, NE.

Notice of the meeting/hearing was given in advance by posting in at least three public places as shown by the certificate of posting placed on file. Notice of the hearing/meeting was simultaneously given to the Mayor and all members of the City Council and a copy of their acknowledgment of receipt and agenda are placed on file. At 7:30 PM, Mayor Meyer called the Regular meeting to order and roll call was taken. A motion was made by Council member Wolf, seconded by Reedy, and followed by a 4-0 affirmative vote to approve as sent the April 7, 2015 Regular meeting minutes. After review of claims, a motion was made by Council member Mewes, seconded by Neumann, and followed by a 4-0 affirmative vote to approve claims as follow: Salaries : $1,916.34; Bank-Direct Payment - NE Dept. of Revenue (#10) - $260.14; Black Hills Energy - $28.88; City Motor Supply - $39.40; Constellation Energy - $25.64; Davidson Insurance (Annual Insurance Package) - $12,896.00; NE Dept. of Revenue (#51C) - $3,474.00; Office Depot - $591.90; Roehr’s Machinery - $12.65; Security First Bank (Pike - IRA) - $55.00; Windstream - $91.90; Total Claims: $ 19,391.85.
1994 EXMARK MOWER/”SURPLUS” RESOLUTION 2015-3: City Attorney Carothers read Resolution 2015-3. A motion was made by Council member Wolf, seconded by Neumann , and followed by a 4-0 affirmative vote to accept/approve Resolution 2015-3. The Resolution (full specifics) will be posted at the usual City posting locations (Post Office, Bank, City Office - at least 7 days prior to bid receipt deadline (7:30 PM 5/5/15, and bid opening 7:30 PM 5/5/15).
HJP PEST CONTROL: SEASONAL SPRAYING REVIEW: Discussion (Comments: “Might want to add one time, or go longer,” (Wolf) --- “I think he’ll work with us if we want to add another spraying at the end.” - (Reedy) --- “People feel good about City efforts” -- (Neumann) was followed by a motion by Council member Mewes, second by Neumann and a 4-0 affirmative vote to approve seasonal spraying as stipulated (Tuesdays --- June 2, June 16, June 30, July 14, July 28, August 11, with option for additional 1-2 spraying(s) if deemed necessary. (Base Price: $1,267.20 for six sprayings (which includes discount for prepayment.)
TELEPHONE COMPENSATION: WOUTZKE: A motion was made by Council member Wolf, seconded by Mewes, and followed by a 4-0 affirmative vote to approve monthly personal cell phone compensation (for City use) to Milford Woutzke in the amount of $5.00.
PLANNING & ZONING: Two applications for building permits (Rex - Adams, pole building - #15-2 and Ronnie Rainey - fence - #15-1 were approved by a 4-0 vote at the 4/20 meeting of the Planning and Zoning Commission. A motion by Council member Mewes, second by Neumann, and a 4-0 affirmative vote approved the Adams application for a building permit and the Rainey application. Both permits were prepaid. Notification of approval will be sent to both property owners.
CLEAN UP: Legal filing has been completed for one property on the clean-up list. Filing on another property is dependent on participation in Spring Clean-up Day (4/22), or independent removal of infractions within the same timeline.

ANNUAL INSURANCE PACKAGE: Mark Davidson provided handouts, and presented the Annual Insurance Policy (Estimated Total Policy Premium - $12,896.00, covering: property, liability, crime/fidelity, inland marine, automobile, Worker’s Compensation - Umbrella Coverage - w/ Other Explanation -- in summary 5% general increase, 6.5 % Worker’s Compensation). The Annual Insurance Policy was approved, excluding coverage on 1994 Exmark laser mower, by motion of Council member Reedy, second by Mewes, and a 4-0 affirmative vote. Details of the policy are available to the public at the City office.
ONE BLOCK ADDITION TO BROAD STREET ASPHALT PROJECT: No objections were made to adding one more block to the project, and a motion was made by Council member Neumann, second by Mewes, and followed by a 4-0 affirmative vote to approve addition of Jefferson Street to Saunders on Broad Street.
MOWER: PURCHASE-VS- ENGINE REPLACEMENT COST ANALYSIS: Purchase of a new motor (estimated at cost of $2,500 -- (Neumann - “according to Pike, needs new tires too”) was determined to be a poor option for the “out-of-service” 1994 Exmark mower (Meyer). By agreement of all members, Attorney Carothers will draft a Resolution (#2015-3) to designate it “surplus” and “for sale.“ Purchase of a new replacement unit was considered at the present to be ill-advised (all members). Future purchase will be based on a strong determined need and market availability, and at that time determinations will be made as to percentile assessment of cost between funds (General/Sewer/Street - 1/3 value each?)
WYMORE AMENDMENT # 2 - WATER SALE AND PURCHASE AGREEMENT WITH BLUE SPRINGS: Following discussion including conjecture of future increase and potential future response (in one year?) of the City to increase water charges to customers, a motion was made by Council member Wolf, seconded by Mewes, and received an 4-0 affirmative vote to accept/approve Wymore Amendment #2 - which increased the base rate to the city within a 3-year period, but did not elevate per thousand gallon charge. Details are available to the public at the City office.
PLANNING & ZONING: No new applications.
CLEAN UP: Pictures were requested (to be taken by Pike, and provided to Carothers) in support of legal clean-up action on two properties. No additions were made to the Clean-Up list, pending what is hoped to be the successful outcome of the upcoming Spring Clean-Up Day.

BROAD STREET ASPHALT PROJECT BID DECISION: Three bids were received and discussed: Cather & Son’s Construction (Lincoln) - Base Bid - $58,275.00/Base Bid with substitution - $54,775.00; Pavers, Inc - (Waverly) - Base Bid - $59,276.00/Base Bid with substitution - $52,845; Constructors, Inc. (Lincoln) - Base Bid $78,950.00/Base Bid with Substitution $75,410.00. The lowest qualifying bid for the three-block project on Broad Street- Pavers, Inc. - Base Bid with substitution $52,845.00 was recommended by Gilmore and Associates (Gilmore letter attached to the office copy of minutes) and accepted within a motion by Council member Neumann, second by Wolf and 4-0 affirmative vote, and option was left open for negotiating an additional block if contractor would be receptive to that provision with the same unit cost. John Berry will take measurements of the optional extra block and provide particulars for consideration.

GLENNIS MC CLURE / NGAGE: Glennis McClure presented information from ECAP - (needs assessment, community vision, embracing change, dedicated leaders, infrastructure, internet, commercial characteristics, as well as workshop and training, sense of place, education, and workforce. She also provided information on Municipal membership ($1,000) and gave survey percentages in regard to areas of community interest: attracting young families, clean up, revitalizing downtown, improving sidewalks, curbing, gutters, food service needs, etc. She said it is important to raise money for long-term development through such avenues as “philanthropy, giving back.”
CLEAN UP: Ashley Calkins provided pictures of a property with clean-up issues , and they will be forwarded to Carothers to support previous documentation provided to Carothers. A certified letter for trash removal was determined for one property.

CLEAN UP: City Attorney Carothers provided documentation for District Court Action for one property owner. Plans are still in place for demolition of one structure. Further progress noted on another property. A certified letter will be mailed to one property owner,and Employee Pike will take pictures for Carothers. Council member Reedy noted that a couple of groups are forming to address “community beautification issues.” Smaller tasks might be to help elderly people do some painting. Larger intent might be purchasing property. One group was identified as Ngage, the other as a number of interested individuals. John Berry indicated that grants are often available for rehabilitation projects, but he knew of nothing for purchase/demolition/use reassignment. Mayor Meyer noted that it would be acceptable for the groups to proceed on their own without participation of the City.

CLEAN UP: City Attorney Carothers provided documentation for District Court Action for one property owner. Plans are still in place for demolition of one structure. Further progress noted on another property. A certified letter will be mailed to one property owner,and Employee Pike will take pictures for Carothers. Council member Reedy noted that a couple of groups are forming to address “community beautification issues.” Smaller tasks might be to help elderly people do some painting. Larger intent might be purchasing property. One group was identified as Ngage, the other as a number of interested individuals. John Berry indicated that grants are often available for rehabilitation projects, but he knew of nothing for purchase/demolition/use reassignment. Mayor Meyer noted that it would be acceptable for the groups to proceed on their own without participation of the City.

MFO/INTERLOCAL AGREEMENT/RESOLUTION 2015-2: A motion was made by Council member Mewes and seconded by Neumann to approve Resolution #2015-2, with Brad Robinson as representative and Tom Wolf as alternate. Resolution # 2015-2 was read: (WHEREAS, the Nebraska State legislature has passed the Mutual Finance Assistance Act, which provides an opportunity for increased funding for fire districts, villages, and first-class cities: WHEREAS, in order to participate in an application for such funding, municipalities must join in an interlocal agreement with fire districts comprising at least 80% of the rural population of Gage County, Nebraska: WHEREAS, an agreement has been prepared that will meet the requirements of the Mutual Finance Assistance Act, and will result in specific state aid to Gage County for fire and rescue purposes, in addition to currently available funds: WHEREAS, the City of Blue Springs, Nebraska, is authorized to enter into such an agreement pursuant to the Interlocal Cooperation Act, and the Nebraska Mutual Finance Assistance Act; and WHEREAS, this Board or Council must appoint a representative and an alternate representative to sit on the joint board provided for in the reference agreement. NOW, THEREFORE, BE IT RESOLVED by this body that the City of Blue Springs, NE is authorized to execute the Interlocal Cooperation Agreement which accompanies this Resolution, providing for a uniform levy of three cents on each $100 of taxable valuation of a property subject to levy, and which distributes aid one-half on the basis of property valuation, and one-half on the basis of population. BE IT FURTHER RESOLVED, that Brad Robinson shall serve as a representative on the joint board for the Interlocal Agreement and Tom Wolf shall serve as an alternate representative to such board...)

NEMS TRAINING - 2/25 (WOLF): Council member Wolf summarized requirements. All City members who have not completed training within the past three years -- Mayor, Council, Board, all Fire Department, Ambulance, Sheriff, Police must attend the 7PM NEMS Training at the Wymore Community Center on 2/25/15. Only Council member Mewes will not be required to attend.

CLEAN UP: Pictures may need to be re-sent to Carothers for one property. Requirements have been met and plans are in place for the demolition of a sub-standard structure. Review continues on another property. Mayor Meyer suggested advertising Spring Clean-up in the Arbor State. No objections were made. PUBLIC HEARING OF THE ONE & SIX YEAR PLAN/ RESOLUTION #2015-1: Request by Mayor Meyer and motion by Council member Neumann, second by Mewes, and a 3-0 affirmative vote (Mewes - yes; Neumann - yes; Reedy - yes) opened the PUBLIC HEARING OF THE ONE AND SIX YEAR PLAN at 7:35PM. Mayor Meyer called for comments and questions. No objections were raised nor amendments made to the One & Six Year Plan as prepared.

At 7:55 PM (no new arrivals), a motion by Council member Mewes, second by Reedy, and an affirmative 3-0 vote closed the Public Hearing, followed, in Regular session by a motion
by Council member Neumann, second by Mewes to adopt Resolution 2015-1, the reading of the resolution, WHEREAS: Section 39-2115 and Section 39-2119, 1969 C.S. - R.S. of Nebraska 1943 requires that each County and Municipality prepares a one and six year, specific road or street improvement plan and to file same with the State Highway Commission on or before March 1, 2015, and WHEREAS: The Mayor and City Council of the City of Blue Springs, in compliance with the statutes and regulations of the State Highway Commission, did hold a public hearing on the proposed one and six year specific street improvement plans in the City Hall on February 3, 2015, in accordance with the “Notice of Public Hearing,” a certified copy of such notice is attached, and WHEREAS, There were no objections filed or amendments made to the one and six year plan on file with the City Clerk and as presented at the hearing now, THEREFORE BE IT RESOLVED: That the City Council does hereby approve said one and six year plan as filed with the City Clerk, a copy of which is attached hereto, BE IT FURTHER RESOLVED: That the Mayor of the City is authorized to sign this resolution on behalf of the City Council and the City Council hereby approves the proposed one and six year plan... Adopted this 3rd day of February 2015, AND THEN: the Vote: (Council Member Mewes - Yes, Neumann - Yes, Reedy-- Yes) to approve and adopt Resolution 2015-1.

CLEAN UP: Members briefly discussed one clean-up infraction remaining after a controlled burn, and which has been referred to the City Attorney. City Employee Pike notified members that “written consent” has been accomplished in support of a demolition project.
